Justice V.RAMKUMAR\n\n Dated :14\/09\/2010\n\n O R D E R\n                        V.RAMKUMAR, J.\n             ----------------------------------------------\n             Bail Application No.5350 of 2010\n            ------------------------------------------------\n        Dated this the 14th day of September, 2010\n\n                               ORDER\n<\/pre>\n<p>      In this petition filed under Section 438 Cr.P.C. the<\/p>\n<p>petitioner who is the sole accused in Excise Crime No.3\/2005<\/p>\n<p>of Nedumangadu Excise Range for offences punishable under<\/p>\n<p>Sections 55(a), 8(1), 8(2), 65 &amp; 67B of Abkari Act I of 1077 for<\/p>\n<p>allegedly having been found in possession of 30 litres of<\/p>\n<p>arrack, seeks anticipatory Bail.\n<\/p>\n<p>      2.   The    learned     Public     Prosecutor      opposed the<\/p>\n<p>application.\n<\/p>\n<p>      3.   Anticipatory bail cannot be granted in a case<\/p>\n<p>involving such grave offence. It is too early to accept the<\/p>\n<p>petitioner&#8217;s contention that the petitioner has been falsely<\/p>\n<p>implicated.   There is no reason why the petitioner should not<\/p>\n<p>surrender before the magistrate concerned and seek regular<\/p>\n<p>bail.  Accordingly, if the petitioner surrenders before the<\/p>\n<p>Magistrate concerned within two weeks from today and files<\/p>\n<p>an application for regular bail, the same shall be considered<\/p>\n<p>Bail Appln.No.5350\/2010<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>and disposed of preferably on the same day on which it is filed<\/p>\n<p>bearing in mind the decision in <a href=\"\/doc\/1158859\/\">Sukumari v.
