Justice V.RAMKUMAR\n\n Dated :28\/03\/2007\n\n O R D E R\n                             V.RAMKUMAR, J.\n\n                             ----------------------------\n\n                     Bail Application No. 1841\/2007\n\n                             -----------------------------\n\n                   Dated this  28th day of March, 2007\n\n\n                                   O R D E R\n<\/pre>\n<p>                The petitioners, who are the husband, father-in-law<\/p>\n<p>and   sister-in-law     of   Omana,   the   defacto   complainant,   seek<\/p>\n<p>anticipatory   bail.     The   petitioners   are   accused   Nos.   1   to   3   in<\/p>\n<p>Crime No.158\/2007   of Kottarakkara Police Station for offences<\/p>\n<p>punishable   under   Sections   498-A   and   494   IPC.     The   marriage<\/p>\n<p>between the defacto complainant, Omana, and the first accused<\/p>\n<p>took place on 10.2.2000. A child has been born in that wedlock.\n<\/p>\n<p>The complaint of the  defacto complainant is that from the eighth<\/p>\n<p>month   of   the   marriage   onwards,   she   has   been   ill-treated   and<\/p>\n<p>harassed   by   the   petitioner   with   demands   of   dowry   and   the<\/p>\n<p>petitioner   has   subsequently   contracted   another   marriage   with<\/p>\n<p>one Radha.\n<\/p>\n<p>      2.     After hearing both sides and considering the facts and<\/p>\n<p>circumstances   of   this   case,   I   am   inclined   to   grant   anticipatory<\/p>\n<p>bail to the petitioners 2 and 3 (accused Nos. 2 and 3).\n<\/p>\n<p>      3.     Accordingly, a direction is issued to the Investigating<\/p>\n<p>Officer  to release the petitioners 2 and 3 (accused Nos. 2 and 3)<\/p>\n<p>on bail for a period of one month   in the event of their arrest in<\/p>\n<p>B.A.1841\/2007<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>connection   with   the   above   case   on   each   of   them   executing   a<\/p>\n<p>bond   for   Rs.   10,000\/-   (Rupees   ten   thousand   only)     with   two<\/p>\n<p>solvent   sureties   each   for   the   like   amount   to   the   satisfaction   to<\/p>\n<p>the Investigating officer and subject to the following conditions:\n<\/p>\n<blockquote><p>            (a).          The second petitioner (second accused)<\/p>\n<p>                 shall   report   before   the   Investigating   Officer<\/p>\n<p>                 between   9   a.m.   and   11   a.m.   on   all<\/p>\n<p>                 Wednesdays.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>            (b).          Petitioners 2 and 3 (accused Nos. 2 and<\/p>\n<\/blockquote>\n<blockquote><p>                 3)     shall   make     themselves   available   for<\/p>\n<p>                 interrogation   as   and   when     required   by   the<\/p>\n<p>                 Investigating Officer.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              (c).        Petitioners 2 and 3 (accused Nos. 2 and<\/p>\n<\/blockquote>\n<blockquote><p>                 3)   shall   not   influence   or   intimidate   the<\/p>\n<p>                 prosecution witnesses nor shall they attempt<\/p>\n<p>                 to   tamper   with   the   evidence   for   the<\/p>\n<p>                 prosecution.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>              (d).        Petitioners 2 and 3 (accused Nos. 2 and<\/p>\n<\/blockquote>\n<blockquote><p>                 3)   shall   not   commit   any   offence   while   on<\/p>\n<p>                 bail.<\/p><\/blockquote>\n<p>              (e).    Petitioners 2 and 3 (accused Nos. 2 and<\/p>\n<p>                 3)     shall   surrender   before   the   Magistrate<\/p>\n<p>B.A.1841\/2007<\/p>\n<p><span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>                 concerned   and   seek   regular   bail   in   the<\/p>\n<p>                 meanwhile.\n<\/p>\n<p>        4.     If   the   petitioners   2   and   3   (accused   Nos.   2   and   3)<\/p>\n<p>commit breach of any of the above conditions, the bail granted<\/p>\n<p>to them shall be liable to be cancelled.\n<\/p>\n<p>         5.    In the case of the first petitioner,  who is the husband<\/p>\n<p>of   Omana,   the   defacto   complainant,   he   shall   surrender   before<\/p>\n<p>the     Investigating   Officer   for   interrogation   and   his   application<\/p>\n<p>for   regular   bail   shall,   thereafter,   be   considered   by   the<\/p>\n<p>Magistrate having jurisdiction.\n<\/p>\n<p>        6.
