M. SAHAI)<\/a><\/p>\n<p>1.\tWe have<br \/>\nheard learned counsel Mr. G.R. Thakar for the petitioners, learned<br \/>\nAssistant Government Pleader Mr. N.J. Shah for respondent Nos. 1,4<br \/>\nand 5 and learned counsel Mr. H.S. Munshaw for respondent Nos.2 and\n<\/p>\n<p>3. <\/p>\n<p>2.\tThis<br \/>\npetition has been filed by the petitioners for  issuance of the<br \/>\ndirection to the respondent authorities to fix compensation  and to<br \/>\npay the petitioner solatium, interest, etc. by completing the<br \/>\nprocedure for acquisition and by making an award.\n<\/p>\n<p>3.\tThe writ<br \/>\npetition was prepared on 13th October 2010, but was filed<br \/>\nin the Registry on 14th March 2011.\n<\/p>\n<p>4.\tNotification<br \/>\nunder Section 4 of the Land Acquisition Act ( for short, &#8216;the Act&#8217;)<br \/>\nwas issued on 26.5.2011 for acquiring the same land on which the road<br \/>\nhas already been constructed. Declaration under Section 6 of the Act<br \/>\nhas not yet been issued. However, in the affidavit-in-reply, filed by<br \/>\nrespondent No.2, it is admitted that the road known as Moli-Majethi\n<\/p>\n<p>-Rajapar Road, Taluka  Dasada, District Surendranagar, having width<br \/>\nof 6 Mtrs.  and length of 4 Km. was constructed in the year 1980-1981<br \/>\nand the said District Road was a new road. The possession of the land<br \/>\nfor construction of the road was taken by the respondents on 2.5.1981<br \/>\nfrom the land owners.\n<\/p>\n<p>5.\tIt is<br \/>\nalleged that the petitioners whose land was taken for construction of<br \/>\nthe road claimed compensation which was considered by the respondents<br \/>\nin the year 1989 and correspondence took place between the respondent<br \/>\nNos.2,3,4 and 5.\n<\/p>\n<p>6.\tThe<br \/>\ngrievance of the petitioners is that since the possession of the land<br \/>\nhas been taken on 2.5.1981, this fact may be considered by the<br \/>\nCollector while making award under Section 11 of the Act.\n<\/p>\n<p>7.\tOnce<br \/>\nthis is an admitted fact that the possession of the land has been<br \/>\ntaken by the State on 2.5.1981 for construction of the new road and<br \/>\nthe road has been constructed, this fact shall be taken into<br \/>\nconsideration by the Collector while making award under Section 11 of<br \/>\nthe Act in pursuance of the land acquisition proceedings which have<br \/>\nbeen initiated on 26.5.2011.\n<\/p>\n<p>8.\tWith the<br \/>\naforesaid direction, this petition stands finally disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>(V.M.\n<\/p>\n<p>SAHAI, J.)<\/p>\n<p>\t\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>(G.B.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>omkar<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court =========================================Appearance vs Mr Nj Shah on 8 July, 2011 Author: V.
