Sinha\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\nwith Writ Petition (Civil) No. 67 of 2002<\/p>\n<p>S.B. SINHA, J :\n<\/p>\n<p>\tThe petitioners herein are aspirants of joining Rajasthan Judicial<br \/>\nService.  They are working as Legal Assistants in the Education Department<br \/>\nof the State of Rajasthan.  Prior thereto they practiced as lawyers but they<br \/>\nhad not completed three years&#8217; period as was necessary in terms of the rules<br \/>\nas thence existing.\n<\/p>\n<p>\tThe contention of the petitioners in these Writ Petitions is that they<br \/>\nhaving been allowed to appear at the written examination and having been<br \/>\ncalled for interview, their candidature could not have been cancelled on the<br \/>\npurported ground of non-completion of three years&#8217; practice in terms of the<br \/>\nAll India Judges&#8217; Association and Others Vs Union of India [(2002) 4 SCC<br \/>\n247]; keeping in view the fact that they have been representing their<br \/>\ndepartment before the district courts and Tribunal like lawyers in respect<br \/>\nwhereof they had affirmed the requisite affidavits and filed certificates<br \/>\ngranted by the Competent Authority.\n<\/p>\n<p>\tFurther contention of the petitioners is that having regard to the<br \/>\ndecisions of this Court in All India Judges&#8217; Association and Others (supra)<br \/>\nwherein this Court has laid down the law that practice at the Bar would not<br \/>\nbe necessary for joining the Judicial Service; this Court should set aside the<br \/>\nimpugned directions issued by the respondent  Commission.\n<\/p>\n<p>\tIt is not in dispute that three years&#8217; minimum practice was a pre-<br \/>\nrequisite at the relevant time for being eligible to enter in the judicial<br \/>\nservice.\n<\/p>\n<p>\tIn All India Judges&#8217; Association and Others Vs. Union of India and<br \/>\nOthers [(1993) 4 SCC 288], it was inter alia directed:<br \/>\n&#8220;52.(a) The legal practice of three years should<br \/>\nbe made one of the essential qualifications for<br \/>\nrecruitment to the judicial posts at the lowest rung<br \/>\nin the judicial hierarchy.\n<\/p>\n<p>Further, wherever the recruitment of the judicial<br \/>\nofficers at the lowest rung is made through the<br \/>\nPublic Service Commission, a representative of the<br \/>\nHigh Court should be associated with the selection<br \/>\nprocess and his advice should prevail unless there<br \/>\nare strong and cogent reasons for not accepting it,<br \/>\nwhich reasons should be recorded in writing.\n<\/p>\n<p>The rules for recruitment of the judicial officers<br \/>\nshould be amended forthwith to incorporate the<br \/>\nabove directions.&#8221;\n<\/p>\n<p>\tIn the said decision, this Court was inter alia considering the question<br \/>\nas regard uniform hierarchy and designation.  It was opined:\n<\/p>\n<p>&#8220;20In this connection, it may be pointed out<br \/>\nthat under Article 233(2) of the Constitution, no<br \/>\nperson is eligible to be appointed a District Judge<br \/>\nunless he has been an advocate or a pleader for not<br \/>\nless than seven years while Articles 217(2)(b) and<br \/>\n124(3)(b) require at least ten years&#8217; practice as an<br \/>\nadvocate of a High Court for the appointment of a<br \/>\npersons to the posts of the Judge of the High Court<br \/>\nand the Judge of the Supreme Court,<br \/>\nrespectively..&#8221;\n<\/p>\n<p>\tA bare perusal of the aforementioned paragraph would leave no<br \/>\nmanner of doubt that the minimum legal practice of three years was<br \/>\nprescribed as an essential qualification to be eligible for being appointed as<br \/>\nJudicial Officer so as to ensure recruitment of competent, independent and<br \/>\nhonest judicial officers for the purpose of strengthening the administration of<br \/>\njustice and the confidence of public in it.\n<\/p>\n<p>\tThis Court, therefore, laid down the law to the effect that a candidate<br \/>\nmust have three years&#8217; practice at the Bar.\n<\/p>\n<p>\tThe petitioners herein admittedly did not complete the said period of<br \/>\nthree years of active practice at the Bar.  They joined services prior thereto.<br \/>\nThey might have been representing their department while in service before<br \/>\nthe Tribunal but we fail to understand as to how they could appear before the<br \/>\nCourt like lawyers.  Be that as it may, representing the employer in a Court<br \/>\nor Tribunal would not amount to practice at the Bar and as such the criteria<br \/>\nlaid down by this Court would not stand satisfied.