SAGHIR AHMAD,.J.\n<\/p>\n<p>     Guru  Nanak   College  at\t Gurdaspur  was\t  a  private<br \/>\ninstitution  affiliated\t  to  Guru   Nanak  Dev\t University.<br \/>\nRespondent was\tappointed as  Principal of  the college by a<br \/>\nresolution of  the Managing Committee adopted on 27th of May<br \/>\n1975. His  appointment\t was approved by the Vice Chancellor<br \/>\non 30th\t of June,  1975 and  thereafter he  was confirmed on<br \/>\nthat post with effect from 31st of May. 1976.\n<\/p>\n<p>2. Guru\t Nanak college,\t as also  three other  colleges were<br \/>\nproposed to  be taken  over by the Government under its Memo<br \/>\ndated 30th  of September.  1987 on  the condition  that only<br \/>\nthose\tstaff\t member\t  who\tpossessed   thee   requisite<br \/>\nqualification\twould along be absorbed and that too as &#8220;new<br \/>\nentrants&#8221; while\t the  Principal\t of  the  college  would  be<br \/>\nbrought in  as senior-most  lecturer and  not as  principal.<br \/>\nThis Memorandum\t was considered by the Managing Committee of<br \/>\nthe college in its meeting held on 18th of May, 1983 and was<br \/>\napproved. Consequently,\t a gift deed dated IIth of July,1983<br \/>\nwas executed  between the  management of the college and the<br \/>\nState Government  in which  the management  was described as<br \/>\ndonors and it was provided, inter alia. as under:\n<\/p>\n<blockquote><p>     &#8220;1.  In  pursuance\t  of  the   said<br \/>\n     agreement,\t  the\t donors\t  hereby<br \/>\n     transfer to  the Govt.,  by way  of<br \/>\n     gift   all the  properties\t in  the<br \/>\n     form of buildings, fields, gardens,<br \/>\n     staff quarters,  lands, equipments,<br \/>\n     furniture, library\t books,\t science<br \/>\n     apparatus and  other assets etc. at<br \/>\n     present attached  with the\t college<br \/>\n     or standing  in  the  name\t of  the<br \/>\n     college   as   are\t  specified   in<br \/>\n     Schedule A\t including the\tright of<br \/>\n     college management\t and control  of<br \/>\n     the Guru  Nanak  College  Gurdaspur<br \/>\n     District, Gurdaspur  to have and to<br \/>\n     hold the  same  to\t the  Government<br \/>\n     absolutely for ever.<br \/>\n     2 &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..<br \/>\n     3 &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>     4.\t  It is\t agreed that  Government<br \/>\n     shall not\taccept any  liability or<br \/>\n     responsibility for the period prior<br \/>\n     to the  taking over  of the college<br \/>\n     by\t them.\t All  such   liabilities<br \/>\n     shall be  cleared by  the\tManaging<br \/>\n     Committee of the college concerned.\n<\/p><\/blockquote>\n<blockquote><p>     5.\t  It is\t agreed that the college<br \/>\n     on\t being\t taken\t over\tby   the<br \/>\n     Government\t should\t  not  be  over-<br \/>\n     staffed and only such staff will be<br \/>\n     kept as  is justified  on the basis<br \/>\n     of actual\tworkload  in  accordance<br \/>\n     with  the\t prescribed  norms   for<br \/>\n     different.\t categories   of  staff.<br \/>\n     Confirmed and  regularly  appointed<br \/>\n     staff through  prescribed\tchannels<br \/>\n     and      approved\t     by\t     the<br \/>\n     University\/department will be taken<br \/>\n     on ad  hoc\t basis\tsubject\t to  the<br \/>\n     approved  of   the\t Punjab\t  Public<br \/>\n     Service\t  Commission\t   where<br \/>\n     applicable.\n<\/p><\/blockquote>\n<blockquote><p>     6.\t  It is agreed that such members<br \/>\n     of the  Staff  of\tthe  college  as<br \/>\n     fulfil necessary qualifications and<br \/>\n     are   considered\t suitable    for<br \/>\n     absorption in Government service by<br \/>\n     the P.P.S.C. Sub-Board\/Departmental<br \/>\n     Committee shall  only be taken over<br \/>\n     in\t Government   service  and  then<br \/>\n     treated as\t new contracts.