These all 32 female health<br \/>\nworkers are working for more than 15 to 16 years with District<br \/>\nPanchayat, Rajkot. As per GR dated 25.2.2009 (Annexure-C, Page-48) in<br \/>\nrespect to these 32 and other female health workers, in all comes to<br \/>\n53, their services have been regularized and they are now not<br \/>\nrequired to clear direct recruitment procedure. Accordingly, these<br \/>\npetitioners are considered to be a regular employees of District<br \/>\nPanchayat, Rajkot. A specific resolution has been passed in favour of<br \/>\n46 female health workers and out of that, 32 female health workers &#8211;<br \/>\npresent petitioners are mentioned at Page-51 and 52.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr.Majmudar submitted that District Panchayat, Rajkot has<br \/>\nissued a circular dated 7.6.2010 giving advertisement for direct<br \/>\nrecruitment in the post of female health workers. In that, it has<br \/>\nbeen specifically made clear by District Health Officer, District<br \/>\nPanchayat, Rajkot that present petitioners, those who were appointed<br \/>\non ad-hoc basis in the year 1995-96, they should not have to require<br \/>\nto clear this direct recruitment procedure and they were granted<br \/>\nexemption. However, the grievance of present petitioners is that in<br \/>\npursuance to their services have been regularized, their service<br \/>\nbooks are not prepared accordingly and not only that, they are not<br \/>\neven given increments as well as higher grade as per GR dated<br \/>\n16.8.1994.\n<\/p>\n<p>3.1\tLearned<br \/>\nadvocate Mr.Majmudar also submitted that merely order of regularizing<br \/>\nservices of petitioners has been passed means decision has been<br \/>\ntaken, even though consequential benefits have not been extended in<br \/>\ntheir favour and that is why, present petition is filed.\n<\/p>\n<p>4.\tIn<br \/>\nlight of these facts, this petition is directly preferred before this<br \/>\nCourt without approaching to respondents in respect grievance voiced<br \/>\nin present petition. Therefore, let petitioners may approach by way<br \/>\nof detailed representation to respondents claiming all the benefits<br \/>\nwhich are available to regular employee of District Panchayat<br \/>\nincluding pay fixation, increments, higher pay-scale and also to<br \/>\nprepare service book accordingly, within a period of one month from<br \/>\ndate of receiving copy of present order.\n<\/p>\n<p>5.\tAs<br \/>\nand when respondents receive such representation from petitioners, it<br \/>\nis directed to respondents to consider the GR dated 25.2.2009<br \/>\n(Annexure-C, Page-48) and also to consider another resolution from<br \/>\nDistrict Panchayat, Rajkot dated 7.6.2010 where petitioners have been<br \/>\nexempted from process of direct recruitment in the post of female<br \/>\nhealth workers and thereafter, to consider that once their services<br \/>\nhave been regularized by respondents, then naturally all<br \/>\nconsequential benefits they are entitled as a matter of right from<br \/>\ndate of joining in service and also entitled to consequential<br \/>\nbenefits.\n<\/p>\n<p>6.\tLet<br \/>\nthat aspect may be considered positively and sympathetically and<br \/>\nthen, to pass appropriate reasoned order in light of aforesaid<br \/>\nresolution which has been referred by this Court, within a period of<br \/>\nthree months from date of receiving such representation from<br \/>\npetitioners and communicate decision to petitioners immediately.\n<\/p>\n<p>7.\tIn<br \/>\nview of above observations and directions, present petition is<br \/>\ndisposed of by this Court without expressing any opinion on merits.\n<\/p>\n<p>8.\tIt<br \/>\nis made clear by this Court that in case if  decision is taken by<br \/>\nrespondents in favour of petitioners, let that benefit may be<br \/>\nimmediately extended in favour of pets.\n<\/p>\n<p>9.\tHowever,<br \/>\nin case if ultimate decision is adverse to petitioners, it is open<br \/>\nfor petitioners to challenge the same before appropriate forum in<br \/>\naccordance with law.
