      This Appeal is against an Order dated 7th May, 1997 by
\nwhich  the  first  appeal filed by the\tappellant  has\tbeen
\ndismissed  in  limine.\t Briefly  stated the  facts  are  as
\nfollows:   The Petitioner is a sole proprietory concern.  It
\nruns  its  workshop  of shaping steel  sheets  into  various
\nshapes\tand forms.  The 1st Respondent was, at the  relevant
\ntime,  working\tas a press operator with the Appellant.\t  On
\n27th  January,\t1993  while  working on\t a  press,  the\t 1st
\nRespondent  sustained injuries to his right index finger and
\nthumb.\tThe Appellant rushed the 1st Respondent to the Civil
\nHospital  at  Gurgaon (Haryana).  The injuries\tnecessitated
\namputation  of 2.5 x 0.5 Cms.  of the index finger.  On 14th
\nJune,  1993,  the  1st Respondent filed a  claim  under\t the@@
\n\t\t\t\t\t\t\t JJJ
\nWorkmen’s  Compensation\t Act, 1923 claiming compensation  in@@
\nJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ
\nthe  sum  of Rs.  25,000\/- with interest thereon @  16%\t per
\nannum.\tThe Appellant in his reply, inter alia, claimed that
\nthe  provisions of the Workmen’s Compensation Act would\t not
\napply  to  his\testablishment.\t On 15th  October  1996\t the
\nCommissioner  held  that  the\tWorkmen’s  Compensation\t Act
\napplied\t  and  that  the  Appellant   was  liable   to\t pay
\ncompensation   in  a  sum  of  Rs.29,814\/-   together\twith
\nRs.5,000\/-  as\tpenalty and interest at 12% per annum.\t The
\nAppellant  preferred  an  Appeal  under Section\t 30  of\t the
\nWorken’s  Compensation Act before the High Court of Punjab &
\nHaryana.   That Appeal came to be dismissed in limine by the
\nimpugned order dated 7th May, 1997.  It is admitted that the
\n1st  Respondent\t was  working as a press operator  with\t the
\nAppellant  at  the relevant time.  It is admitted  that\t the
\naccident  did  took place on 27th January, 1993 and that  it
\nresulted  in injuries to the right index finger and thumb of
\nthe  1st Respondent and that this necessitated amputation of
\n2.5  x 0.5 Cms.\t of the index finger.  Mr.  Vasdev  however,
\nsubmitted  that the Workmen’s Compensation Act did not apply
\nto the Appellant’s establishment.  He submitted that Section
\n2(n)  (ii) of the Wormen’s Compensation Act provides that  a
\nworkman\t is  a\tperson employed in a capacity  specified  in
\nSchedule  II.\tHe  then  referred to  Schedule\t II  of\t the
\nWorkmen’s Compensation Act and pointed out that under item 2
\nof  Schedule  II a person would be a workman provided he  is
\nemployed  in  any premises where a manufacturing process  as
\ndefined in clause (k) of Section 2 of the Factories Act 1948
\nwas  being  carried on.\t He submitted that this showed\tthat
\nthe  provisions of the Factories Act were being incorporated
\ninto the Workmen’s Compensation Act.  He submitted that this
\nis  also clear from the fact that over the years there\thave
\nbeen  a\t number of amendments to the Workmen’s\tCompensation
\nAct  incorporating therein provision of the Factories Act or
\nprovisions  similar  thereto.  He then referred\t to  Section
\n2(k) and 2 (m) of the Factories Act and submitted that under
\nthe  Factories\tAct the manufacturing process must be  in  a
\nfactory\t where\tten  or\t more workers are  working  (if\t the
\nmanufacturing  process\tis being carried on with the aid  of
\npower)\tor  twenty  or\tmore persons  are  working  (if\t the
\nmanufacturing process is being carried on without the aid of
\npower).\t  He  submitted\t that a joint reading of  all  these
\nprovisions  makes it clear that even for the purposes of the
\nWorkmen’s  Compensation\t Act  only  those  persons  who\t are
\nemployed  in  a factory within the meaning of the  Factories
\nAct,  1948  would  be  entitled to make a  claim  under\t the
\nWorkmen’s  Compensation\t Act.  We are unable to\t accept\t the
\nsubmissions  of\t the learned counsel.  It is true  that\t the
\nWorkmen’s  Compensation\t Act,  1923 has been  amended  on  a
\nnumber of occasions.  However inspite of numerous amendments
\nthe  Legislature  has  purposely   omitted  to\tspecifically
\nprovide that only a workman who is employed in a factory, as
\ndefined\t in the Factories Act, could make a claim.  All that
\nhas  been  done\t is  that in Schedule II  of  the  Workmen’s
\nCompensation  Act  it is inter alia clarified  that  persons
\nemployed,  otherwise  than  in a clerical capacity,  in\t any
\npremises  wherein  a  manufacturing process  as\t defined  in
\nclause\t(k)  of\t Section 2 of the Factories Act,  1948,\t are
\nworkmen.  Significantly the definition of the term “Factory”
\nas appearing in clause (m) of Section 2 of the Factories Act
\n1948 has not been incorporated in the Workmen’s Compensation
\nAct.   Thus it is clear that for the Workmen’s\tCompensation
\nAct  to apply it is not necessary that the workman should be
\nworking\t in a Factory as defined in the Factories Act, 1948.
\nIt  has\t not been denied that the workshop of the  Appellant
\nwould  fall  under clause (k) of Section 2 of the  Factories
\nAct.   Therefore,  the\t1st Respondent would  be  a  Workman
\nwithin\tthe meaning of the term as defined in the  Workmen’s
\nCompensation  Act.  Under the circumstances, we see no merit
\nin  the\t Appeal.   The same stands dismissed.\tThere  will,
