No.14858 of 2010\n                  GANGA PRASAD YADAV, SON OF LATE KANAK LAL YADAV\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>3.   29.06.2010               Heard learned counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                   offence under Sections 147, 148, 149, 302, 427, 379 of the<\/p>\n<p>                   Indian Penal Code and Section 27 of the Arms Act.<\/p>\n<p>                              Allegation   against   the   petitioner   in   the   First<\/p>\n<p>                   Information Report is that six accused persons came on two<\/p>\n<p>                   motorcycles and thereafter the petitioner is said to have fired<\/p>\n<p>                   firstly on the chest of the deceased and, thereafter, the co-<\/p>\n<p>                   accused Rameshwar Yadav is said to have fired and rest of the<\/p>\n<p>                   accused persons fired on the deceased.<\/p>\n<p>                              The submission is that some witnesses stated that in<\/p>\n<p>                   fact, there was cross firing between the parties and in the<\/p>\n<p>                   transaction, the deceased had sustained injuries and in fact, the<\/p>\n<p>                   petitioner was in Deoghar at that relevant time, the plea of alibi<\/p>\n<p>                   was verified by the Investigating Officer, found true, and<\/p>\n<p>                   petitioner was not charge sheeted initially. However, on perusal<\/p>\n<p>                   of the case diary, it appears that there is some interpolation<\/p>\n<p>                   even in the carbon copy of the case diary obviously with an<\/p>\n<p>                   intent to support the fact that there was cross firing between the<\/p>\n<p>                   parties and the plea of alibi was verified six months later and<\/p>\n<p>                   there is absolutely nothing on record to show as to what was<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        the ailment that had afflicted the petitioner while he was in<\/p>\n<p>        Deoghar at that relevant time.\n<\/p>\n<p>                      In view of such, I am not inclined to grant bail to the<\/p>\n<p>        petitioner.\n<\/p>\n<p>                      The prayer for bail is rejected.\n<\/p>\n<p>                      The trial court is directed to immediately commit the<\/p>\n<p>        case to the court of Session so that there is not further delay in<\/p>\n<p>        the trial.\n<\/p>\n<\/p>\n<p>                                    ( Anjana Prakash, J.)<br \/>\nS.Ali\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ganga Prasad Yadav vs The State Of Bihar on 29 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
