Even the Restoration Application<br \/>\n\thas been dismissed in the year 2002.  The defendants therefore,<br \/>\n\tfiled application Exh.58 to reject the plaint for non-payment of<br \/>\n\trequired court fee stamp and to reject the plaint as it is barred by<br \/>\n\tlaw.  The City Civil Court vide order dated 1\/8\/2007 rejected the<br \/>\n\tplaint.  It is against the said order the present appeal has been<br \/>\n\tfiled.\n<\/p>\n<p>The<br \/>\n\tTrial Court has considered the fact that earlier suit for the very<br \/>\n\tsame prayer has been dismissed and even the restoration application<br \/>\n\tcame to be dismissed.  The second suit has been filed by heirs of<br \/>\n\tKalavatiben.  Therefore, same persons claimed identical relief.  The<br \/>\n\tTrial Court has found that the suit was clearly barred under Rule 9<br \/>\n\tOrder 9 of the CPC.  I am in complete agreement with the reasonings<br \/>\n\tadopted and findings arrived at by the Trial Court.\n<\/p>\n<p>The<br \/>\n\tlearned counsel for the appellants has relied upon the judgment of<br \/>\n\tMadras High Court in the case of Kuppuswami alias Mannakatti and<br \/>\n\tothers vs. Nagarathina Gounder and others, reported in 2000 AIHC<br \/>\n\t1563.  On the facts of the case, the said decision is not<br \/>\n\tapplicable.\n<\/p>\n<p>In<br \/>\n\tview of the above, the appeal is dismissed.
