Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :18\/03\/2010\n\n O R D E R\n<\/pre>\n<p>          THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>       R.P.167\/2010 in W.P.(C).37846\/2007-E<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>       Dated this the 18th day of March, 2010.<\/p>\n<p>                       Order<\/p>\n<p>1.This review petition is filed on the premise that<\/p>\n<p> the finding in the judgment sought to be reviewed<\/p>\n<p> that the petitioner did not have the locus standi<\/p>\n<p> to file the writ petition and challenge the<\/p>\n<p> impugned sale proceedings, is unsustainable. It<\/p>\n<p> has   been  specifically   held  in  the   impugned<\/p>\n<p> judgment that the right to complain about the<\/p>\n<p> sale is definitely only with the person whose<\/p>\n<p> property   has  been   sold.   This   is  how   the<\/p>\n<p> particular statutory provision has been construed<\/p>\n<p> by this Court while considering whether the right<\/p>\n<p> of the writ petitioner or his interest has been<\/p>\n<p> affected by the impugned sale proceedings. There<\/p>\n<p> is no error apparent on the face of the record of<\/p>\n<p> the impugned judgment and the question raised has<\/p>\n<p> not been left without being considered.<\/p>\n<p><span class=\"hidden_text\">RP167\/10              -: 2 :-<\/span><\/p>\n<p>2.I may also notice that the issue raised with<\/p>\n<p>  regard to Section 68B of the Second Schedule to<\/p>\n<p>  the   Income Tax  Act    was answered   in WP(C).<\/p>\n<p>  1867\/2008 arising from the same proceedings at<\/p>\n<p>  the   instance  of  the    father-in-law  of  the<\/p>\n<p>  petitioner herein, who is the guarantor to the<\/p>\n<p>  transaction.\n<\/p>\n<p>  I do not find any ground to exercise the review<\/p>\n<p>  jurisdiction on the aforesaid facts. This review<\/p>\n<p>  petition   fails.
