In this matter, the charge-sheet is filed.<br \/>\nHe also submitted that nothing is recovered from the applicant and TI<br \/>\nparade is not carried out. Prima facie, it appears that there is no<br \/>\ninvolvement of the applicant. Therefore, the applicant may kindly be<br \/>\nreleased on bail by imposing suitable conditions.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah strongly opposed the application of the applicant and<br \/>\nstated that the applicant is involved in serious offence. He also<br \/>\nstated that discretion may not be exercised in favour of the<br \/>\napplicant considering the seriousness of offence.\n<\/p>\n<p>5.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nprovisions of Sections 392, 395, 120(B) and 114 of the Indian Penal<br \/>\nCode, quantum of punishment and the fact that nothing is recovered<br \/>\nfrom the applicant and TI parade is not carried out, I am of the view<br \/>\nthat the applicant deserves to be enlarged on bail. At this stage of<br \/>\nbail, this Court is not entering into merit of the case.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. I- 97 of 2011 registered at Unjha Police Station, on his<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned police station on 15th day<br \/>\nevery English Calender month at 11:00 a.m. till the trial is over;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
