Justice V.GIRI\n\n Dated :14\/08\/2007\n\n O R D E R\n                    J.B.KOSHY &amp; V.GIRI, JJ.\n            -------------------------------------\n                    M.F.A.No.710 OF 2001\n            -------------------------------------\n                    Dated 14th August, 2007\n\n                           JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>          This  appeal  is  filed  by  the  insurance  company<\/p>\n<p>contending that the driver of the vehicle insured by it had no<\/p>\n<p>effective driving licence on the date of accident and hence<\/p>\n<p>insurance company is not liable to pay the compensation.    It<\/p>\n<p>is submitted that a petty case was charged against the driver,<\/p>\n<p>but, there is no evidence to show that he was convicted.<\/p>\n<p>Further, the Tribunal also found as follows:<\/p>\n<blockquote><p>               &#8220;There is no evidence to prove that R1<br \/>\n          was not possessed of D.L. to drive the<br \/>\n          offending vehicle.    So also there is no<br \/>\n          evidence   to  prove   that   R2  knowingly<br \/>\n          entrusted the vehicle for driving by an<br \/>\n          unlicenced  driver.     3rd respondent  has<br \/>\n          validly insured the vehicle.      So it is<br \/>\n          liable to indemnify the claim.&#8221;\n<\/p><\/blockquote>\n<p><a href=\"\/doc\/1827019\/\">In National Insurance Co. Ltd. v. Swaran Singh and others (AIR<\/a><\/p>\n<p>2004 SC 1531) the Apex Court has considered the matter in<\/p>\n<p>detail and at paragraph 105 the points were summarised.  Point<\/p>\n<p>Nos.1, 3, 4, 5 and 6 are as follows:<\/p>\n<blockquote><p>             &#8220;1. Chapter XI of the Motor Vehicles<br \/>\n        Act, 1988 providing compulsory insurance of<br \/>\n        vehicles against third party risks is a<\/p>\n<p><span class=\"hidden_text\">MFA.710\/2001                  2<\/span><\/p>\n<p>          social  welfare  legislation  to   extend<br \/>\n          relief  by  compensation  to  victims  of<br \/>\n          accidents  caused   by   use   of   motor<br \/>\n          vehicles.  The provisions of compulsory<br \/>\n          insurance coverage of all vehicles are<br \/>\n          with  this  paramount   object  and   the<br \/>\n          provisions of the Act have to be so<br \/>\n          interpreted as to effectuate the said<br \/>\n          object.\n<\/p><\/blockquote>\n<blockquote><p>              xx        xx        xx        xx<\/p>\n<\/blockquote>\n<blockquote><p>              3. The breach of policy condition,<br \/>\n          e.g.,  disqualification   of  driver   or<br \/>\n          invalid driving licence of the driver, as<br \/>\n          contained in sub-section (2)(a)(ii) of<br \/>\n          Section 149, have to be proved to have<br \/>\n          been  committed   by  the   insured   for<br \/>\n          avoiding liability by the insurer.   Mere<br \/>\n          absence, fake or invalid driving licence<br \/>\n          or disqualification of the driver for<br \/>\n          driving at the relevant time, are not in<br \/>\n          themselves  defences  available  to   the<br \/>\n          insurer against either the insured or the<br \/>\n          third parties.   To avoid its liability<br \/>\n          towards insured, the insurer has to prove<br \/>\n          that the insured was guilty of negligence<br \/>\n          and failed to exercise reasonable care in<br \/>\n          the matter of fulfilling the condition of<br \/>\n          the policy regarding use of vehicles by<br \/>\n          duly licensed driver or one who was not<br \/>\n          disqualified to drive at the relevant<br \/>\n          time.\n<\/p><\/blockquote>\n<blockquote><p>              4.   The  insurance  companies   are,<br \/>\n          however,  with  a  view  to  avoid  their<br \/>\n          liability must not only establish the<br \/>\n          available defence(s) raised in the said<br \/>\n          proceedings  but   must  also   establish<br \/>\n          `breach&#8217; on the part of the owner of the<br \/>\n          vehicle; the burden of proof therefore<br \/>\n          would be on them.\n<\/p><\/blockquote>\n<blockquote><p>              5. The court cannot lay down any<br \/>\n          criteria as to how said burden would be<br \/>\n          discharged, in as much as the same would<br \/>\n          depend upon the facts and circumstances<br \/>\n          of each case.\n<\/p><\/blockquote>\n<blockquote><p>              6. Even where the insurer is able to<br \/>\n          prove breach on the part of the insured<\/p>\n<p><span class=\"hidden_text\">MFA.710\/2001                  3<\/span><\/p>\n<p>          concerning the policy condition regarding<br \/>\n          holding of a valid licence by the driver<br \/>\n          or his qualification to drive during the<br \/>\n          relevant period, the insurer would not be<br \/>\n          allowed to avoid its liability towards<br \/>\n          insured  unless   the  said   breach  or<br \/>\n          breaches  on  the  condition  of  driving<br \/>\n          licence  is\/are  so  fundamental  as  are<br \/>\n          found to have contributed to the cause of<br \/>\n          the   accident.      The   Tribunals   in<br \/>\n          interpreting the policy conditions would<br \/>\n          apply &#8220;the rule of main purpose&#8221; and the<br \/>\n          concept of &#8220;fundamental breach&#8221; to allow<br \/>\n          defences available to the insured under<br \/>\n          Section 149(2) of the Act.&#8221;\n<\/p><\/blockquote>\n<p>Here,  there   was  no  evidence  to  show  that  the  owner<\/p>\n<p>(insured) was negligent in entrusting the vehicle to first<\/p>\n<p>respondent knowing that he was not having proper licence<\/p>\n<p>and insurance company has not proved that the driver was<\/p>\n<p>not  having   valid  driving  licence  and  the  matter  was<\/p>\n<p>considered by the Tribunal.
