\ndeserves to”   the delay is<\/p>\n

3. T’l1e”appellant’  selected as a process server.<\/p>\n
  ent{‘yit..,,muto,.sewice, he was placed under<\/p>\n
 \u00bbp1fobati.oi1. ‘el-lfaV_ing evaluated his work and conduct, the<\/p>\n
Civil Jud’ge,,’.1′ Junior Division, Channagiri, by a<\/p>\n
‘.Vcomrnulni_cation dated 06.10.2006 recommended, that<\/p>\n
0’ lffthvellservices of the appellant be con\ufb01rmed. Despite the<\/p>\n
  aforesaid, by an order dated 14.02.2007, the probation<\/p>\n
 of the appellant was not cleared, in as much as, the<\/p>\n
appellant was relieved from service.<\/p>\n

the1_appelllalf1tl.has interalia undertaken as under:–<\/p>\n
“1′}V_.l*i’hat in case the appellant is reinstated into<\/p>\n
  he shall forego all his backwages.<\/p>\n
ii] That on his reinstatement. the appellant shall
\nre–comrnence his employment as a probationer, in terms
\nof the provisions of the Karnataka Civil Service<\/p>\n
[Probation] Rules, 1977<\/p>\n

8. We have considered the solitary contention
\nadvanced at the hands of the learned counsel for the<\/p>\n
appellant, as has been noticed in the foregoing<\/p>\n
paragraphs. We are satisfied, that <\/p>\n
contained in Rule 6(2) of the Karnataka <\/p>\n
(Probation) Rules, 1977, is clearfanlunarnbiguou_s,_finals.<\/p>\n
much as, before the services of aKpr’obation”er’ are to'”‘ne’v,<\/p>\n
dispensed with, it is  g for”  to
\ninform him, the grounds   indicating
\nthe same in the orderwoif Thus viewed,
\nsince it is     of discharge of
\nthe   in the order dated<\/p>\n
14.o2.:,2oQ~r]ere.fee,rie,r1ed, that the said order<\/p>\n
deserves. to ‘be. aside being violative of Rule 6(2) of<\/p>\n
 ,the,l  Civil Service (Probation) Rules, 1977.<\/p>\n
‘Ordered aCcor.ding1y.\n<\/p>\n
 *  9;” In View of the aforesaid, it is necessary to
\n.’   that consequent upon the disposal of the instant<\/p>\n
 appeal, the appellant shall stand reinstated into<\/p>\n
service, forthwith. On his reinstatement, he shall not be
\nentitled to any backwages. His emoluments shall<\/p>\n
commence from the minimum of the scale. On his<\/p>\n

reinstatement, he shall remain on probation, in terms of<\/p>\n
the provisions of the Karnataka Civil Service [Probation},:. “\u00bba.<\/p>\n
