DAVE\n\t\t\n\t\n\n \n\nDate\n: 19\/07\/2011 ORAL ORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.II-110 of 2011 with Godhra Town &#8220;A&#8221; Division<br \/>\n\tPolice Station, Godhra for the offences punishable under Section 7<br \/>\n\tof the Essential Commodities Act and Sections 2, 6(4), 7(3) and 7 of<br \/>\n\tP.D.S. (Control) Order, 2011.\n<\/p>\n<p>The<br \/>\n\tlearned counsel for the applicant submits that the basic allegation<br \/>\n\tagainst the applicant is of committing offence under the Essential<br \/>\n\tCommodities Act, Rules, Regulations and Control Order made<br \/>\n\tthereunder and the registered ration cards allotted to the rationing<br \/>\n\tshop, as shown, are not tallying with the &#8216;on-line&#8217; voters&#8217; list<br \/>\n\tand, on the basis of  short-fall, the Authority has presumed that<br \/>\n\tthe essential commodities for the last 36 months are divested or<br \/>\n\tsold contrary to the provisions of the law. It is further submitted<br \/>\n\tthat the ration card is issued by the Mamlatdar and the Competent<br \/>\n\tAuthority of the Food and Civil Supplies Department  of the State of<br \/>\n\tGujarat and the applicant has  no control over it. That, once such<br \/>\n\tration cards are allotted, necessary action is to be taken at the<br \/>\n\tend of the owner of the rationing shop and the commodities so<br \/>\n\tdistributed will be entered into the ration cards as well as the<br \/>\n\tbill register and the stock will be shown accordingly in the<br \/>\n\tregister of the stock which will also indicate purchase as well as<br \/>\n\tsale of the essential commodities. That, the criteria for issuance<br \/>\n\tof ration cards and registration of voters are different and no<br \/>\n\tpresumption or assumption can be drawn on the basis of names of<br \/>\n\tration-card holders and those registered with &#8216;on-line&#8217; registration<br \/>\n\tof the voters. Besides, the complaint was registered on or around<br \/>\n\t20th June 2011 onwards and the alleged stock of essential<br \/>\n\tcommodities have been seized. That, the applicant is available for<br \/>\n\tinvestigation, but custodial interrogation in such type of case is<br \/>\n\tnot necessary. The applicant is a permanent resident and has<br \/>\n\tproperty in Godhra and will not flee from justice. In view of the<br \/>\n\tabove, the applicant may be granted anticipatory bail.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tManisha Shah, learned APP, submits that to find out the true persons<br \/>\n\twho are holding ration cards and distributed essential commodities<br \/>\n\tas per the register maintained by the ration-shop owner and other<br \/>\n\tdetails, custodial interrogation of the applicant is necessary. It<br \/>\n\tis further submitted that in the case of divesting of a huge stock<br \/>\n\tof essential commodities, powers under Section 438 of the Code<br \/>\n\tcannot be exercised.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and overall consideration of<br \/>\n\tallegations, perusal of the papers, provisions of the Act, Rules and<br \/>\n\tRegulations and conditions of the licence, prima-facie, except a<br \/>\n\tbare version in the complaint about not tallying or matching of<br \/>\n\tration-card holders with the voter&#8217;s list, complaint and police<br \/>\n\tpapers at this stage reveal the  amount calculated of essential<br \/>\n\tcommodities distributed for the last 36 months, therefore, custodial<br \/>\n\tinterrogation is not necessary since the  Competent Authority under<br \/>\n\tthe Act is conferred with powers to take action in accordance with<br \/>\n\tlaw including seizure of stock of commodities, all registers,<br \/>\n\tration-cards, bills and even suspension of licence and further<br \/>\n\taction if deemed fit.\n<\/p>\n<p>Considering<br \/>\n\tthe above, at this stage, I am inclined to grant anticipatory bail<br \/>\n\tto the applicant.  This Court has also taken into consideration the<br \/>\n\tlaw laid down by the Apex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam<br \/>\n\tSatlingappa Mhetre v. State of Maharashtra &amp; Ors. Reported<\/a> in<br \/>\n\t[2011]1 SCC 694, wherein the Apex Court reiterated the law<br \/>\n\tlaid down by the Constitutional Bench in the case of Shri<br \/>\n\tGurubaksh Singh Sibbia &amp; Ors. Reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tfirst information report registered at CR No.II-110 of 2011 with<br \/>\n\tGodhra Town &#8220;A&#8221; Division Police Station, Godhra    the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.10,000\/- (Rupees Ten Thousand only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself \tavailable for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  29.7.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>\tThe<br \/>\nobservations made in this order are only for the purpose of exercise<br \/>\nof powers under Section 438 of the Code and  shall have no bearing on<br \/>\nany other proceedings pending before any Court or Forum or Authority.<br \/>\nRule made absolute.