\n<\/p>\n<p>\tOur attention was drawn to an order of this Court passed in I.A. Nos.<br \/>\n31, 32 of 1995 in Review Petition No. 249 of 1992 in Writ Petition No. 1022<br \/>\nof 1989.  In that case also it was observed :\n<\/p>\n<p>&#8220;There is no doubt in our minds that what was<br \/>\nintended by the provision was that a candidate for<br \/>\nappointment to judicial office should be a person<br \/>\nwho has had three years experience of practice as<br \/>\nan advocate.  He must be a lawyer in the sense that<br \/>\nhe regularly practices before a court or tribunal,<br \/>\nwho appears for his clients before the court or<br \/>\ntribunal.  It may be that in a given case he may do<br \/>\nso only for a client who is his employer.&#8221;\n<\/p>\n<p>\tFurther, it was directed:\n<\/p>\n<p>&#8220;We, therefore, direct the legal Assistants who are<br \/>\nthe applicants in I.As. 7, 8, 9 and 10 to place on<br \/>\naffidavit before the Rajasthan Public Service<br \/>\nCommission within a period of one week from<br \/>\ntoday a statement of what precisely their work as<br \/>\nLegal Assistant involves.  It is only if that work<br \/>\ninvolves regularly appearing before courts or<br \/>\ntribunals that they would fall within the<br \/>\nrequirements of the provision aforementioned and,<br \/>\nbeing eligible, should be allowed to complete the<br \/>\nselection process.&#8221;\n<\/p>\n<p>\tIt may be true that pursuant to or in furtherance of said directions the<br \/>\npetitioners had filed affidavits but evidently the impugned order has been<br \/>\npassed by the respondent  Public Service Commission being not satisfied as<br \/>\nregard fulfillment of requirement of the statutory rules as then existed.\n<\/p>\n<p>\tThe rules were framed by the State pursuant to the directions of this<br \/>\nCourt in All India Judges Association&#8217;s case (supra) and thus as regard the<br \/>\nquestion as to whether the petitioners held the requisite qualifications or not,<br \/>\nthe Commission was required to satisfy itself in that behalf on the materials<br \/>\nplaced on record as to whether the petitioners fulfilled the said criteria or<br \/>\nnot.  Ex-facie we do not find the decision of the Commission to be so<br \/>\narbitrary so as to attract the wrath of Article 14 of the Constitution of India.\n<\/p>\n<p>\tThe learned counsel may be correct that in All India Judges&#8217;<br \/>\nAssociation and Others Vs Union of India [(2002) 4 SCC 247] this Court<br \/>\nhas directed dispensation of practice at the Bar; keeping in view of the<br \/>\nsubsequent events.  However, in no uncertain terms it was categorically<br \/>\nstated that before a Judicial Officer is entrusted to decide the fate of the<br \/>\nlitigants, he must undergo rigorous judicial training of one year preferably<br \/>\ntwo years.  It is not in dispute that the State of Rajasthan has amended the<br \/>\nrules pursuant to the directions of this Court.\t The petitioners, therefore, are<br \/>\nnow eligible to appear at the ensuing examination.\n<\/p>\n<p>\tOur attention has, however, been drawn to a recent decision of this<br \/>\nCourt in Rajasthan Public Service Commission and Anr. Vs. Harish Kumar<br \/>\nPurohit and Others [2003(3) SCALE 571] wherein this Court held that the<br \/>\nHigh Court has committed an illegality in directing the Commission to de-<br \/>\nreserve the 11 posts although they were meant to be filled up by the<br \/>\ncandidates belonging to the reserved categories.  In view of the<br \/>\naforementioned decision alone, this Court cannot presume that the said 11<br \/>\nvacancies would be dereserved and the petitioners would be eligible to fill<br \/>\nup the vacancies wherefor they be given an opportunity to appear at the<br \/>\ninterview.\n<\/p>\n<p>\tIt is not in dispute that all other eligible candidates have been<br \/>\ninterviewed and select-list has been finalized.\t It will, therefore, not be<br \/>\nproper for this Court to reopen the selection process and direct the<br \/>\nrespondent-Commission to take the viva-voce test of the petitioners.\n<\/p>\n<p>\tFor the reasons aforementioned, we are of the opinion that there is no<br \/>\nmerit in these Writ Petitions which are, therefore, dismissed.\tHowever, in<br \/>\nthe facts and circumstances of this case, there shall be no order as to costs.\n<\/p>\n<p>New Delhi;\n<\/p>\n<p><span class=\"hidden_text\">7<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Sunil Kumar Goyal vs Rajasthan Public Service &#8230; on 9 May, 2003 Author: S.B.
