Justice V.RAMKUMAR\n\n Dated :30\/09\/2010\n\n O R D E R\n                          V.RAMKUMAR, J.\n               ----------------------------------------------\n                Bail Application No.5885 of 2010\n              ------------------------------------------------\n          Dated this the 30th day of September, 2010\n\n                                 ORDER\n<\/pre>\n<p>      The petitioner, who is the sole accused in Crime No.624 of<\/p>\n<p>2010 of Kasaragod Police Station for offences punishable under<\/p>\n<p>Sections 332 I.P.C., 3(1) of PDPP Act, 41(1A) read with Section<\/p>\n<p>21(1) of the MMDR Act and Sections 119(1) read with Section<\/p>\n<p>179(1) of the MV Act, seeks anticipatory bail.<\/p>\n<p>      2.   The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature. But at the same time, I am inclined to permit the petitioner<\/p>\n<p>to surrender before the Investigating Officer for the purpose of<\/p>\n<p>interrogation and then to have his application for bail considered<\/p>\n<p>by the Magistrate having jurisdiction. Accordingly, the petitioner<\/p>\n<p>shall surrender before the investigating officer on 14\/10\/2010 or<\/p>\n<p>on 15\/10\/2010 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any.
