The said<br \/>\npetition was preferred by the appellant to challenge an award passed<br \/>\nby Presiding Officer, Labour Court, Nadiad in Reference (LCN) No.17<br \/>\nof 1990 on 26th May,  1999, whereby the Labour Court<br \/>\ndirected the petitioner  to pay backwages from the date of<br \/>\nretrenchment  i.e. 8.8.1989 till the respondent obtained Sanad as an<br \/>\nadvocate in the year 1994.\n<\/p>\n<p>2.<br \/>\n The respondent was an employee of the appellant working as a Clerk.<br \/>\nHe came to be retrenched from service and therefore he raised an<br \/>\nindustrial dispute and reference was made to the Labour Court, which<br \/>\nwas registered as Reference (LCN) No.17 of 1990 before Labour Court,<br \/>\nNadiad.\n<\/p>\n<p>3.<br \/>\nRespondent on the other hand  continued his study and obtained a<br \/>\nSanad somewhere in 1994.  The Labour Court, after considering the<br \/>\nevidence led before it, came to conclusion that the appellant has not<br \/>\nbeen able to show that provision contained in Section 25-G of the<br \/>\nIndustrial Disputes Act (hereinafter referred to as  I.D.Act )<br \/>\nhave been properly followed and therefore passed the impugned order.\n<\/p>\n<p>4.<br \/>\n   The case of the appellant is that the Labour Court erred in<br \/>\nappreciating the evidence.  The evidence of the respondent before the<br \/>\nLabour Court is clear and there was no need to look for seniority<br \/>\nlist, which error the Labour Court has committed. The evidence of the<br \/>\nrespondent itself is clear to show that all his juniors  were<br \/>\nretrenched before his retrenchment and, therefore, the appeal may be<br \/>\nentertained.\n<\/p>\n<p>5.<br \/>\n     Learned advocate Mr.Dave has reiterated the grounds stated in<br \/>\nthe appeal.\n<\/p>\n<p>6.<br \/>\nThe appellant has also produced the record of the Labour Court.<br \/>\nHowever, going through the record, we find that seniority list  of<br \/>\nthe employees of the federation is not forming part of record of the<br \/>\nLabour Court.  What is produced is only a list of employees working<br \/>\nwith the appellant in the month of August 1989.  Unless seniority<br \/>\nlist is produced and specific evidence is brought on record  either<br \/>\nthrough admission of the appellant or by adducing its own evidence by<br \/>\nthe appellant to show that juniors to the respondent were retrenched<br \/>\nfirst or prior to the respondent, the Labour Court could not have<br \/>\ncome to conclusion that provision contained under Section 25-G of the<br \/>\nI.D.Act were followed.  While appreciating the petition, again a list<br \/>\nof employees for the month of August 1989 is produced  but not<br \/>\nseniority list.\n<\/p>\n<p>7.<br \/>\n   \t In our opinion, neither the Labour Court nor the learned Single<br \/>\nJudge can be said to have  committed any error in not accepting the<br \/>\nversion of the appellant that the  requirements of Section 25-G of<br \/>\nthe I.D.Act were properly complied with.   If those requirements are<br \/>\nnot complied with, the Labour Court was justified in passing the<br \/>\nimpugned award and the learned Single Judge was also justified in<br \/>\npassing the orders impugned in the appeal.  We do not find any merits<br \/>\nin the appeal.  The appeal must fail and stands dismissed.\n<\/p>\n<p>8.<br \/>\n   In light of  dismissal of the main appeal, Civil Application<br \/>\nNo.9797 of 2010 stands    dismissed.<\/p>\n<pre>\n \n\n \n \n\n\n \n\n(\nA.L.
