MUKHOPADHAYA)<\/p>\n<p> CIVIL<br \/>\nAPPLICATION No. 8324 of 2010<\/p>\n<p>\tThis<br \/>\nCivil Application has been preferred for condonation of delay of 299<br \/>\ndays in preferring the proposed petition for restoration.\n<\/p>\n<p>\tIt<br \/>\nappears that the petitioner preferred a Letters Patent Appeal with<br \/>\ncertain defects which having not removed, the Court dismissed the<br \/>\nappeal for non-compliance of the Court&#8217;s order.\n<\/p>\n<p>\tIt<br \/>\nis stated that because of the inadvertent bona fide mistake of the<br \/>\nadvocate&#8217;s clerk, the defects could not be removed in the Letters<br \/>\nPatent Appeal.  The advocate who was initially engaged to appear in<br \/>\nthe Letters Patent Appeal having appointed as the Additional<br \/>\nSolicitor General of India, Supreme Court, the defects could not be<br \/>\nremoved by the Clerk.\n<\/p>\n<p>\tWe<br \/>\nhave perused the petition and heard Ms Krina P Calla, learned AGP<br \/>\nappearing on behalf of the respondents.  We being satisfied with the<br \/>\nground shown, condone the delay of 299 days in preferring the Misc.<br \/>\nCivil Application for restoration.\n<\/p>\n<p>\tThis<br \/>\nCivil Application stands disposed of.\n<\/p>\n<p> MISC.CIVIL<br \/>\nAPPLICATION No. 564 OF 2011<\/p>\n<p>\tPerused<br \/>\nthe petition.  Heard Ms Krina P Calla, learned AGP for the<br \/>\nrespondents.  For the grounds as shown by the petitioner as recorded<br \/>\nabove, the petition for restoration is allowed.  Letters Patent<br \/>\nAppeal (Stamp) No. 1727 of 2008 is restored to its original file.\n<\/p>\n<p>\tThis<br \/>\nMisc. Civil Application stands disposed of.\n<\/p>\n<p> LETTERS<br \/>\nPATENT APPEAL (STAMP NUMBER) No. 1727 of 2008<\/p>\n<p>\tThe<br \/>\ncounsel for the appellant is allowed time till 28th<br \/>\nFebruary, 2011 to remove the defects, failing which the appeal shall<br \/>\nstand dismissed without further reference to the Bench.  In case of<br \/>\nnon-compliance, the matter should be brought to the notice of the<br \/>\nCourt on 18th<br \/>\nMarch, 2011.\n<\/p>\n<p>\t\t\t\t\t\t[S.\n<\/p>\n<p>J.
