It may be recorded that pursuant to the earlier order passed by<br \/>\n\tthis Court in the present appeal, the learned APP has declared<br \/>\n\tbefore us that the Government has taken decision of not to prefer<br \/>\n\tappeal against the order of acquittal.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances and more particularly in view of the two<br \/>\n\tdying declarations, it is a case to be considered in the appeal.<br \/>\n\tHence, leave deserves to be granted.
