DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/10\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1\tThis<br \/>\npetition under Article 226 of the Constitution of India is filed by<br \/>\nthe petitioner challenging the communication dated 24th<br \/>\nMarch 2008 and 14th May 2008 passed by respondent No.2<br \/>\npursuant to order dated 30th December 2006 passed by<br \/>\nrespondent No.4, by which, it is held that the petitioner has no<br \/>\nright or interest on the land admeasuring 300 Acres of Survey No.1039<br \/>\nof Mouje: Village Jungi, Taluka: Bachau, District: Kutch, in view of<br \/>\nthe notification of the Government of Gujarat dated 12th<br \/>\nJanuary 1973 declaring the area as &#8216;Ghudkhar Wild Life Sanctuary&#8217;.\n<\/p>\n<p>2\tIt<br \/>\nis the case of the petitioner that the land has been conveyed by the<br \/>\nGovernment to the petitioner on lease for salt manufacturing for a<br \/>\nperiod of 20 years. That the petitioner is holding the land since<br \/>\n1990. That the said lease deed was executed on 6th<br \/>\nFebruary 1990  and expired on 31t July 2009. That,  the said lease<br \/>\ncame to be granted by the then Collector, respondent No.3 herein and,<br \/>\ntherefore, the same cannot be cancelled by taking recourse to the<br \/>\nsaid notification.\n<\/p>\n<p>3\tBefore<br \/>\nthe matter could be taken up for effective hearing, Mr. Prabhav<br \/>\nMehta, learned counsel appearing for the petitioner, submits that, on<br \/>\n18th September 2008, the petitioner preferred<br \/>\napplication\/representation under  Section 24 of the Wild Life<br \/>\n[Protection] Act, 1972 for exclusion of the said land from the Wild<br \/>\nAss Sanctuary [WAS] before the National Board for Wild Life, New<br \/>\nDelhi, which is pending. He, therefore, prays for withdrawal of this<br \/>\npetition at this stage.\n<\/p>\n<p>3\tMr.\n<\/p>\n<p>Sunit Shah, learned Government Pleader, submits that, pending<br \/>\ndecision on the said application\/representation filed by the<br \/>\npetitioner  by the National Board for Wild Life, New Delhi, it is<br \/>\napprehended by the Authority that the petitioner may continue to use<br \/>\nthe land in question, though the order has already been passed. He<br \/>\nfurther submits that the petitioner has no right to use the said land<br \/>\nand even an appropriate action can be taken against the petitioner<br \/>\nfor occupying the lease land beyond the time period.\n<\/p>\n<p>4\tIn<br \/>\nview of the fact that the petitioner has preferred<br \/>\napplication\/representation under  Section 24 of the Wild Life<br \/>\n[Protection] Act, 1972 for exclusion of the said land from the Wild<br \/>\nAss Sanctuary [WAS] before the National Board for Wild Life, New<br \/>\nDelhi, I deem it proper not to observe anything on the merit of the<br \/>\ncase.\n<\/p>\n<p>5\tThis<br \/>\npetition stands disposed of as withdrawn with the following<br \/>\ndirections:\n<\/p>\n<p>[i]\tThe<br \/>\nrespondents shall not resort to any coercive action for a period \tof<br \/>\nsix weeks from today;\n<\/p>\n<p>[ii]<br \/>\n\tThe petitioner shall not cause any damage to the land in question<br \/>\n\tor put to illegal usage of the said lease land.\n<\/p>\n<p>6.<br \/>\nNotice is discharged  with no order as to costs. \tDirect service is<br \/>\npermitted.\n<\/p>\n<p>(ANANT<br \/>\nS.
