On which date the accused in the assassination of former<br \/>\n               Prime Minister Late Smt. Indira Gandhi was announced<br \/>\n               death sentence. And on which date did the court decide<br \/>\n               that the death sentence be executed, and on which date<br \/>\n               the Mercy Petition was submitted in the Office of<br \/>\n               President of India and on which date it was received in<br \/>\n               MHA and by which date it was again presented before<br \/>\n               the President of India after scrutiny. On which date the<br \/>\n               application was dismissed by the President and on which<br \/>\n               date he was sentenced to death.\n<\/p><\/blockquote>\n<blockquote><p>      2.       When the Court has announced death sentence to Shri<br \/>\n               Dhananjay Chatterjee accused in the West Bengal<br \/>\n               episode. And on which date did the court decide that the<br \/>\n               death sentence be executed. On which date the Mercy<br \/>\n               Petition was submitted in the Office of President of India<br \/>\n               and on which date it was received in MHA and by which<br \/>\n               date it was again presented before the President of India<br \/>\n               after scrutiny.     On which date the application was<br \/>\n               dismissed by the President and on which date was he\n<\/p><\/blockquote>\n<blockquote><p>      3.        hanged?\n<\/p><\/blockquote>\n<blockquote><p>      4.       When the Court has announced death sentence to Shri<br \/>\n               Afzal Guru. And on which date did the court decide that<br \/>\n               the death sentence be executed. On which date the<br \/>\n               Mercy Petition was submitted in the Office of President of<br \/>\n               India and on which date it was received in your Office.\n<\/p><\/blockquote>\n<blockquote><p>      5.       In above two cases of Late Smt. Indira Gandhi and Shri<br \/>\n               Dhananjay Chatterjee which rules\/ sub rules have been<br \/>\n               adopted. Whether now some changes have been done<br \/>\n               in that if so please provide the copy of the same rule\/ sub<br \/>\n               rule.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                        1<\/span><\/p>\n<blockquote><p>       To this he received a response dated 17-10-07 from CPIO, Shri N.N.\n<\/p><\/blockquote>\n<p>Perumal, Director who has received the application on 7-9-07:\n<\/p>\n<blockquote><p>      &#8220;Ans. To Ques. Nos. i, ii &amp; iii: The information is attached.<br \/>\n      Ans. To Ques. No. iv. : There is no change.&#8221;<\/p><\/blockquote>\n<p>      Attached with this are the different dates asked for including date of<br \/>\nissue of all death warrants and, where applicable, the date of execution.<br \/>\nUpon this Shri Dwivedi moved an appeal before the Appellate Authority, MHA<br \/>\npointing out the following issues on which he was dissatisfied with the<br \/>\ninformation provided:\n<\/p>\n<blockquote><p>      &#8216;1.    Which date was fixed by the court to give death sentence<br \/>\n             to the prisoners in case of Smt. Indira Gandhi? This date<br \/>\n             has not been mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      2.     On which date the MHA has completed the formalities in<br \/>\n             this case and produced before the President of India.<br \/>\n             This date has not been mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      3.     The date of Mercy Petition ahs been shown as October<br \/>\n             1988 but that date has not been mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      4.     Which date was fixed by the court to give death sentence<br \/>\n             to Shri Dhananjay Chatterjee? This date has not been<br \/>\n             mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      5.     On which date the MHA has completed the formalities in<br \/>\n             case of Shri Dhananjay Chatterjee and produced before<br \/>\n             the President of India. This date has not been mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      6.     Which date was fixed by the court to give death sentence<br \/>\n             to Shri Afzal Guru accused in the case of attack on<br \/>\n             Parliament? This date has not been mentioned.\n<\/p><\/blockquote>\n<blockquote><p>      7.     That the enclosure with letter No. F. 16\/9\/2007 Legal Cell<br \/>\n             dated 17th October, 2007 has not been certified by any<br \/>\n             competent officer and the application of applicant dated<br \/>\n             30 August 2007 has been shown as 3rd September, 2007,<br \/>\n             which in any case as per the version of PIO does not<br \/>\n             come under the RTI Act whereas it comes in the category<br \/>\n             of incomplete, misleading and fraudulent.