The Applicant filed his RTI request on 11.05.09 with the PIO, N F Railway, Katihar<br \/>\n       seeking information related to land acquired by the Railway for the Piprithan Crossing<br \/>\n       Railway Station including compensation paid etc.       against 6 points. The Sr. Section<br \/>\n       Engineer (Works) N.F. Railway\/Thakurganj replied on 13.05.09 stating that the<br \/>\n       information is not available with their office because their office is not the custodian of<br \/>\n       the information and requested the Applicant       to contact the DRM office at Katihar<br \/>\n       division while returning the IPO of the Applicant to him . Not satisfied with the reply,<br \/>\n       the Applicant filed his First Appeal on 13.08.09 before the Appellate Authority, DRM<br \/>\n       Office, Katihar reiterating his request for the information. The Appellate Authority<br \/>\n       replied on 26.08.09 requesting the Applicant to send the IPO in favour of the correct<br \/>\n       payee if he wants the information. Still being aggrieved with the reply, the Applicant<br \/>\n       filed his Second Appeal on 25.09.09 before the Commission requesting for the<br \/>\n       information once again.\n<\/p>\n<p>2.     The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the<br \/>\n       hearing for 5th February, 2010 through video conferencing.\n<\/p>\n<p>3.     Mr. D. Srikant, PIO and Mr. B. Misra Appellate Authority representing the Public<br \/>\n       Authority were present at NIC studio, Katihar.\n<\/p>\n<p>4.     The Appellant was not present during the hearing.<br \/>\nDecision\n<\/p>\n<p>5.     The Commission on perusal of the RTI application dated 11.05.09 and after hearing<br \/>\n       the submission of the Respondent noted that the Appellant has submitted entirely<br \/>\n       different sets of documents including the RTI applications and the responses by PIO<br \/>\n       and Appellate Authority to the Respondent and to the Commission and since it is not<br \/>\n       clear which RTI application\/appeal is to be disposed off, returns all the papers with<br \/>\n       the suggestion that the Appellant file a fresh application which is clear.\n<\/p>\n<p>6.
