Justice M.N.KRISHNAN\n\n Dated :14\/06\/2007\n\n O R D E R\n                            M.N.KRISHNAN, J.\n\n                    -----------------------------\n\n                         C.R.P.No. 87 OF 2007 A\n\n                    -----------------------------\n\n                   Dated this the 14th June, 2007.\n\n\n\n                                 O R D E R\n<\/pre>\n<p>      This   revision   petition   is   filed   seeking   to   quash   the<\/p>\n<p>order   in   I.A.5522\/06   in   O.S.8\/05.     The   Managing   Partner   of<\/p>\n<p>a   firm   died   and   a   petition   was   filed   to   implead   his   legal<\/p>\n<p>representatives.     The   court   below   allowed   the   application<\/p>\n<p>and permitted the petitioners to proceed with the suit.   It<\/p>\n<p>is against that decision the revision has been preferred by<\/p>\n<p>the defendant.  According to the defendant, on the death of<\/p>\n<p>the   Managing   Partner   the   partnership   firm   will   get<\/p>\n<p>automatically   dissolved   and   therefore,   there   cannot   be   any<\/p>\n<p>continuation   of   the   suit   by   the   legal   representatives.     On<\/p>\n<p>the other hand, learned counsel appearing for the impleaded<\/p>\n<p>parties   submitted   that   there   is   partnership   agreement<\/p>\n<p>entered   into   between   the   partners   and   as   per   clause   10   of<\/p>\n<p>the partnership deed there is a specific provision that the<\/p>\n<p>partnership   firm   shall   not   get   dissolved   and   the   legal<\/p>\n<p>representatives   of   the   deceased   partner   is   entitled   to   be<\/p>\n<p>admitted   to   the   partnership   firm.     Learned   counsel   for   the<\/p>\n<p>revision petitioner submits that there was no mention about<\/p>\n<p>any   partnership   deed   and   no   document   was   produced   before<\/p>\n<p>the   court   below   and   therefore   she   is   not   in   a   position   to<\/p>\n<p>answer  those  points.    A  perusal  of  the  order  also  does  not<\/p>\n<p><span class=\"hidden_text\">C.R.P.87\/07                          2<\/span><\/p>\n<p>reveal   regarding   the   production   of   any   partnership<\/p>\n<p>agreement  therein.     So,   the   only   course   left   open   for   this<\/p>\n<p>Court   is   to   set   aside   the   order   and   direct   the   Principal<\/p>\n<p>Munsiff-I,   Kozhikode   to   consider   the   whole   matter   afresh<\/p>\n<p>after   permitting   both   parties   to   produce   documents   or<\/p>\n<p>adduce evidence in support of their respective contentions.\n<\/p>\n<p>C.R.P is disposed of accordingly.
