On<br \/>\n28.10.1994, it was found that he has committed irregularity of<br \/>\ncollecting fare without issuing tickets. Departmental inquiry was<br \/>\ninitiated against him which resulted in the dismissal of the services<br \/>\nof the respondent. Against the dismissal order, the respondent<br \/>\ntherefore raised a dispute by way of Reference (L.C.A) No. 1162 of<br \/>\n1999 wherein the Labour Court, Ahmedabad has passed the award as<br \/>\nstated hereinabove which is challenged in the present petition.\n<\/p>\n<p>3.0\tHeard<br \/>\nlearned advocates appearing for the respective parties and perused<br \/>\nthe documents on record. As a result of this exercise, the Labour<br \/>\nCourt has found that the allegation against the petitioner regarding<br \/>\nmisbehaviour  and dishonesty was not proved.  The statements of the<br \/>\npassengers regarding the misappropriation of Rs. 23\/- were not taken.<br \/>\nIn  my  opinion, the Labour Court was fully justified in granting<br \/>\nreinstatement to the respondent without backwages and imposing<br \/>\npenalty of stoppage of two increments with future effect. This<br \/>\npenalty is sufficient for the misconduct of the respondent and it<br \/>\ndoes not require any enhancement.\n<\/p>\n<p>4.0\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is therefore dismissed.
