The Chief Conservator of Forest had affirmed the order\npassed by the Divisional Forest Officer-cum-competent authority,\nMandla dated 30.8.2008 directing forfeiture of the tractor and trolley of\nrespondent.<\/pre>\n<p>       Learned counsel for State assailed the order on the grounds<br \/>\nthat the forest goods were found in the vehicle and the Divisional<br \/>\nForest Officer had rightly directed forfeiture of the tractor and trolley<br \/>\nand the Chief Conservator of Forest had rightly affirmed the aforesaid<br \/>\norder, but the Additional Sessions Judge has not considered the<br \/>\nfindings recorded by the authorities while reversing the order.\n<\/p>\n<p>       From the perusal of the impugned order and material on record,<br \/>\nwe find that respondent was transporting his household goods by<br \/>\ntractor and trolley and alongwith household goods, 5 teak door-frames<br \/>\nwere found. As aforesaid door-frames were found in the vehicle,<br \/>\ntractor and trolley both were seized by the forest authorities and<br \/>\nthereafter confiscation proceedings were initiated under Section 15(5)<br \/>\nof the M.P. Van Upaj (Vyapar Viniyaman) Adhiniyam, 1969. The<br \/>\nAdditional Sessions Judge by the impugned order found that the<br \/>\naforesaid door-frames were finished wood and the respondent was<br \/>\ntransporting these door-frames alongwith the household goods and<br \/>\nfor finished product, provisions of aforesaid Act were not applicable.<br \/>\nThe State could not produce any material before the Additional<br \/>\nSessions Judge that the transportation of the aforesaid finished wood<br \/>\nalongwith the household goods were not permissible under the<br \/>\naforesaid Act.\n<\/p>\n<p><span class=\"hidden_text\">                                                                          2<\/span><\/p>\n<p>                         W.P.No.5512\/10<\/p>\n<p>     State of M.P. &amp; others                      Sukratlal Chakravarty<\/p>\n<p>     10.5.2010<br \/>\n           In view of aforesaid, no error is found in the impugned order<br \/>\n     passed by the Additional Sessions Judge allowing the revision filed by<br \/>\n     the respondent and quashing the confiscation order passed by the<br \/>\n     aforesaid authorities.
