BALAKRISHNAN, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>\tThe appellants in these two appeals challenge the<br \/>\njudgment of the Division Bench of the High Court of Gujarat.<br \/>\nK.M. Shah Dental College, appellant in one of the two appeals<br \/>\nherein, is a dental college in the district of Vadodra in Gujarat.<br \/>\nThey held entrance examination for admission to  the post-<br \/>\ngraduate course (M.D.S. in all branches], for which an<br \/>\nadvertisement was published by them in two daily newspapers<br \/>\non 17.6.2006.   The last date for receipt of applications was<br \/>\n22.6.2006 and thereafter the entrance examination was held<br \/>\non 25.6.2006.    Though the counselling had been notified for<br \/>\n27.6.2006, the entire admission process was completed on<br \/>\n26.6.2006 itself.  According to the appellant-college,  24<br \/>\nstudents had  sought admission, but  only 23 students  were<br \/>\nselected.   One of the students who sat for the entrance<br \/>\nexamination filed a Special Civil Application before the High<br \/>\nCourt of Gujarat challenging the process of selection followed<br \/>\nby the appellant-college.   The learned single Judge directed<br \/>\nthat the appellant-college  shall not fill up the seats of the<br \/>\npost-graduate course on the basis of the common entrance<br \/>\nexamination held on 25.6.2006.   The appellant-college<br \/>\nchallenged the same in a writ appeal and the Division Bench<br \/>\nfound that the common entrance examination conducted by<br \/>\nthe appellant-college was not fair and transparent and non-<br \/>\nexploitative and held that all the 23 seats will be filled up from<br \/>\nthe list prepared by the Gujarat University.\n<\/p>\n<p>\tWe heard the appellant&#8217;s counsel and counsel for the<br \/>\nrespondents.   The counsel for the appellant-college contended<br \/>\nthat the entrance examination was held in accordance with<br \/>\nlaw and the appellant-college being a single college was<br \/>\nentitled to conduct the entrance examination of its own based<br \/>\non the decision of this  Court in <a href=\"\/doc\/1390531\/\">P.A. Inamdar vs. State of<br \/>\nMaharashtra<\/a> [2005] 6 SCC 537.   Counsel for the respondents<br \/>\non the other hand contended that even if it is assumed that<br \/>\nthe appellant-college had the right to conduct the entrance<br \/>\nexamination, the selection process was illegal and not fair to<br \/>\nthe students seeking admission.   The Division Bench in the<br \/>\nimpugned judgment has pointed out   a series of irregularities<br \/>\nin the conduct of the entrance examination.   The whole<br \/>\nentrance examination was done in a haphazard manner.   The<br \/>\nentrance examination was advertised on 17.6.2006, the last<br \/>\ndate for receipt of applications was fixed as 22.6.2006 and the<br \/>\ncounseling was notified for 27.6.2006 whereas the counseling<br \/>\nwas held on the previous day.   It is also contended that some<br \/>\nof the students who sought admission were denied application<br \/>\nforms, short date were given for examination in order to<br \/>\nprevent the candidates from submitting the applications for<br \/>\nexamination.   It is also alleged that the appellant-college was<br \/>\ntrying to circumvent the directions contained in various<br \/>\ndecisions of this Court.  The appellant-college, on the other<br \/>\nhand, contended that the whole process  of selection had to be<br \/>\nconducted before 30th June, 2006 and hence short time was<br \/>\ngiven for submitting the applications.\n<\/p>\n<p>\tOn a close scrutiny of the various dates as also the way<br \/>\nin which the entrance examination was conducted, we affirm<br \/>\nthe view held by the Division Bench that the entrance<br \/>\nexamination was not fair and transparent.   It is high time that<br \/>\nthe Dental Council of India as well as the Medical Council of<br \/>\nIndia may fix in advance the approximate dates  during which<br \/>\nthe entrance examination is to be held by various colleges.<br \/>\nWhen there is an outer limit fixed for the final admission of the<br \/>\nstudents to various courses,  the Dental Council, the Medical<br \/>\nCouncil and the All India Council for Technical Education and<br \/>\nsuch other authorities, which are regulating the admission of<br \/>\nstudents in various colleges,  shall be careful in seeing that<br \/>\nirregularities are not committed in the matter of admissions.<br \/>\nThese institutions can fix in advance  the  dates of<br \/>\nadvertisement,  availability of application forms  as also final<br \/>\nreceipt of application forms.   For the purpose of conducting<br \/>\nthe entrance examination, some approximate dates could be<br \/>\nfixed giving sufficient time for the colleges to regulate   the<br \/>\nadmissions.   As the students have to compete in more than<br \/>\none examinations to secure admission in one of the colleges,<br \/>\nsufficient opportunity should be given to the colleges to fix the<br \/>\ndate of entrance examination.  If this regulatory mechanism is<br \/>\nprovided for, there can be  a final date for admission to each<br \/>\ncollege.\n<\/p>\n<p> In the present case, though the entrance examination<br \/>\nwas not held in a proper manner, we do not think that the<br \/>\nDivision Bench was justified in directing that the entire 23<br \/>\nseats should be filled up from the list prepared by the Gujarat<br \/>\nUniversity.    At least some of the students, if  not all the 23<br \/>\nstudents who got admission,  may be meritorious  for getting<br \/>\nadmission to the post-graduate course.   Their merit is to be<br \/>\nassessed by  a competent authority.     The counsel for the<br \/>\nrespondents submitted that there should be a fresh entrance<br \/>\nexamination and that all these students should be given a<br \/>\nchance to  compete.    We are not inclined to  accept the<br \/>\nsubmission as all other students had  appeared for the<br \/>\nentrance examination held by the Gujarat University.\n<\/p>\n<p>\t\tIn the result, we direct that 24 applicants, who are<br \/>\nstated to have applied pursuant to publication of<br \/>\nadvertisement on 17.6.2006, shall be subjected to a fresh<br \/>\nmerit-assessment test, to be conducted by the Head  of the<br \/>\nDepartment of Dentistry of the All India Institute of Medical<br \/>\nSciences.   All the modalities in this behalf shall be worked out<br \/>\nby the HOD in consultation with the appellant-College.  The<br \/>\nHead of the Department of Dentistry at the AIIMS shall give<br \/>\nnotice to all the applicants, whose addresses shall be<br \/>\nfurnished by the College.  The test shall be held at the earliest<br \/>\nand the appellant-college shall deposit a sum of rupees one<br \/>\nlakh as initial expenses for conducting the said test.  If any<br \/>\nother expenses are required to be incurred,  the appellant-<br \/>\ncollege  shall pay that amount also.     If anyone or more of<br \/>\nthese 24 students is found meritorious and eligible for<br \/>\nadmission to the MDS (Dental]  by the HOD at the AIIMS,  the<br \/>\nappellant- college is entitled to fill  up the seats out of these 24<br \/>\nstudents available and if some seats are left over thereafter,<br \/>\nthe same shall be filled up out of the list prepared by the<br \/>\nGujarat University for admission to the post-graduate dental<br \/>\ncourse. The last date fixed as 30th June, 2006 for admission<br \/>\nto the post-graduate courses, shall be waived in the case of<br \/>\nthese 24 students.\n<\/p>\n<p>\tThe appeals are disposed of accordingly with no order as<br \/>\nto costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Dr. Romil B.
