One  W\/jo\ufb02l*\u00a7ate-.5’Btivafdredowda filed a suit
\nseeking p.a.rtiti”o.n”o;f–It’h.e pjro_per’tiesHd,escribed in the schedule
\nto the gjliainti for’V’V’=;i:ssig.n4rn_:erit and to unto her haif share<\/p>\n
therein. In”the_suit_ she”  into party one Indiramma<\/p>\n
.~vV.\u00ab(herV_\u00bb\u00bbs=f;ep daughter)_a_s_defendant No.1 and 6 more persons<\/p>\n
“:__d*esc~riVbing’\u00abtr’i\u00ab-ern __as purchasers of the different portions of<\/p>\n
the:sc.iieVdui\u00e9L:property. In support of such reiief she averred<\/p>\n
{that ii-kgdstegowda was the absoiute owner in possession of<\/p>\n
“.js.en\\\/e’ra! properties. He had married two wives, viz.,<\/p>\n
W7Ke\u00a7nchamma and Maliamma (piaintiff). Badregowda died in<\/p>\n
 year 1975 ieaving beyond piaintiff (Maliamma), the first<\/p>\n
-‘\\’ 5 ,.\n<\/p>\n

wife Kenchamma and her daughter Indiaramma (defendant
\nNo.1). However, the first wife of Badregowda, Kenchamiiia
\ndied after his death leaving beyond only the plaintiffand the<\/p>\n
Indiramma (defendant herein) to succeed to th_’ei.e_’stat,e of<\/p>\n
Bhadregowda. In short, her plea was <\/p>\n
died intestate and his first wife Kencham’rnaV”‘a’lis.,o ‘died. isiie. <\/p>\n
and the defendant No.1 were  o-tiiy”Vhei*rs”‘tov
\nthe property in equal
\nfactual position and lE’9al enti–t.i\u00e9rg_”ne”i’–~..,l:,,_ ‘defentlant No.1 —
\nIndiramma, with sinliswltg  her taking<\/p>\n
advantage of t.he.__fact’th’at’:l\u00a7\/ia_i”ia.rn_rna-  shifted because of<\/p>\n
her    houlsvelll of her relatives, sold five
\nproperties- to defeAnda’nt:A’N\u00abo~.’2 to 7. Contending that deed of<\/p>\n
Sale by wh’ic._h defendant No.1 — Indiaramma sold property<\/p>\n
 AtO’…,d’ef.end’ant No.2′””t’oV “7 was not binding on her, she sought<\/p>\n
  tilts Vain.,n”ti.EgiTsentv._j..\n<\/p>\n
 suit was contested by defendant No.1<\/p>\n
 throijgh1~ a detailed written statement denying the titie of the<\/p>\n
 ‘pl_afi”ntiff and she supported the saie in favour of defendant<\/p>\n
‘  __.i\\lo.2. to 7. The defendant No.2 to 7 did not file any written<\/p>\n

view. However, Mallamma claimed for maintenance was
\ngranted. Before the learned first appellate Court the issue
\nwas whether Mallamma was entitled to half share–.._in the<\/p>\n
property and whether deed of sale executed b,y7Vfn’dji4′.rah1.ma<\/p>\n
— defendant No.1 was valid. During pendencx\/jof:the’app’eal’ <\/p>\n
Mallamma died. She had no issues.\n<\/p>\n
11. Therefore, the: .,re|evanVt”‘ c;ue,st’io.n:,_\u00e9.th’e “‘*?\u00a7rs’t,<\/p>\n
appellate Court to be decilfdend _was”‘~wuhaVt will be the
\nconsequence of her  :heA”‘ha_d half share in the
\nschedule property, upo._n,:’her.’dVea,th”‘it.’frag. -to pass on to her<\/p>\n
legal heirs.?_”  |”ega–l-~” heir, Indiramma ~<\/p>\n
defendant’  daughter, who was no doubt,
\ndefendarit.__,Nio,.wloruldahecome entitled. Instead of deciding<\/p>\n
th.is,,.iss’ue the “iear_n_ed appellate Judge held Parvathegowda,<\/p>\n
\u00bb lone’ o.f’th’e,,”de_fendant, to come on record as legal heir of<\/p>\n
H ‘–i\\:\/lai.lan\ufb01rha:dehspite opposition to such order.<\/p>\n
if z  The learned counsel for appellant is right in<\/p>\n
if ff,p’o”i.ntin’g out that when the appellant had pointed out that<\/p>\n
AV’,?arf\\\/athegowda was not related to Mallamma and was not a<\/p>\n

