Justice ANTONY DOMINIC\n\n Dated :05\/06\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                W.P.(C).No.32460 OF 2003\n              ------------------------\n            Dated this the 5th day of June, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>      Challenge in this writ petition is against Exts.P8 and<\/p>\n<p>P10 and the petitioner seeks a declaration that the<\/p>\n<p>petitioner&#8217;s establishment do not come within the purview<\/p>\n<p>of the Air(Prevention and Control of Pollution)Act 1981, as<\/p>\n<p>is outside   the definition of  &#8220;Industrial Plant&#8221;. A further<\/p>\n<p>direction to the first respondent to reconsider the coverage<\/p>\n<p>of the petitioner&#8217;s factory under the purview of the Act is<\/p>\n<p>also sought for.\n<\/p>\n<p>      2. Petitioner submits that it is manufacturing match<\/p>\n<p>sticks which are being supplied to the match factories.<\/p>\n<p>According to the petitioner, the unit has been functioning<\/p>\n<p>since 1978 without any complaint from any corner. It is<\/p>\n<p>seen that the petitioner was issued Ext.P1 letter directing<\/p>\n<p>him to inform whether they are         using sulpher in the<\/p>\n<p><span class=\"hidden_text\">WP(c).No.32460\/03           2<\/span><\/p>\n<p>factory. Reply was given and finally Ext.P6 show cause notice<\/p>\n<p>was issued. On its receipt petitioner gave Ext.P7 reply<\/p>\n<p>disputing its liability to comply with the requirements of Air<\/p>\n<p>Act and also sought for an opportunity of hearing to explain<\/p>\n<p>his contentions. The      objections raised by the petitioner<\/p>\n<p>disputing     coverage of   the Act were rejected and by the<\/p>\n<p>impugned proceedings, the petitioner was asked to apply for<\/p>\n<p>consent and also to increase the height of the Chimney. It is in<\/p>\n<p>these circumstances the writ petition is filed with the aforesaid<\/p>\n<p>prayers.\n<\/p>\n<p>      3. As already noticed, it is the case of the petitioner that<\/p>\n<p>their unit has been functioning since 1978 and that it is not an<\/p>\n<p>industrial plant as defined in Section 2K of the Air Act, due to<\/p>\n<p>absence of air pollutants. It was raising this contention that<\/p>\n<p>the petitioner filed his reply to the show cause notice.<\/p>\n<p>Petitioner wanted to substantiate         his contentions and<\/p>\n<p>therefore he sought an opportunity of hearing. However, it<\/p>\n<p>was denied by the respondents for the reason that consequent<\/p>\n<p>on the notification issued by the Government of Kerala, entire<\/p>\n<p>industries in the State have been brought within the coverage<\/p>\n<p><span class=\"hidden_text\">WP(c).No.32460\/03              3<\/span><\/p>\n<p>of the Air Act and therefore it was not necessary to give an<\/p>\n<p>opportunity of hearing.\n<\/p>\n<p>      4. Having considered the justification thus offered by the<\/p>\n<p>respondents I must confess my inability to accept the same. As<\/p>\n<p>already stated, it is the case of the petitioner that            his<\/p>\n<p>establishment is not an industrial plant due to absence of air<\/p>\n<p>pollutants. If it is factually correct, his industry will be outside<\/p>\n<p>the purview of the Act.         When the petitioner wanted to<\/p>\n<p>substantiate this contention and sought an opportunity of<\/p>\n<p>hearing, the first respondent should certainly have given that<\/p>\n<p>opportunity to the petitioner.        Having not done so, I am<\/p>\n<p>inclined to hold that, Exts.P8 and P10 orders impugned in this<\/p>\n<p>writ petition are passed for violation of the principles of<\/p>\n<p>natural justice.\n<\/p>\n<p>       For that reason      and without expressing anything on<\/p>\n<p>merits, Exts.P8 and P10 are set aside and the first respondent<\/p>\n<p>is directed to reconsider Ext.P6 in the light of Ext.P7, with<\/p>\n<p>notice and opportunity of hearing to the petitioner and as<\/p>\n<p>expeditiously as possible.
