No.32635 of 2008\nSatish Sharma, Son of Late Lalmani Sharma, Resident of village Chanaki, PS Dhanarua, District\n                                     Patna ---- Petitioner\n                                           Versus\n                            The State Of Bihar ---- Opposite Party\n                                          -----------\n<\/pre>\n<p>2      30.6.2011                       Heard learned counsel for the petitioner and the<\/p>\n<p>                           counsel appearing on behalf of the State.\n<\/p>\n<p>                                       The petitioner has been made accused in a case under<\/p>\n<p>                           Sections 498(A), 323, 324 and 307 of the Indian Penal Code.<\/p>\n<p>                           There is specific allegation that after six months of marriage in the<\/p>\n<p>                           year 1997, the husband, mother-in-law and father-in-law began to<\/p>\n<p>                           ill treat the victim lady (Smita Devi) and also set her on fire. The<\/p>\n<p>                           victim lady was treated at Rajeshwar Hospital at Patna. As far as<\/p>\n<p>                           this petitioner is concerned, he has not named in the First<\/p>\n<p>                           Information Report. It is stated on his behalf that he is not related<\/p>\n<p>                           to the victim lady and her husband in any manner.             In the<\/p>\n<p>                           circumstances, this Court cannot find any material in the order<\/p>\n<p>                           impugned dated 30.7.2007 which would justify the action of the<\/p>\n<p>                           Court below.\n<\/p>\n<p>                                       In a case such as this, the Court below should give<\/p>\n<p>                           specific details regarding the participation of a person specially in<\/p>\n<p>                           a case under Section 498(A), who is not related to the victim lady<\/p>\n<p>                           or her husband. In the result, this Court quashes the order dated<\/p>\n<p>                           30.7.2007 passed by the Sub-divisional Judicial Magistrate,<\/p>\n<p>                           Masaurhi (Patna) and remand the matter back to the Sub-<\/p>\n<p>                           divisional Judicial Magistrate, Masaurhi (Patna) to reconsider the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>         matter after looking into the case diary.\n<\/p>\n<p>                     I make it clear that in case the trial of this case has<\/p>\n<p>         commenced, then this order will have no effect.<\/p>\n<p>                     This application is allowed.\n<\/p>\n<\/p>\n<pre>Sanjay                                          ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Satish Sharma vs State Of Bihar on 30 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
