{"id":187882,"date":"2009-07-01T00:00:00","date_gmt":"2009-06-30T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/khem-singh-vs-state-of-haryana-on-1-july-2009"},"modified":"2018-02-25T07:47:48","modified_gmt":"2018-02-25T02:17:48","slug":"khem-singh-vs-state-of-haryana-on-1-july-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/khem-singh-vs-state-of-haryana-on-1-july-2009","title":{"rendered":"Khem Singh vs State Of Haryana on 1 July, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Khem Singh vs State Of Haryana on 1 July, 2009<\/div>\n<pre>In the High Court for the States of Pun jab and Haryana at\nChandigarh.\n\n\n\n\n             Decided on July 01,2009.\n\n\nKhem Singh                                     Petitioner\n\n                 vs.\n\nState of Haryana                                   Respondent.<\/pre>\n<p>Present:   Mr. Tribhuvan Dahiya, Advocate,for the petitioner<\/p>\n<p>           Mr.Partap Singh,Sr.DAG,Haryana.\n<\/p>\n<p>\nRakesh Kumar Jain, J:\n<\/p>\n<\/p>\n<p>           On a complaint filed under Section 156 (3) of the Code<\/p>\n<p>of Criminal Procedure,1973 (in short, &#8216;Cr.PC), a case under Sections<\/p>\n<p>420\/467\/468\/471\/419\/120-B     of Indian Penal Code , was registered<\/p>\n<p>vide FIR No. 95 dated 06.2.2009 at Police Station, Faridabad Central,<\/p>\n<p>District Faridabad., against as many as five persons, namely Khem<\/p>\n<p>Singh, Beg Raj, Anil, Harikant Sharma, Advocate and one unknown<\/p>\n<p>person, on the allegations that in conspiracy with each other, land<\/p>\n<p>measuring 71 kanal 02 marlas situated in village Alipur Shikar Gah,<\/p>\n<p>Faridabad owned by one Shiv      Sahay    son of   Kanhaya     son of<\/p>\n<p>Bhura,resident of the same village, who is permanently missing since<\/p>\n<p>1911 from Delhi, has been sold by accused No.5 (unknown person)<\/p>\n<p>impersonating as Shiv Sahay in favour of Khem Singh (petitioner)<br \/>\n vide registered sale deed No.20889 dated 12.12.2008 which has been<\/p>\n<p>witnessed by Beg Raj and Anil who have been identified by Harikant<\/p>\n<p>Sharma Advocate.\n<\/p>\n<p>             Apprehending his arrest, the petitioner filed Bail<\/p>\n<p>application No.1 of 2009 before the Addl.Sessions Judge (Fast Track<\/p>\n<p>Court), Faridabad, which has been dismissed on 15.4.2009. Aggrieved<\/p>\n<p>against the said order, the petitioner has filed the present      bail<\/p>\n<p>application in which notice of motion was issued on 2.6.2009 for<\/p>\n<p>09.6.2009, but interim     relief was declined. On 9.6.2009, the case<\/p>\n<p>was adjourned for today.\n<\/p>\n<p>           Mr. Tribhuvan Dahiya, learned counsel for the petitioner<\/p>\n<p>has vehemently argued that the petitioner is a bonafide purchaser of<\/p>\n<p>the land in question for a sum of Rs.20 lacs and in fact, he has been<\/p>\n<p>cheated by the seller.\n<\/p>\n<p>           On the other hand , learned counsel appearing on behalf<\/p>\n<p>of the respondent-State      has contended that out of five accused<\/p>\n<p>mentioned herein above, Beg Raj and Harish have been arrested on<\/p>\n<p>5.3.2009 and 24.3.2009 and the other two accused Anil and Harikant<\/p>\n<p>Sharma have not been arrested so         far.   It is also argued that<\/p>\n<p>admittedly, the land in dispute is owned by      Shiv Sahay who has<\/p>\n<p>been recorded as dead in the jamabandi for the year 1999-2000, and<\/p>\n<p>the sale and purchase of his land was prohibited.     Learned counsel<\/p>\n<p>for the respondent-State       has argued that     the petitioner has<\/p>\n<p>committed a serious offence as it is not reflected from the sale deed<\/p>\n<p>that amount of Rs. 20 lacs was paid before the Sub Registrar.\n<\/p>\n<p>                Keeping in view the nature of offence but without<\/p>\n<p>commenting on the merit of the case, I do not find it to be a fit case<\/p>\n<p>for grant      of anticipatory bail to the petitioner.