\t But the<br \/>\n     Principal will  be taken  over only<br \/>\n     as\t senior\t most  lecturer\t of  the<br \/>\n     concerned college.\t The  Government<br \/>\n     scale  in\t respect  of  respective<br \/>\n     categories shall  be permissible to<br \/>\n     them and there shall be no personal<br \/>\n     grade for any one. Their pay in the<br \/>\n     Government scale  will be\tfixed on<br \/>\n     the  basis\t  of  their   length  of<br \/>\n     service in\t    equivalent\/identical<br \/>\n     or higher time\t scale.\t   There<br \/>\n     shall be no guarantee    in  regard<br \/>\n     to protecting their\t   exist<br \/>\n     ing pay and allowances or any<br \/>\n     other per fitness.\n<\/p><\/blockquote>\n<blockquote><p>     7.\t  It is\t further agreed that the<br \/>\n     staff, subject to their suitability<br \/>\n     may  be   regularized  but\t  shall,<br \/>\n     however,\tbe    subject\tto   the<br \/>\n     condition\tlaid down in clause 8.\n<\/p><\/blockquote>\n<blockquote><p>     8.\t  It is\t agreed that the members<br \/>\n     of the  staff will\t be  treated  as<br \/>\n     fresh entrants  and  they\twill  be<br \/>\n     placed   at the  bottom of\t the old<br \/>\n     Government\t  employees   in   their<br \/>\n     respective\t cadre\t including   the<br \/>\n     principal who  will be  absorbed as<br \/>\n     senior most lecturer intense of the<br \/>\n     concerned college.&#8221;\n<\/p><\/blockquote>\n<p>3.   In pursuance  of the  aforesaid. gift  deed, the  staff<br \/>\nmembers of  the college\t were absorbed in Government service<br \/>\nand the\t respondent who,  prior to  the taking\tover of\t the<br \/>\ncollege by  the Government  was working\t as  Principal,\t was<br \/>\nbrought in as Senior-most lecturer.\n<\/p>\n<p>4.   The respondent  wanted to\tbe absorbed  as Principal of<br \/>\nthe college and since it was not done, he represented to the<br \/>\nGovernment  and\t  when\tno   action   was   taken   on\t his<br \/>\nrepresentation. he  filed the  writ petition in the Punjab &amp;<br \/>\nHaryana High  Court which was allowed by the Single Judge on<br \/>\n6th of\tAugust, 1992  with a  direction to the appellants to<br \/>\nabsorb him  as principal of the college. It is this judgment<br \/>\nwhich was  upheld   by the  Division Bench of the High Court<br \/>\nand is now being questioned here in this Court.\n<\/p>\n<p>5.   Learned counsel  appearing for  the State of Punjab has<br \/>\ncontended that the claim of the respondent for absorption as<br \/>\nPrincipal of  the college  was wholly  out of  place and the<br \/>\nHigh Court  was in  error in  issuing a\t direction  for\t the<br \/>\nrespondent absorption  as Principal  of the  college. It  is<br \/>\npointed\t out   that  the  respondent,  in  his\tcapacity  as<br \/>\nPrincipal of Guru Nanak College. was already a member of the<br \/>\nManaging Committee  and\t in  the  crucial  meeting  of\tthat<br \/>\nCommittee. held\t on 18.5.83, in which the taking over of the<br \/>\ncollege was  approved on the terms set out in the gift deed,<br \/>\nhe was\tpresent and  therefore, cannot\tclaim  the  post  of<br \/>\nprincipal of  the college as it was specifically provided in<br \/>\nthe gift deed that the principal would be brought in only as<br \/>\na senior-most lecturer and not as principal.\n<\/p>\n<p>6.   