NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition has been filed against the<br \/>\njudgement of  the Kerala  High Court,  made on\tNovember 22,<br \/>\n1996 in O.P.No.13328\/92.\n<\/p>\n<p>     The petitioner  therein, while  working as an Assistant<br \/>\nin the\tEconomics and Statistics Department had\t applied for<br \/>\nrecruitment as\tLegal Assistant\t Grade II  by transfer under<br \/>\nKerala Secretariat  Subordinate\t   Service Special Rule (for<br \/>\nshort, the &#8216;Rule&#8217;). Rule 7 of the Rules prescribe the method<br \/>\nof appointment\tto   the post  of category   7,\t viz., Legal<br \/>\nAssistants,   Grade II,(i)  by direct  recruitment; or\t(ii)<br \/>\nappointment or\tpromotion from\tany other category in Kerala<br \/>\nSecretariat Subordinate\t Service; or  (iv) transfer from any<br \/>\ncategory in  any Department  under the\tGovernment or in the<br \/>\nservice of  the High Count of  Kerala. Pursuant thereto, the<br \/>\npetitioner and others applied for appointment by transfer as<br \/>\nLegal Assistant.  Rules,   Applications\t were  made  through<br \/>\nDepartments, written  test was\tconducted on  August 8, 1989<br \/>\nand merit  list was prepared on October 23, 1989 for filling<br \/>\nup one\tpost of\t Legal Assistant,  Grade II by transfer form<br \/>\nother Departments.  The petitioner  was included, at No. 13,<br \/>\nin the\tmerit list.  Though vacancies  were existing, he was<br \/>\nnot appointed.\tTherefore, he\t  filled a writ petition for<br \/>\ndirection  for\t appointment.  Pursuant\t  to   the   interim<br \/>\ndirection, he  came to\tbe appointed on October 15, 1992. By<br \/>\nNotification  dated  December  15,  1992  applications\twere<br \/>\ncalled for  to fill up the post of Legal Assistant, Grade II<br \/>\nfrom  other  Departmental  candidates.\t  Consequently,\t the<br \/>\nwaiting list  was cancelled.  It was contended that the list<br \/>\nprepared in 1969 was still in operation. It was not intended<br \/>\nthat the list will be restricted to a particular period. The<br \/>\npetitioner was appointed to the existing vacancy pursuant to<br \/>\nthe direction.\tTherefore, he  is required to be regularised<br \/>\nirrespective of\t the notification  published on December 15,<br \/>\n1992 calling  for applications\tfrom other  departments.  In<br \/>\nthis background, the High Court held that the appointment of<br \/>\nthe petitioner,\t though under  the directions  of the Count,<br \/>\ncould not  be  regularised. irrespective of the notification<br \/>\npublished on  December\t  15,  1992 calling  for application<br \/>\nfrom other  departments. In  this background, the High Court<br \/>\nheld that  the appointment  of the  petitioner, though under<br \/>\nthe direction  of the  court, could  not be regularised. The<br \/>\npetitioner relied upon <a href=\"\/doc\/179726\/\">Union of India &amp; Ors. v. Ishwar Singh<br \/>\nKhatri &amp;  Ors.<\/a>[1992 supp.(3) SCC 84] and  contended that the<br \/>\nexisting vacancies should be filled  up from the select list<br \/>\nand that  the omission therein is arbitrary and violative of<br \/>\nhis  right.   We  find\t no  force  in\tthe  contention.  <a href=\"\/doc\/982107\/\">In<br \/>\nShankarasan Dash  v. Union  of\tIndia<\/a>[(1991)2  SCR  567],  a<br \/>\nConstitution Bench  had held that mere inclusion of the name<br \/>\nin the list of selected candidates does not confer any right<br \/>\nupon any  candidate to be selected unless the relevant rules<br \/>\nso indicate.  In Babita\t Prasad and Ors. v. State of Bihar &amp;<br \/>\nOrs.[1993 Supp.(3) SSC 268] though the life of the panel was<br \/>\nnot  prescribed,  it  was  directed  to\t be  confined  to  a<br \/>\nreasonable time.  