KRISHNAN, J.\n                  ...........................................\n                   M.A.C.A.No.267 OF 2009\n                  .............................................\n          Dated this the 18th day of November, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred by the claimant against the<\/p>\n<p>award of the Claims Tribunal, Irinjalakkuda in OP(MV)<\/p>\n<p>No.377\/2003     whereby          the      Tribunal           has awarded  a<\/p>\n<p>compensation of Rs.26.900\/= and exonerated the insurance<\/p>\n<p>company from the liability.            Challenging the correctness of<\/p>\n<p>the said finding, the appeal is preferred.<\/p>\n<p>      2. After perusing the award, I find that the claimant was<\/p>\n<p>hospitalized thrice for a total period of 24 days and                nature<\/p>\n<p>of the injury is cerebral concussion. He was initially treated<\/p>\n<p>for ten days as an inpatient. Subsequently again from 4.10.<\/p>\n<p>2002 to 6.10.2002 and from 15.10.2002 to 23.10.2002<\/p>\n<p>Certainly this would have affected her amenities and<\/p>\n<p>therefore, I award an additional compensation of Rs.5,000\/=<\/p>\n<p>under that head.\n<\/p>\n<p>      3.  The main contention                 raised in the       appeal is<\/p>\n<p>regarding    exoneration of the insurance company from the<\/p>\n<p>liability. The learned counsel for the insurance company in<\/p>\n<p><span class=\"hidden_text\">                                : 2 :<\/span><br \/>\nM.A.C.A.No.267 OF 2009<\/p>\n<p>fairness at my request had produced a copy of the policy<\/p>\n<p>with conditions of the policy. I had perused the policy and it<\/p>\n<p>is very clearly seen that it is a comprehensive policy. When I<\/p>\n<p>use the word comprehensive policy, I am aware that it does<\/p>\n<p>not mean by itself that additional premium is paid for the<\/p>\n<p>coverage of a pillion rider. But these type of comprehensive<\/p>\n<p>policies are followed by the conditions and the conditions<\/p>\n<p>are also made        available before me. Section II(i) of the<\/p>\n<p>conditions would reveal that the insurance company has<\/p>\n<p>undertaken to indemnify the insured in respect of death or<\/p>\n<p>bodily injury to any person conveyed      in or on the motor<\/p>\n<p>cycle provided, such person is not carried for hire or reward.<\/p>\n<p>The very same clause came up for interpretation before a<\/p>\n<p>Division Bench of this Court in <a href=\"\/doc\/135962\/\">New India Assurance Co.<\/p>\n<p>Ltd v. Hydrose<\/a> (2008 (3) KLT 778) and it was laid down in<\/p>\n<p>that decision that by virtue of the conditions of the contract,<\/p>\n<p>the insurance company has undertaken to wipe off the<\/p>\n<p>liability and, therefore, there need not be any payment of<\/p>\n<p>additional premium for the coverage of such person. In the<\/p>\n<p>light of this decision and as the policy condition is contained<\/p>\n<p><span class=\"hidden_text\">                               : 3 :<\/span><br \/>\nM.A.C.A.No.267 OF 2009<\/p>\n<p>in such    clause, the insurance company has to be made<\/p>\n<p>liable and I do so.\n<\/p>\n<p>      4. In the result the MACA is partly allowed and the<\/p>\n<p>claimant is awarded        an       additional compensation of<\/p>\n<p>Rs.5,000\/= with 7% interest on the said sum from the date<\/p>\n<p>of the petition till realisation.   The insurance company is<\/p>\n<p>made liable to pay the entire amount awarded by the<\/p>\n<p>Tribunal as well as this Court and the      finding exonerating<\/p>\n<p>the insurance company from the liability is set aside. The<\/p>\n<p>insurance company is directed to deposit the said amount<\/p>\n<p>within a period of 60 days from the date of receipt of a copy<\/p>\n<p>of this judgment.\n<\/p>\n<p>      Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                     M.N.