The respondent  admittedly was  the  Principal  of\t the<br \/>\nprivate institution  which was\ttaken over by the Government<br \/>\nunder a\t gift deed  dated 11th\tof July,  1983 in  which the<br \/>\nterms and conditions on which the members of the staff would<br \/>\nhe absorbed  were set  out. A  perusal of  these  conditions<br \/>\nwhich have  already been  reproduced above,  would  indicate<br \/>\nthat while  the Government  was not  bound  to\tabsorb\teach<br \/>\nindividual member  of the  staff  unless  he  possessed\t the<br \/>\nrequisite qualifications,  the erstwhile Principal was to be<br \/>\nabsorbed as senior-most lecturer and not as principal. Since<br \/>\nmembers of  the staff  were absorbed  in terms\tof the\tgift<br \/>\nDeed, as new entrants. they were placed at the bottom of the<br \/>\nseniority in the related cadre.\n<\/p>\n<p>7.   The respondent took over as senior-most lecturer in the<br \/>\ncollege with  effect from  11th of  July, 1983\tand has been<br \/>\nworking as such. He, however, filed the writ petition in the<br \/>\nHigh Court  on 11.1.88 invoking the writ jurisdiction of the<br \/>\nCourt after  about four\t and a\thalf years. His petition was<br \/>\nthus liable  to be  rejected on\t the  ground  of  delay\t and<br \/>\nlaches.\n<\/p>\n<p>8.   What is the binding effect of the gift deed and to what<br \/>\nextent it  would regulate  the conditioner  service  of\t the<br \/>\nmembers of  the staff  was considered by this Court in State<br \/>\nof Punjab  &amp; Ors.Vs. Dev Dutt Kaushal &amp; Ors.. 1995 (4) Supp.<br \/>\nSSC 784=JT  1995 (6)  SC 225  by a  Bench of which one of us<br \/>\n(Hon&#8217;ble B.P.Jeeven  Reddy, J.) was a Member. The Petitioner<br \/>\nin that\t case had  claimed the\tbenefit of retirement at the<br \/>\nage of\t60 years  instead of  58 years\ton the\tbasis of his<br \/>\nbeing  a   lecturer  in\t a  private  institution  which\t was<br \/>\nsubsequently taken  over by  the Government  under gift deed<br \/>\ncontaining terms  and conditions  similar and  identical  to<br \/>\nthose contained in the gift deed in the Instant case. lt was<br \/>\nheld by\t this Court that in view of the terms and conditions<br \/>\nof the\tgift deed,  it was  not possible  to accede  to\t the<br \/>\nrequest of the petitioner for being superannuated at the age<br \/>\nof 60 years as it was specifically provided in the gift deed<br \/>\nthat in\t respect of  matters  which  were  not\tspecifically<br \/>\nprovided for  by the  gift deed,  the Government Rules would<br \/>\napply under  which the\tage  of\t retirement  was  58  years.<br \/>\nConsequently. the claim of the petitioner was rejected.\n<\/p>\n<p>9.   The gift  deed of\tthat case  is identical in its tenor<br \/>\nand contents  to the  gift deed\t in the\t instant  case\tand,<br \/>\ntherefore the  question as to the binding nature of the gift<br \/>\ndeed on the Management and Members of the staff is concluded<br \/>\nby the aforesaid decision.\n<\/p>\n<p>10.  Recruitment to and conditions of service of the post of<br \/>\nprincipal and other Class-I posts in the government colleges<br \/>\nwere regulated\tby Rules known as Punjab Educational Service<br \/>\n(College Cadre) (Class-I) Rules, 1976 made under Article 309<br \/>\nof the Constitution.\n<\/p>\n<p>Rule 9 provides as under:\n<\/p>\n<blockquote><p>     &#8220;9.  (i)\tNo   person   shall   be<br \/>\n\t  appointed   to a  post in  the<br \/>\n\t  Service by  direct recruitment<br \/>\n\t  unless  he\t possesses   the<br \/>\n\t  educational\t qualifications.<\/p><\/blockquote>\n<blockquote><p>\t  Professional\t training,   and<br \/>\n\t  other\t     qualifications   as<br \/>\n\t  specified in appendix &#8220;B&#8221; .\n<\/p><\/blockquote>\n<blockquote><p>\t  (ii) A  person appointed  to a<br \/>\n\t  post in  the service by direct<br \/>\n\t  recruitment\tshall\t possess<br \/>\n\t  knowledge   of    Punjabi   of<br \/>\n\t  Matriculation\t     or\t     its<br \/>\n\t  equivalent standard  which  he<br \/>\n\t  shall\t have\tto  acquire  the<br \/>\n\t  requisite knowledge  within  a<br \/>\n\t  period of  six months\t of  his<br \/>\n\t  appointment  after   which  he<br \/>\n\t  shall be  required to\t pass  a<br \/>\n\t  test of the aforesaid standard<br \/>\n\t  as may  be  specified\t by  the<br \/>\n\t  State\t Government,   otherwise<br \/>\n\t  his services\tshall be  liable<br \/>\n\t  to termination.