Public Prosecutor, Mr.L.R.Pujari and learned advocate,<br \/>\n\tMr.A.B.Munshi, waive service of notice of rule on behalf of the<br \/>\n\trespondent Nos.1 and 2 respectively.\n<\/p>\n<p>The<br \/>\n\tpresent application under Sec.482 of the Code of Criminal Procedure<br \/>\n\thas been filed for quashing of FIR registered as I.C.R.No.15 of 2011<br \/>\n\tbefore Athwa Police Station, Surat for the offences punishable under<br \/>\n\tSecs.420, 465, 467, 468, 471, 504, 506(2), 120-B and 114  of IPC in<br \/>\n\tpursuance of complaint filed by the respondent No.2-complainant.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.Ashish Dagli  for the petitioners, learned<br \/>\n\tAddl. Public Prosecutor, Mr.L.R.Pujari for the respondent No.1 and<br \/>\n\tlearned advocate, Mr.A.B.Munshi,  for the respondent No.2.\n<\/p>\n<p>It<br \/>\n\tis jointly submitted by the learned Counsel for the parties that the<br \/>\n\tmatter is settled between the parties and the terms of settlement is<br \/>\n\talso placed on record which is ordered to be taken on record.<br \/>\n\tLearned APP Mr.Pujari has also verified from the Investigating<br \/>\n\tOfficer and submitted that appropriate order may be passed.\n<\/p>\n<p>The<br \/>\n\tApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\n\treported in (2008)4  Supreme Court Cases page 582 has<br \/>\n\tobserved as under in paras 5 and<br \/>\n\t7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.<br \/>\n\t Applying the ratio of the aforesaid decision of the Apex<br \/>\n\tCourt to the facts of the present case, I am of the opinion that<br \/>\n\tthis Cri. Misc. Application is required to be allowed and the<br \/>\n\tparties be permitted to compound the offence.\n<\/p>\n<p>7.<br \/>\n\t  In the result, this Cri. Misc. Application is allowed. The<br \/>\n\tcomplaint being  I.C.R.No. 15 of 2011 registered before Athwa Police<br \/>\n\tStation, Surat and the proceedings therein are required to be<br \/>\n\tquashed and are accordingly quashed. Rule is made absolute.
