S.J. MUKHOPADHAYA)<\/p>\n<p>\tUnder<br \/>\nSection 4(3) of the Juvenile Justice (Care and Protection of<br \/>\nChildren) Act, 2000, only a Magistrate having special knowledge or<br \/>\ntraining in child psychology or child welfare is eligible for<br \/>\nappointment as a Member of the Juvenile Justice Board.  It has come<br \/>\nto the notice of the Court that no specific order of appointment has<br \/>\nbeen issued by the State appointing one or other qualified Magistrate<br \/>\nas Member of the Board.  By notification, it is only notified that<br \/>\nsenior most Magistrate  of the District will function as Member of<br \/>\nthe Juvenile Justice Board, which prima facie appears to be not in<br \/>\naccordance with law.  In the circumstances, the respondent &#8211;<br \/>\nState is directed to state as to why they be not directed to take up<br \/>\nthe matter with the High Court, request the High Court to nominate<br \/>\nqualified Magistrates for appointment to the posts of Magistrate<br \/>\nMember of Juvenile Justice Board and why the State Government be not<br \/>\ndirected to notify them as Members of the Board.\n<\/p>\n<p>\tIt<br \/>\nis expected that the State Government will rectify the technical<br \/>\ndefects in the matter of constitution of Juvenile Justice Board.\n<\/p>\n<p>\tLet<br \/>\na copy of this order be handed over to the learned Government Pleader<br \/>\nfor information to the officials concerned.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 14th December, 2010.\n<\/p>\n<p>\t\t\t\t\t\t[S.J.\n<\/p>\n<p>MUKHOPADHAYA, CJ.]<\/p>\n<p>\t\t\t\t\t\t\t[K.\n<\/p>\n<p>M.