\n<\/p><\/blockquote>\n<p>11. Method  of recruitment.  indicated in Rule 10. is quoted<br \/>\nbelow:\n<\/p>\n<blockquote><p>     &#8220;10. (1)  Appointment to  the posts<br \/>\n\t       in the  Service shall  be<br \/>\n\t       made   in    the\t  manner<br \/>\n\t       indicated below:-<\/p><\/blockquote>\n<blockquote><p>\t       (i)  In\t the   case   of<br \/>\n\t       Director\t   of\t  Public<br \/>\n\t       Instruction (Colleges) by<br \/>\n\t       selection  from\t amongst<br \/>\n\t       the   members\tof   the<br \/>\n\t       Service;\n<\/p><\/blockquote>\n<blockquote><p>\t       (ii) In the case of other<br \/>\n\t       posts in the Service-\n<\/p><\/blockquote>\n<blockquote><p>\t       (a) 50  per cent\t of  the<br \/>\n\t       posts by\t promotion  from<br \/>\n\t       amongst\tthe   member  of<br \/>\n\t       Punjab\t     Educational<br \/>\n\t       (College\t Cadre)\t Service<br \/>\n\t       (Class-\t II)\tor    by<br \/>\n\t       transfer\t or   deputation<br \/>\n\t       from\tother-\t   State<br \/>\n\t       Governments,   Government<br \/>\n\t       of    India     or    the<br \/>\n\t       universities having  such<br \/>\n\t       experience, Government of<br \/>\n\t       India   or   universities<br \/>\n\t       having such experience as<br \/>\n\t       is specified  in appendix<br \/>\n\t       &#8220;B&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>\t       (b) 50  per cent\t of  the<br \/>\n\t       posts\t  by\t  direct<br \/>\n\t       recruitment.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     (2)       All appointments\t to  the<br \/>\n\t       posts by\t promotion shall<br \/>\n\t       be made\ton the\tbasis of<br \/>\n\t       seniority-cum-merit   and<br \/>\n\t       no person  shall have any<br \/>\n\t       right\tfor    promotion<br \/>\n\t       merely on  the  basis  of<br \/>\n\t       seniority.\n<\/p><\/blockquote>\n<blockquote><p>     (3)       Whenever a vacancy occurs<br \/>\n\t       or is about to occur, the<br \/>\n\t       Government\t   shall<br \/>\n\t       determine the  manner  in<br \/>\n\t       which it shall be filled.<\/p><\/blockquote>\n<p>12. Qualifications prescribed for appointment to the post of<br \/>\nPrincipal were\tindicated in  Appendix &#8220;B&#8221;  which is  quoted<br \/>\nbelow:\n<\/p>\n<blockquote><p>\t     &#8220;APPENDIX &#8220;B&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      [Rule 9 (i)]<br \/>\n     &#8220;Qualifications and  experience for<br \/>\n     appointment to  the Service  (i) by<br \/>\n     direct   recruitment,    (ii)    by<br \/>\n     promotion\n<\/p><\/blockquote>\n<blockquote><p>     (i) By Direct Recruitment:\n<\/p><\/blockquote>\n<blockquote><p>\t  (a) M.A.  First  &#8216;Division  or<br \/>\n\t       High Second  Division (50<br \/>\n\t       % )  in relevant\t subject<br \/>\n\t       or an  equivalent  degree<br \/>\n\t       of a  foreign  University<br \/>\n\t       with  8\tyears&#8217;\tteaching<br \/>\n\t       experience.\n<\/p><\/blockquote>\n<blockquote><p>\t  (b)  Ph.D.   with  .8\t  years&#8217;<br \/>\n\t       teaching experience.\n<\/p><\/blockquote>\n<blockquote><p>     (ii) By Promotion:\n<\/p><\/blockquote>\n<blockquote><p>     Experience of working as a Lecturer<br \/>\n     for  a   minimum  period  of  eight<br \/>\n     years.&#8221;\n<\/p><\/blockquote>\n<p>13. By\tNotification dated  27.11.81. the Governor of Punjab<br \/>\nrelaxed the Rules in the case of service lecturers in Punjab<br \/>\nGovernment Colleges as under:\n<\/p>\n<blockquote><p>     &#8220;(1 )  The upper  age limit  of  45<br \/>\n\t  years prescribed  under rule 8<br \/>\n\t  of the  Rules ibid, be relaxed<br \/>\n\t  to the  extent of  52 years of<br \/>\n\t  age.