No.4040 OF 2008\n           -----------------------------------------------\n         Dated this the 12th day of December, 2008\n\n                              ORDER\n<\/pre>\n<p>     Revision Petitioners are the accused and second<\/p>\n<p>respondent the complainant in ST No.159\/06 on the file of<\/p>\n<p>Judicial First Class Magistrate-IV, Kochi. Revision Petitioners<\/p>\n<p>were convicted and sentenced for the offence under section<\/p>\n<p>138 of the Negotiable Instruments Act. They challenged the<\/p>\n<p>conviction before the Additional Sessions Judge (Adhoc-II)<\/p>\n<p>Ernakulam in Crl.A.No.320\/08. The learned Sessions Judge<\/p>\n<p>on reappreciation of the evidence confirmed the conviction,<\/p>\n<p>and sentence and dismissed the appeal. It is challenged in<\/p>\n<p>the revision.\n<\/p>\n<p>     2.    Learned counsel for the revision petitioners<\/p>\n<p>submitted that in view of the concurrent findings of the fact<\/p>\n<p>and the evidence on record,         revision petitioners are not<\/p>\n<p>challenging the conviction and sentence may be modified<\/p>\n<p>and one months time to be granted to pay the amount.<\/p>\n<p>CRRP.NO.4040\/08<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>     3.    On going through the judgment of the Courts<\/p>\n<p>below, I find no reason to interfere with the conviction. The<\/p>\n<p>evidence establish that Ext.P1 cheque was issued by the<\/p>\n<p>revision petitioner towards payment of Rs.25,000\/- due<\/p>\n<p>from him. It is also proved that cheque was dishonoured for<\/p>\n<p>want of sufficient funds and first respondent had complied<\/p>\n<p>with all the statutory formalities provided under section 138<\/p>\n<p>and 142 of the Negotiable Instruments Act. Conviction for<\/p>\n<p>the offence under section 138 of Negotiable Instruments Act<\/p>\n<p>is perfectly legal.\n<\/p>\n<p>     4.    Then the only question is regarding the sentence.<\/p>\n<p>So long as the sentence is not a varied or modified against<\/p>\n<p>the interest of the second respondent it is not necessary to<\/p>\n<p>issue notice to the second respondent. Ext.P1 cheque was<\/p>\n<p>issued   towards the payment of Rs.25,000\/- . Magistrate<\/p>\n<p>sentenced first petitioner to simple imprisonment for two<\/p>\n<p>months and pay compensation of Rs.25,000\/- to first<\/p>\n<p>respondent. Second petitioner      was sentenced to fine of<\/p>\n<p>CRRP.NO.4040\/08<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>Rs.5,000\/-. The learned Sessions Judge confirmed the<\/p>\n<p>sentence. But considering the entire facts of the case the<\/p>\n<p>sentence as against first revision petitioner is modified to<\/p>\n<p>simple imprisonment till rising of court and fine of<\/p>\n<p>Rs.25,000\/- and in default simple imprisonment for 2<\/p>\n<p>months with a direction to pay the fine on realisation to<\/p>\n<p>second respondent as compensation. I find no reason to<\/p>\n<p>interfere with the sentence as against the second revision<\/p>\n<p>petitioner.\n<\/p>\n<p>      Revision is allowed in part . Conviction of the revision<\/p>\n<p>petitioners for the offence under section 138 of the<\/p>\n<p>Negotiable Instruments Act and the sentence as against the<\/p>\n<p>second revision petitioner is confirmed.    The sentence as<\/p>\n<p>against first revision petitioner is modified and he is<\/p>\n<p>sentenced to imprisonment till rising of Court and to pay<\/p>\n<p>fine of Rs.25,000\/-and in default simple imprisonment for<\/p>\n<p>two months. On realisation of the said fine, it is to be paid<\/p>\n<p>to second respondent as compensation under section 357<\/p>\n<p>CRRP.NO.4040\/08<br \/>\n<span class=\"hidden_text\">                                4<\/span><\/p>\n<p>(1) (b) of the Code of Criminal procedure.
