SHAH\n\t\t\n\t\n\n \n\nDate\n: 11\/01\/2010 \n\n \n\n \n \n\n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioners   heirs of original landlord have prayed<br \/>\nfor an appropriate writ, order and\/or direction, quashing and setting<br \/>\naside the orders dated 30\/08\/1997 and 13\/10\/1999 passed by Mamlatdar<br \/>\n&amp; ALT, Gandhinagar as well as Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat respectively, which are at Annexure  C<br \/>\nand  D  respectively by holding that the application filed by<br \/>\nrespondent Nos.2 and 3\/1 to 3\/6 was not maintainable.\n<\/p>\n<p>2.\t\tFacts<br \/>\nleading to the present petition, in nutshell, are as under :\n<\/p>\n<p>\t\tOne<br \/>\nMaganbhai Naranbhai Valand   husband of petitioner No.1 and father<br \/>\nof petitioner No.2, was owner of the land in question and Umtaji<br \/>\nLilaji Thakore was tenant of the land in question. Proceeding under<br \/>\nSection 32G of the Bombay Tenancy and Agricultural Lands Act,1948<br \/>\ncame to be initiated by respondent No.1 and  Umtaji Lilaji Thakore<br \/>\nwas declared as tenant of the land in question. He refused to pay the<br \/>\npurchase price and, therefore, sale in his favour came to be declared<br \/>\nineffective. Thereafter, the property was ordered to be disposed of<br \/>\nunder Section 32-P of the Bombay Tenancy and Agricultural Lands Act<br \/>\nand accordingly by order dated 22\/11\/1968, the said land was ordered<br \/>\nto be given to Maganbhai Naranbhai Valand, who was original land<br \/>\nowner, under Section 32P(7) and (8) of Bombay Tenancy and<br \/>\nAgricultural Lands Act, as restricted new tenure land. Necessary<br \/>\nentry to that effect also came to be mutated into Hak Patrak i.e.<br \/>\nVillage Form No.6 vide entry No.301, which came to certified on<br \/>\n04\/04\/1970.\n<\/p>\n<p>\t\tIt<br \/>\nappears that thereafter heirs of original tenant i.e. respondent<br \/>\nNos.2 and 3\/1 to 3\/6 approached Mamlatdar &amp; ALT, Gandhinagar<br \/>\nunder Section 32-P of the Bombay Tenancy and Agricultural Lands Act<br \/>\nby submitting that they are in possession of the land in question and<br \/>\nstill cultivating the land in question and petitioners   heirs of<br \/>\noriginal land owner  have never restrained them from cultivating the<br \/>\nland in question and, therefore, they are entitled to purchase the<br \/>\nland in question. The said application submitted by the aforesaid<br \/>\nrespondents was registered as Tenancy Case No.4\/97, which came to be<br \/>\nallowed by Mamlatdar &amp; ALT, Gandhinagar by order dated 30\/08\/1997<br \/>\nand directed to dispose of the land at the administration of the<br \/>\nCollector and to dispose of the land in accordance with Section 32-P<br \/>\nof the Bombay Tenancy and Agricultural Lands Act. Being aggrieved and<br \/>\ndissatisfied with the order passed by Mamlatdar &amp; ALT,<br \/>\nGandhinagar dated 30\/08\/1997, the petitioners being heirs of original<br \/>\nlandlord preferred Revision Application No.SRD\/4\/99 [According to<br \/>\nthis Court, the said Revision Application against the order of<br \/>\nMamlatdar &amp; ALT, Gandhinagar was not maintainable] before<br \/>\nSecretary (Appeals), Revenue Department, State of Gujarat and<br \/>\nSecretary (Appeals), Revenue Department, State of Gujarat dismissed<br \/>\nthe said Revision Application and confirmed the order passed by<br \/>\nMamlatdar &amp; ALT, Gandhinagar dated 30\/08\/1997 in Tenancy Case<br \/>\nNo.4\/97. Being aggrieved and dissatisfied with the orders passed by<br \/>\nMamlatdar &amp; ALT, Gandhinagar and Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat, the petitioners   heirs of original<br \/>\nlandlord have preferred the present petition under Articles 226 and<br \/>\n227 of the Constitution of India.\n<\/p>\n<p>3.\t\tMr.Bukhari,<br \/>\nlearned advocate appearing on behalf of the petitioners has made only<br \/>\none submission that order passed  under Section 32-P of the Bombay<br \/>\nTenancy and Agricultural Lands Act disposing the said land in favour<br \/>\nof Maganbhai Valand   original landlord and the petitioners<br \/>\nheirs of original landlord were already impleaded and necessary<br \/>\nmutation entry is made in the revenue record and even at the time<br \/>\nwhen application was submitted by respondent Nos.2 and 3\/1 to 3\/6,<br \/>\nthey were not in possession of the land in question and, therefore,<br \/>\napplication submitted by respondent Nos.2 and 3\/1 to 3\/6 before<br \/>\nMamlatdar &amp; ALT was not maintainable. No other submissions have<br \/>\nbeen made.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned advocates appearing on behalf of the respective parties<br \/>\nand considering the orders passed by both the authorities below, it<br \/>\nappears that even in the year 1993, Maganbhai Valand   original<br \/>\nlandlord &#8211; father of petitioner No.2 served Notice upon respondent<br \/>\nNos.2 and 3\/1 to 3\/6 calling upon them to hand over the possession of<br \/>\nthe land in question, meaning thereby, respondent Nos.2 and 3\/1 to<br \/>\n3\/6 were in possession of the land in question. Under the<br \/>\ncircumstance, the contention on behalf of the petitioners that when<br \/>\nrespondent Nos.2 and 3\/1 to 3\/6 submitted application under Section<br \/>\n32-P of the Act, they were not in possession of the land in question,<br \/>\ncannot be accepted. In view of the above, respondent Nos.2 and 3\/1 to<br \/>\n3\/6 submitted application under Section 32-P of the Bombay Tenancy<br \/>\nand Agricultural Lands Act to the effect that they were in possession<br \/>\nof the land in question and cultivating the land in question and the<br \/>\nsaid application came to be allowed by Mamlatdar &amp; ALT and<br \/>\ndirected to dispose of the said land under Section 32-P of the Bombay<br \/>\nTenancy and Agricultural Lands Act, it cannot be said that the said<br \/>\norder is in any way illegal and\/or contrary to the provisions of the<br \/>\nstatute.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above and for the reasons stated hereinabove, there is no<br \/>\nsubstance in the present petition, which deserves to be dismissed and<br \/>\nis accordingly dismissed. Rule is discharged. Ad-interim relief<br \/>\ngranted earlier, if any, stands vacated forthwith.
