NO.183    OF 1994\n\n               ===========================\n\n\n\n         Dated this the  3rd day of July, 2007\n\n\n\n                           JUDGMENT\n<\/pre>\n<p>     Plaintiff   in   O.S.385\/1986   on   the   file   of<\/p>\n<p>Munsiff   Court,   Alapuzha           is   the   appellant.\n<\/p>\n<p>Defendants are the respondents. Suit was instituted<\/p>\n<p>seeking   a   decree   for   settlement   of   accounts   and<\/p>\n<p>permanent   injunction.     Appellant   was   the   Abkari<\/p>\n<p>contractor   who   enjoyed   the   privilege   of   sale   of<\/p>\n<p>arrack in shop Nos.5,6,7, 11 to 14 of Abkari range<\/p>\n<p>during   the   year   1984-85.   According   to   appellant,<\/p>\n<p>the monthly quota to be supplied was 5140 litres of<\/p>\n<p>arrack   and   Government   has   also   an     obligation   to<\/p>\n<p>supply   additional   quota   of   arrack   as   and   when<\/p>\n<p>demanded,     but     Government   failed   to   supply   the<\/p>\n<p>monthly   quota   for   the   month   of   February   1985   and<\/p>\n<p>additional    quota  as  demanded  by  the  appellant  and<\/p>\n<p>because   of   the   violation   of   the   statutory   and<\/p>\n<p>contractual   obligations,   appellant   sustained   loss<\/p>\n<p>and   therefore   appellant   is   entitled   to   recover<\/p>\n<p><span class=\"hidden_text\">S.A.183\/1994                            2<\/span><\/p>\n<p>damages.                  Contending         that         the         demand         for<\/p>\n<p>realisation   of   Rs.6,87,730.50   by   the   State   as   the<\/p>\n<p>balance   kist   amount   is   not   correct   and   she   is<\/p>\n<p>entitled   to   the   damages   caused   for   the   non-supply<\/p>\n<p>of   arrack,                appellant   sought   a   settlement   of<\/p>\n<p>accounts and for a permanent prohibitory injunction<\/p>\n<p>restraining   respondents   from   realising   the   amount<\/p>\n<p>by   recourse   to   the   provisions   of   Revenue   Recovery<\/p>\n<p>Act.  Respondents resisted the suit contending that<\/p>\n<p>the   monthly   quota   for   February,   1985   was   supplied<\/p>\n<p>and Government has an obligation to supply only the<\/p>\n<p>monthly  quota  and  there  is  no  obligation  to  supply<\/p>\n<p>additional quota as and when demanded and therefore<\/p>\n<p>appellant   is   not   entitled   to   claim     damages   and<\/p>\n<p>State   is   entitled   to   realise   the   balance   kist<\/p>\n<p>amount   under   the   provisions   of     Revenue   Recovery<\/p>\n<p>Act.   Learned Munsiff on the evidence of Pws 1to 4<\/p>\n<p>and   Exts.A1,   A2   and   X1   and   X2   series   found   that<\/p>\n<p>appellant is not entitled to any damages on account<\/p>\n<p>of   the   failure   of   the   Government   to   supply   the<\/p>\n<p>monthly   quota   for   the   month   of   February,   1985   or<\/p>\n<p><span class=\"hidden_text\">S.A.183\/1994                         3<\/span><\/p>\n<p>additional quota as demanded and State is  entitled<\/p>\n<p>to   realise   the   balance   kist   amount   under   the<\/p>\n<p>provisions   of   Revenue   Recovery   Act   and   dismissed<\/p>\n<p>the   suit.     It   was   challenged   before     District<\/p>\n<p>Court,   Alapuzha   in   A.S.45\/91.   On   reappreciation   of<\/p>\n<p>evidence,   learned   District   Judge   found   that   there<\/p>\n<p>was   non-supply   of   monthly   quota   during   February,<\/p>\n<p>1985   but   as   the   appellant   did   not   rescind   the<\/p>\n<p>contract   and           by   enjoying   the   contract   she<\/p>\n<p>signified   her   acquiescence   and   hence   is   not<\/p>\n<p>entitled to claim damages for the non-supply of the<\/p>\n<p>monthly   quota   during   February,   1985.                            Learned<\/p>\n<p>District   Judge   relying   on   the   decision   of   this<\/p>\n<p>Court   in       Krishnan   v.State   of   Kerala   (1985<\/p>\n<p>K.L.T.1159)          and         Devassya         v.         Asst.         Excise<\/p>\n<p>Commissioner   (1987(1)   KLT   244)                    found   that   the<\/p>\n<p>contract   in   the   case     was   in   accordance   with   the<\/p>\n<p>modified   conditions,   which   does   not   provide   an<\/p>\n<p>obligation   to   supply   additional   quota   as   and   when<\/p>\n<p>demanded   and   for   the   non-supply   of   additional<\/p>\n<p><span class=\"hidden_text\">S.A.183\/1994                       4<\/span><\/p>\n<p>quantity   of   arrack   demanded   by   the   appellant,she<\/p>\n<p>is   not   entitled   to   claim   damages.   Learned   District<\/p>\n<p>Judge   also   found   that   respondents   are   entitled   to<\/p>\n<p>realise   the   balance   kist   amount   under   the<\/p>\n<p>provisions  of  Revenue  Recovery  Act  as  held  by  this<\/p>\n<p>court   in          Gourikutty   Amma   v.   Dist.Collector,<\/p>\n<p>Alleppey   (1975   KLT   29)  and   dismissed   the   appeal.\n<\/p>\n<p>It is challenged in this Second Appeal.\n<\/p>\n<p>      2.    Second  appeal  was  admitted formulating  the<\/p>\n<p>following substantial questions of law.\n<\/p>\n<pre>      1)     When   there   is   default   on   the   part   of\n\n\n\ndefendants   in   satisfying     its   obligations   under   a\n\n\n\n<\/pre>\n<p>contract, resulting in damage to the  plaintiff and<\/p>\n<p>damages   is   not   quantified,   will   not   the   plaintiff<\/p>\n<p>be entitled to sue for settlement of accounts, when<\/p>\n<p>money is claimed as against plaintiff also?\n<\/p>\n<p>      2)          When   plaintiff   is   not   a   defaulter   as<\/p>\n<p>defined   under   the   Kerala   Revenue   Recovery   Act,   is<\/p>\n<p>there   any   bar   for   the   suit   under   section   72   of<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.S.Susheela vs State Of Kerala on 3 July, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM SA No. 183 of 1994() 1.