A long  waiting list\tcannot\tbe  kept  in<br \/>\ninfinitum in  view  of\tthe  principle\t&#8220;infinitum  in\tjure<br \/>\nreprobatur  &#8220;.\t A  distinction\t made  for  the\t purpose  of<br \/>\nappointment between  those who\thave already  been appointed<br \/>\nand those  who are  in the  waiting list  or  had  undergone<br \/>\ntraining and  waiting for  appointment. It cannot be treated<br \/>\nas arbitrary.  This Court  has held  that the  panel was too<br \/>\nlong and  was intended\tto  last  indefinitely\tbarring\t the<br \/>\nfuture generations  for decades for being considered for the<br \/>\nvacancies arising much later. In fact, the future generation<br \/>\nwould have  been kept  out for\ta very\tlong period,  if the<br \/>\npanel would  have been permitted to remain effective till it<br \/>\ngot exhausted. A panel of that type cannot be equated with a<br \/>\npanel which  is prepared  having co-relation to the existing<br \/>\nvacancies arising  in the near future. <a href=\"\/doc\/284979\/\">In Union Territory of<br \/>\nChandigarh v.  Dilbagh Singh &amp; Ors<\/a> [(1993)1 SSC 154], it was<br \/>\nheld that  a candidate\twhose name finds place in the select<br \/>\nlist for  appointment to  a civil  post does not acquire and<br \/>\nindefeasible right  to be  appointed in\t such  post  in\t the<br \/>\nabsence\t of   any  specific  rule  entitling  him  for\tsuch<br \/>\nappointment  and   he  could   be    aggrieved\tby  his\t non<br \/>\nappointment only  when the  Administration  does  so  either<br \/>\narbitrarily of\tfor no\tbonafide or  valid reason.  <a href=\"\/doc\/673003\/\">In Nagar<br \/>\nMahapalika, Kanpur  v. Vinod Kumar  Srivastava<\/a> [AIR 1987  SC<br \/>\n847]  it   was\tobserved  that\tthe  reason  underlying\t the<br \/>\nlimitation of  the period  of life  of waiting\tlist for one<br \/>\nyear is\t obviously to ensure that other qualified person are<br \/>\nnot   deprived of  their chances  of applied for the post in<br \/>\nthe succeeding\tyears and being selected for appointment. In<br \/>\nState Chander  Narwaha &amp;  Ors.[(1974) 1 SCR 165], this Court<br \/>\nhad  held  that\t though\t vacancies  were  existing  selected<br \/>\ncandidate had  no right to the appointment. It would be open<br \/>\nto the Government not to appoint the candidate from the list<br \/>\nfor valid  reasons. <a href=\"\/doc\/614393\/\">In\tState of Bihar &amp; Ors. v. Secretariat<br \/>\nAssistant Successful  Examinees Union<\/a>  1986 and Ors.[(1994)1<br \/>\nSCC 126],  this court  had held\t that a\t person having\tbeen<br \/>\nselected, does\tnot on\taccount of  being empanelled  alone,<br \/>\nacquire any  indefeasible right to appointment. Empannelment<br \/>\nis, at\tthe best,  a condition of eligibility for purpose of<br \/>\nappointment and\t by itself  does not  amount to selection or<br \/>\ncreating right\tto be  appointed unless relevant rules state<br \/>\nto the\tcontrary. In  that case, select list was prepared on<br \/>\nhe  basis   of\tmerit\tin  the\t  examination  without\t any<br \/>\nqualification\t  mark.\t All   the  persons  who  wrote\t the<br \/>\nexamination were ranked in the merit lists. They claimed the<br \/>\nright to  get appointment  contending that till the list was<br \/>\nexhausted, no  fresh list  could be  prepared and  that they<br \/>\nwere  entitled\t to  the  appointment.\tThe  contention\t was<br \/>\nnegatived and it was held that there is no provision  in the<br \/>\nrelevant   rules giving\t indefeasible right  to the  persons<br \/>\nwhose names  appeared in the list to get appointed. There is<br \/>\nno provision  under the Rules prohibiting authorities to fix<br \/>\nthe time limit.