\n<\/p><\/blockquote>\n<blockquote><p>     (2)  Qualifications for appointment<br \/>\n\t  to  the   service  by\t  direct<br \/>\n\t  recruitment  under  rule  9(i)<br \/>\n\t  Appendix &#8216;B&#8217; of the rules ibid<br \/>\n\t  has been prescribed M.A. First<br \/>\n\t  division   or\t   High\t  Second<br \/>\n\t  Division (55%) in the relevant<br \/>\n\t  subject   or\t an   equivalent<br \/>\n\t  degree   of\t a    recognized<br \/>\n\t  University be\t relaxed to  the<br \/>\n\t  extent  that\tthe  educational<br \/>\n\t  qualifications    for\t   these<br \/>\n\t  personnel should  be the  same<br \/>\n\t  which were  prescribed at  the<br \/>\n\t  time\tof  their  selection  as<br \/>\n\t  lecturers.&#8221;\n<\/p><\/blockquote>\n<p>14.  This Notification was issued in exercise of powers<br \/>\nConferred under\t Rule 19  of the  Punjab Educational Service<br \/>\n(College Cadre) (Class-I) Rules,1976.\n<\/p>\n<p>15.  It is pointed out that since respondent was M.A. Second<br \/>\nDivision  with\t52%  marks,  he\t was  not  qualified  to  be<br \/>\nappointed to  the post\tof Principal  as  the  qualification<br \/>\nrequired for  appointment  on  that  post  was\t&#8220;M.A.  First<br \/>\nDivision&#8221;  or\t&#8220;High  Second  Division(55%)&#8221;.\tIt  is\tthus<br \/>\napparent that respondent not being qualified for appointment<br \/>\nto the\tpost of\t Principal  could  not\tlegally\t claim\tsuch<br \/>\nappointment nor\t was it\t possible for the High Court to have<br \/>\nissued a  Mandamus that\t the respondent\t be  appointment  or<br \/>\nabsorbed on  that post.\t Articles 14  &amp; 16 which contain the<br \/>\nRule of\t Equality do  not envisage  that a person who is not<br \/>\nqualified for  appointment can\tstill claim such appointment<br \/>\nmerely on  the basis  of Fundamental  Rights available under<br \/>\nArticle 14 and 16. He cannot, in fact. invoke the provisions<br \/>\nof those  Articles as  he has first to possess the essential<br \/>\nqualification before  invoking the  Rule  of  Equality.\t The<br \/>\nfinding of  the Single\tJudge of  the High  Court  that\t the<br \/>\nrespondent  possessed\tthe  requisite\t qualification\t is,<br \/>\ntherefore. erroneous.  The Division  Bench also was in error<br \/>\nin confirming  the findings  though  it\t had  not  expressly<br \/>\nadverted  itself to this question.\n<\/p>\n<p>16.  Contention of  the learned\t counsel for  the respondent<br \/>\nthat in\t view of  the Circular\tdated 6th  of February, 1981<br \/>\nissued by  the Guru  Nanak Dev\tUniversity Amritsar in which<br \/>\nthe qualification  for appointment  to the post of Principal<br \/>\nin the\tUniversity were\t laid down,  the respondent shall be<br \/>\ndeemed to  possess the\trequisite qualification,  cannot  be<br \/>\naccepted as the government took over the college in 1983 and<br \/>\nhad already  prescribed\t the  qualifications  for  posts  of<br \/>\nlecturers and  Principal in  the Government College by Rules<br \/>\nmade under Article 309 of the Constitution. Appointments and<br \/>\npromotions with\t the provisions contained in these Rules and<br \/>\nnot in any other manner.\n<\/p>\n<p>17.  In view  of  the  above,  we  allow  this\tappeal.\t The<br \/>\njudgment and  order dated  6.8.92 passed by the Single Judge<br \/>\nand upheld  by the  Division Bench  of the  Punjab &amp; Haryana<br \/>\nHigh Court  on 25.1.95\tis hereby  set aside  and  the\twrit<br \/>\npetition of respondent is dismissed but without any order as<br \/>\nto costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Punjab &amp; Ors vs Tara Singh Shahi on 17 April, 1996 Equivalent citations: JT 1996 (6) 26, 1996 SCALE (3)716 Author: A S S.
