Aslam Ansari, Adv.\n<\/p>\n<p>                                    &#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<\/p>\n<p>2.   9.8.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The     petitioner    was     proceeded     with<\/p>\n<p>                 departmentally in his capacity as a Warder in the Sub-<\/p>\n<p>                 Divisional Jail at Nawada when two under trial prisoners<\/p>\n<p>                 escaped on 4\/5th July 1998. He has been visited with<\/p>\n<p>                 punishment inter alia that nothing beyond subsistence<\/p>\n<p>                 allowance was payable for the period of suspension.<\/p>\n<p>                            Counsel for the petitioner contended from the<\/p>\n<p>                 enquiry report that the enquiry officer has opined that the<\/p>\n<p>                 window grill through which the prisoners escaped had been<\/p>\n<p>                 weakened over a period of time.     The petitioner therefore<\/p>\n<p>                 cannot be held guilty for their escape. The punishment<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>imposed is thus excessive in the nature of the findings of the<\/p>\n<p>enquiry officer.\n<\/p>\n<p>            Counsel for the State submitted that in his reply<\/p>\n<p>to the charges and during the proceeding the petitioner had<\/p>\n<p>not denied or disputed that he was on duty when the escape<\/p>\n<p>had taken place.\n<\/p>\n<p>              The charge was that two prisoners escaped<\/p>\n<p>when the petitioner was on duty as the Warder in the Jail. If<\/p>\n<p>he acknowledges that their escape took place during his<\/p>\n<p>duty hours, the charge has been admitted.       If the charge<\/p>\n<p>stands admitted, all alleged procedural lapses, if any, in the<\/p>\n<p>departmental proceeding automatically loose their relevance.<\/p>\n<p>The petitioner cannot absolve himself of the liability if the<\/p>\n<p>escape took place during his duty hours and the explanation<\/p>\n<p>given by him has not been found acceptable. This Court<\/p>\n<p>cannot act as an appellate authority to sit over the view of<\/p>\n<p>the enquiry officer and substitute its own view only because<\/p>\n<p>another view may be possible on the same facts.<\/p>\n<p>            In view of the Division Bench judgment of this<\/p>\n<p>Court in 2006(4) PLJR 514 (Dinesh Prasad Vs. State of Bihar<\/p>\n<p>&amp; Ors.), the punishment that nothing beyond subsistence<\/p>\n<p>allowance shall be payable for the period of suspension<\/p>\n<p>stands vitiated in absence of prior show cause notice as held<\/p>\n<p>in Paragraph-9 of the aforesaid judgment which reads as<\/p>\n<p>follows:-\n<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><\/p>\n<blockquote><p>                                     &#8220;9. Apart from these question, so<br \/>\n                        far the main question for which this matter<br \/>\n                        has been referred, is concerned, it appears<br \/>\n                        that for imposing the punishment no. (iii) that<br \/>\n                        the petitioner shall not get anything for the<br \/>\n                        period of suspension save and except the<br \/>\n                        subsistence allowance, the disciplinary<br \/>\n                        authority was required to give separate show<br \/>\n                        cause notice to the delinquent in terms of<br \/>\n                        Rule 97(3) of the Code. This part of the order,<br \/>\n                        therefore, is not permissible in absence of any<br \/>\n                        such notice to the delinquent employee&#8221;<\/p>\n<p>                   The punishment to that extent only is quashed.<\/p>\n<p>                   This Court had held that the charge has been<\/p>\n<p>           admitted by the petitioner. The quantum of punishment is<\/p>\n<p>           the jurisdiction of the employer normally. This Court is not<\/p>\n<p>           satisfied that the nature of punishment imposed calls for<\/p>\n<p>           interference by this Court on the aspect of quantum. If the<\/p>\n<p>           petitioner represents with regard to the quantum of<\/p>\n<p>           punishment and seeks to rely upon any findings during the<\/p>\n<p>           enquiry that is a matter to be considered appropriately by<\/p>\n<p>           the disciplinary authority itself.\n<\/p><\/blockquote>\n<blockquote><p>                   Any such representation is expected to be considered<\/p>\n<p>           and disposed off in accordance with law within a maximum<\/p>\n<p>           period of three months from the date of receipt and\/or<\/p>\n<p>           presentation of such representation.<\/p>\n<\/blockquote>\n<blockquote><p>                   The application stands allowed only to the extent<\/p>\n<p>           indicated.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<pre>P.