&#8221;<\/p><\/blockquote>\n<p>      Upon this Shri Shashi Bhushan, JS MHA in his order of 4-12-07<br \/>\nresponded in detail as follows:\n<\/p>\n<blockquote><p>      &#8220;In case of death of Smt. Indira Gandhi:<br \/>\n      Answer to Q.1: The Session Judge, Delhi has issued warrant on<br \/>\n             12-10-1998 to give death sentence to the prisoners<br \/>\n             Satwant Singh and Kehar Singh.\n<\/p><\/blockquote>\n<blockquote><p>       Answer to Q.2: This Ministry has sent the file of prisoners for<br \/>\n             the orders of President of India on 17-10-1988.<br \/>\n      Answer to Q.3: No mercy petition was received from Satwant<br \/>\n             Singh or Kehar Singh, whereas Shri Rajinder Singh son<br \/>\n             of Kehar Singh has sent one petition on 14-10-1988.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<blockquote><p>        In case of Dhananjay Chatterjee:\n<\/p><\/blockquote>\n<blockquote><p>       Answer to Q.4: The Addl. Session Judge, Court No. II, Alipore<br \/>\n              has issued warrant dated 25-9-1994 and 26-6-2004 to<br \/>\n              give death sentence to the prisoner Dhananjay Chatterjee.<br \/>\n       Answer to Q.5: This Ministry has sent the file of prisoner for the<br \/>\n              orders of President of India on 9-6-1994 and again on 2-<br \/>\n              7-2004.\n<\/p><\/blockquote>\n<blockquote><p>       In case of attack on the Parliament:\n<\/p><\/blockquote>\n<blockquote><p>       Answer to Q.6: The Addl. Session Judge, Delhi has issued<br \/>\n              warrant dated 20-10-2006 to give death sentence to the<br \/>\n              prisoner Mohammed Afzal.\n<\/p><\/blockquote>\n<blockquote><p>       Answer to Q.7: The signed copy of Annexure is attached with<br \/>\n              letter No.16\/9\/2007-RTI dated 17-10-2007&#8243;<\/p><\/blockquote>\n<p>       Still not satisfied, however, appellant moved an appeal before us with<br \/>\nthe following prayer:\n<\/p>\n<blockquote><p>          1. &#8220;The appellant may be provided information from the<br \/>\n             respondent that when the different courts have<br \/>\n             issued orders for giving death sentence in case of<br \/>\n             Smt. Indira Gandhi, Dhananjay Chatterjee and attacks<br \/>\n             on Parliament.\n<\/p><\/blockquote>\n<blockquote><p>          2. That appellant be awarded Rs. 250\/- a day from the<br \/>\n             respondents for harassing him till the date of<br \/>\n             providing information.\n<\/p><\/blockquote>\n<blockquote><p>          3. That disciplinary action be taken against the<br \/>\n             respondents and compensation        be awarded to<br \/>\n             the appellant whichever is in the interest of<br \/>\n             appellant.&#8221;<\/p><\/blockquote>\n<p>       The appeal was heard through videoconference on 2-9-2009.            The<br \/>\nfollowing are present.\n<\/p>\n<p>       Appellant at NIC Studio, Sultanpur.\n<\/p>\n<p>       Shri Shivsagar Dwivedi.\n<\/p>\n<p>       Respondents at CIC Studio, New Delhi<br \/>\n       Shri Shashi Bhushan, Joint Secretary (J), AA.<br \/>\n       Shri Mohinder Singh, Director (J), CPIO.<br \/>\n       Shri Manoj Kumar Singh, SO (JII0<\/p>\n<p>       Shri Dwivedi was asked to clarify which specific information he felt has<br \/>\nnot been provided.       He pointed out the following sentence in his initial<br \/>\napplication:\n<\/p>\n<blockquote><p>       &#8220;And on which date did the court decide that the death sentence<br \/>\n       be executed.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>        Upon this he was informed by JS Shri Shashi Bhushan that it is not the<br \/>\npractice of the Court to lay down a date of execution. Upon this appellant Shri<br \/>\nDwivedi stated that this is the only piece of information that he required and<br \/>\nthis should have been provided to him in the initial stage.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>       The only issue remaining outstanding before us was the specific date<br \/>\nsought by appellant. It is not the practice in law that such dates are specified<br \/>\nby the Court. CPIO, therefore, cannot be faulted for not having provided this<br \/>\ndate or clarified that this is not the practice in law, since this amounts to a<br \/>\nsimple legal opinion not necessarily applicable only to the information sought<br \/>\nby appellant. Nor did appellant press his plea of harassment. Nevertheless,<br \/>\nthe information sought having now been supplied to the appellant Shri<br \/>\nShivsagar Dwivedi to his satisfaction, this appeal may be treated as disposed<br \/>\nof.\n<\/p>\n<p>       Announced in the hearing.
