Hence, Appeal dismissed.\n\nGrounds for Second Appeal:\nPoints no. 3 and 7 to 11 given in the reply of PIO are unsatisfactory and incomplete.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Mr. Dharambir Singh<br \/>\nRespondent: Mr. Deepak on behalf of PIO Mr. Kunal<br \/>\nThe PIO will give the following information to the Appellant which has not been given earlier:<br \/>\n   1-     Query 3- Copy of the affidavit by the Co-sharer.<br \/>\n   2-     Query 7- Copy of notings and correspondence with decision taken if any on file<br \/>\n          regarding whether the NOC was issued correctly or not.<br \/>\n   3-     Query 8- Copy of the Khata &amp; Khatauni of Serial no. 162\/121.<br \/>\n   4-     Query 10- If any enquiry has been made into the matter a copy of the report including<br \/>\n          the file notings.\n<\/p>\n<p>   5-     Query 11- Letters and notings evidencing the basis on which the first NOC was<br \/>\n          given, then withdrawn and then kept in abeyance.\n<\/p>\n<p>The PIO was asked why the entire information had not been given initially. He states that the<br \/>\nperson responsible for giving information late is BDO Mr. Hans Raj Singh, BDO Office<br \/>\nComplex, Alipur, New Delhi.\n<\/p>\n<p> The First Appellate Authority Mr. Madhup Vyas has also failed to discharge his duty with any<br \/>\nresponsibility.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>The PIO will give the information mentioned above to the Appellant before 10 September 2009.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the deemed PIO Mr. Hans Raj Singh is<br \/>\nguilty of not furnishing information within the time specified under sub-section (1) of Section 7<br \/>\nby not replying within 30 days, as per the requirement of the RTI Act. It appears that the PIO&#8217;s<br \/>\nactions attract the penal provisions of Section 20 (1). A showcause notice is being issued to him,<br \/>\nand he is directed give his reasons to the Commission to show cause why penalty should not be<br \/>\nlevied on him.\n<\/p>\n<p>He will present himself before the Commission at the above address on 14 September 2009 at<br \/>\n10.30am alongwith his written submissions showing cause why penalty should not be imposed<br \/>\non him as mandated under Section 20 (1).