\n<\/p>\n<p>     Shri T.L.V. Iyer, learned senior counsel, contends that<br \/>\nthe list  was not published and so the life of the panel did<br \/>\nnot expire.  We find no force. The fact that candidates were<br \/>\nappointed from\tthe panel is proof of its publication. It is<br \/>\nthen contended that even thought the petitioner has no right<br \/>\nto be  appointed since\the was appointed on the basis of the<br \/>\norder of  the Court  provisionally, the\t appointment already<br \/>\nmade should  be\t allowed  to  be  continued  and  should  be<br \/>\nregularised. The  High Court  has negatived this contention,<br \/>\nand in\tour view  rightly. The\tinterim order  is subject to<br \/>\nresult\tof   outcome  of  the  final  adjudication.  If\t the<br \/>\npetitioner is  not successful  in the  final  decision,\t the<br \/>\ninterim order  would stand  set\t aside.\t So  appointment  by<br \/>\ninterim order  does not\t create any right nor the petitioner<br \/>\nget any\t right to  regularisation on  that basis. <a href=\"\/doc\/786046\/\">In Dr.M.A.<br \/>\nHaque v.  Union of  India<\/a> [(1993)2  SCC 213], this Court had<br \/>\nheld that  recruitment rules  made under  Article 309 of the<br \/>\nconstitution have  to be  followed strictly  and not  in its<br \/>\nbreach. If  disregard of  the rules and the bypassing of the<br \/>\nPublic Service\tCommissions are\t permitted, it\twill open  a<br \/>\nbackdoor for  illegal recruitment without limit. Recruitment<br \/>\nrules should  be strictly  followed and\t the Public  Service<br \/>\nCommission cannot  keep the  rules in  cold storage. It was,<br \/>\ntherefore, held\t relying  on  the  above  ratio\t that  since<br \/>\nexisting list  was closed  and recruitment  was made through<br \/>\nPublic Service\tCommission, cannot  keep the  rules in\tcold<br \/>\nstorage. It  was, therefore, held relying on the above ratio<br \/>\nthat since existing list was closed and recruitment was made<br \/>\nthrough Public\tService Commission  the\t petitioner  has  no<br \/>\nright to  that post  the reliance  of the  petitioner on the<br \/>\njudgment of  this Court\t in <a href=\"\/doc\/1609064\/\">Ashok  Kumar &amp;  Ors. v. Chairman<br \/>\nBanking Service\t Recruitment Board  &amp; Ors.<\/a>[AIR\t1996 SC 976]<br \/>\nwas rightly  not accepted. There in appointment to vacancies<br \/>\narising subsequently  without being notification was held to<br \/>\nbe violative  of  Articles  14\tand  16\t since\teveryone  is<br \/>\nentitled to  claim consideration  for appointment  to a post<br \/>\nunder the State. The vacant posts arising or expected should<br \/>\nbe  notified  and  no  one  can\t be  appointed\twithout\t due<br \/>\nnotification of\t the vacancies\tand selection  according  to<br \/>\nrule and  the prescribed  procedure. Therefore, appointments<br \/>\nmade from  amongst the\twaiting\t list  candidates  would  be<br \/>\nillegal. In  the above\tcase also,  this  Court\t refused  to<br \/>\ninterfere with\tthe order  passed by  the High Court even on<br \/>\nequitable grounds.  <a href=\"\/doc\/146944261\/\">In Surendra\t Kumar\tGyani  v.  State  of<br \/>\nRajasthan<\/a> [AIR\t1993 SC\t 115],\tthis  Court  had  held\tthat<br \/>\ntermination of the services of the temporary employee on the<br \/>\navailability of\t the candidates recruited through the Public<br \/>\nService Commission  was held  to be valid in law and was not<br \/>\nvitiated by  any error\tof law.\t Thus\twe see that the High<br \/>\ncourt has  not committed  any error  nor announced any wrong<br \/>\nprinciple of law warranting interference.\n<\/p>\n<p>     The special leave petition is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India N.