legal heir he could not have bee brought on record as legal
\nheir of Mallamma to Continue the appeal. It must be
\nnoticed that when the dispute is raised as to whoT’i’s. legal<\/p>\n
heir, under Order XXI Rule 5 detailed enquiry-f_lfia_cl’C?to”..I;)e<\/p>\n
held. That becomes very essential in th,i_s’V_A’_jcasel,” <\/p>\n
Parvathegowda had not shown1:lho\\iy,,ne””.wa’s’r.lh:egalDhVei_r’:’of<\/p>\n
Mallamma. The order direactlng
\ntherefore, unjust and erronelolusl’ _ V V. V  ‘V<\/p>\n
13. Viewed    be seen that
\nundoubtedly: in the schedule
\nDroDertY:  Court and in the
\nappeal the  accordingly modified. However,
\nas durinlglthev  petition since Mallamma died<\/p>\n
vv.h\u00a7at’ev~er rig’h’t–..VsVh_e__had passed on to her legal heir and in<\/p>\n
\u00bb Vlthils case’4i.,t”~tv__as undoubtedly Indiramma — defendant No.1,<\/p>\n
H  vvaVs’_”,:adjrnittedly a step daughter. Since except her no<\/p>\n
ori’e,.e’i’lse’is pointed out to be heir of Mallamma, Indiramma<\/p>\n
 Padefvendant No.1 should have succeeded in her appeal<\/p>\n
Atgactlon. The consequence would have been appeal filed by<\/p>\n
H Mallamma had to abate, as right to sue did not survive on<\/p>\n
any body. In the resultant position, appeal filed by
\nIndiramma — defendant No.1 in RA No. 100\/1995 had to be
\nallowed in its entirety. Instead of examining this issue the
\nlearned appellate Judge brought Parvathegowd.aVV_gl’-as~._|egal<\/p>\n
heir of Mallamma, whose right was not atltalll'”t’e-sl;efd._.”‘a_s<\/p>\n
required under Order xxx: Rulewss CPC'”t’g,…:’gj’ro’S’ecLiyte..:the<\/p>\n
appeal. Further, appellate Court has:’ei*red.’<\/p>\n
Judgment and granting re:i’_ef._to li\ufb01allllammiaiyvlh’iry.p.oVse.:’\u00a7ai\u00a7Deaq.
\nhad abated in the absence   <\/p>\n
14. It must  Parvathegowda
\nhad sought to_co_me  the Will purported<\/p>\n
to have been V’e:{‘e.c’ut.e’d..:by’–.Mallamma in his favour. In other
\nwords, i5>a._rvathV\u00e9gow.d”aisought to continue the appeal action<\/p>\n
as\ufb01llelvgal helr”ef:Vl$(lalAl:.amma on the basis of the Will, which<\/p>\n
\u00bb V:Vconte,nt\u00abi.on.:’was urged for the first time in the appeal to<\/p>\n
 Whether there was a Will executed by<\/p>\n
Ma’llanV1.m’afin favour of Parvathegowda was not the issue for<\/p>\n
 fcornsidleration in appeal. Rightly the appellate Court held<\/p>\n
 such contention of Parvethegowda could not be<\/p>\n
H entertained but learned appellate Judge erred in holding<\/p>\n
that he can continue appeal action and in the result by
\nallowed the appeal filed by Mallamma (deceased) granting
\nher share in the schedule property and declared<\/p>\n
Parvethegowda to succeed. This order is unsustaji’i’2–afble;..A’\n<\/p>\n
15. In the result, the Judgment and _\u00a7:i’ecre~e__j:p3a__ssed<\/p>\n
in RA 94\/1995 is set aside and the matter. -to<\/p>\n
