RAVEENDRAN\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\n(Arising out of SLP(C) No. 6666 of 2005) <\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\tLeave granted.\n<\/p>\n<p>Appellants call in question legality of the judgment<br \/>\nrendered by a Division Bench of the Calcutta High Court<br \/>\nholding that the respondent were entitled to the benefit<br \/>\nunder the scheme called Casual Labourers (Grant of Temporary<br \/>\nStatus and Regularisation) Scheme, 1993 of Government of<br \/>\nIndia. Judgment and order dated 7th September, 2001 passed<br \/>\nby the Calcutta Bench of Central Administrative Tribunal (in<br \/>\nshort the &#8216;Tribunal&#8217;) in OA No. 992 of 1998 filed by the<br \/>\nrespondent under Section 19 of the Administrative Tribunal<br \/>\nAct, 1985 (in short the &#8216;Act&#8217;) was held to be in order.<br \/>\nFactual background in a nutshell is as follows:\n<\/p>\n<p>Respondents filed an original application before the<br \/>\nTribunal claiming that they had rendered service from 1988<br \/>\nto 1997 as casual workers.  According to them they have<br \/>\ncompleted the requisite period of service as described<br \/>\nhereinbelow:\n<\/p>\n<p>&#8220;It was claimed that the department had<br \/>\ncirculated by O.M. No. 51016\/2\/90-Estt.(C)<br \/>\ndated 10.9.1993 a scheme for grant of<br \/>\ntemporary status and regularization of casual<br \/>\nworkers.  The scheme is called Casual<br \/>\nLabourers (Grant of Temporary Status and<br \/>\nRegularisation) Scheme of Govt. of India,<br \/>\n1993.  The said scheme came into force with<br \/>\neffect from 1.9.1993.  The scheme envisaged<br \/>\ngrant of temporary status to casual labourer<br \/>\nwho had worked at least 240 days in a year<br \/>\n(206) days in the case of offices observing 5<br \/>\ndays a week)&#8221;.\n<\/p>\n<p>The relevant portion of paragraph 3 of the scheme reads<br \/>\nas follows:\n<\/p>\n<p>&#8220;This scheme is applicable to casual<br \/>\nlabourers in employment of the<br \/>\nMinistries\/Department of Government of India<br \/>\nand their attached and subordinate officer,<br \/>\non the date of issue of these order.&#8221;\n<\/p>\n<p>Paragraph\t4(1) of the Scheme reads as follows:\n<\/p>\n<p>&#8220;Temporary Status &#8211; Temporary status would<br \/>\nbe conferred on all casual labourers who are<br \/>\nin employment on the date of issue of this<br \/>\nO.M. and have rendered a continuous service<br \/>\nof at least one year, which means that they<br \/>\nmust have been engaged for a period of at<br \/>\nleast 240(206 days in the cases of offices<br \/>\nobserving 5 days a week).&#8221;\n<\/p>\n<p>It was held by the High Court that though this Court<br \/>\nhad in Civil Appeal No. 224 of 2000 and connected appeals<br \/>\nheld that the scheme in question was not an on going process<br \/>\nbut one time scheme yet the judgment and order of the<br \/>\nTribunal having been rendered on 7th September, 2001 long<br \/>\nbefore the decision of this Court in Civil Appeal referred<br \/>\nto above, a right which had arisen from the Tribunal&#8217;s order<br \/>\nhas been saved by this Court in its judgment.  It was noted<br \/>\nthat positive direction has been given by this Court in the<br \/>\njudgment that those who had already been given temporary<br \/>\nstatus on the assumption that the scheme is an on going<br \/>\nscheme should not be deprived of the said status because of<br \/>\nthe judgment.\n<\/p>\n<p>According to learned counsel for the appellant the High<br \/>\nCourt&#8217;s judgment is clearly erroneous on the face of the<br \/>\njudgment in <a href=\"\/doc\/1786961\/\">Union of India v. Mohan Pal and Others<\/a> reported<br \/>\nin (2002(4) SCC 573).\n<\/p>\n<p>On the contrary learned counsel for the respondents<br \/>\nsubmitted that the observations in paragraph 11 of Mohan<br \/>\nLal&#8217;s case (supra) protect them as was rightly observed by<br \/>\nthe High Court.\n<\/p>\n<p>\tThe controversy can be resolved on the basis of the<br \/>\ninterpretation of clause 4 of the Scheme. As already<br \/>\nnoticed, the Scheme came into effect from 1.9.1993.\n<\/p>\n<p>Clause 4 of the Scheme is very clear that the<br \/>\nconferment of &#8220;temporary&#8221; status is to be given to the<br \/>\ncasual labourers who were in employment as on the date of<br \/>\ncommencement of the Scheme.  Tribunal has taken the view<br \/>\nthat this is an ongoing scheme and as and when casual<br \/>\nlabourers complete 240 days of work in a year or 206 days<br \/>\n(in case of offices observing 5 days a week), they are<br \/>\nentitled to get &#8220;temporary&#8221; status.  We do not think that<br \/>\nclause 4 of the Scheme envisages it as an ongoing scheme.<br \/>\nIn order to acquire &#8220;temporary&#8221; status, the casual<br \/>\nlabourer should have been in employment as on the date of<br \/>\ncommencement of the Scheme and he should have also rendered<br \/>\na continuous service of at least one year which means that<br \/>\nhe should have been engaged for a period of at least 240<br \/>\ndays in a year or 206 days in case of officers observing 5<br \/>\ndays a week.  From clause 4 of the Scheme, it does not<br \/>\nappear to be a general guideline to be applied for the<br \/>\npurpose of giving &#8220;temporary&#8221; status to all the casual<br \/>\nworkers, as and when they complete one year&#8217;s continuous<br \/>\nservice.  Of course, it is up to the Union Government to<br \/>\nformulate any scheme as and when it is found necessary that<br \/>\nthe casual labourers are to be given &#8220;temporary&#8221; status<br \/>\nand later they are to be absorbed in Group &#8220;D&#8221; posts.\n<\/p>\n<p>This position was highlighted in <a href=\"\/doc\/219931\/\">Union of India v.<br \/>\nGagan Kumar (JT<\/a> 2005 (6) SC 410).\n<\/p>\n<p>Above being the position the Tribunal&#8217;s order is<br \/>\nclearly untenable and the High Court was in error in<br \/>\nproceeding under the assumption that the protection given to<br \/>\nsome of the parties in Mohan Lal&#8217;s case (supra) applied to<br \/>\nthe facts of the present case.\n<\/p>\n<p>As was observed in Gagan Kumar&#8217;s case (supra) the<br \/>\nobservations in paragraph 11 of Mohan Lal&#8217;s case (supra)<br \/>\nwere rendered in a different factual background and context<br \/>\nand have no application to the facts of the present case.<br \/>\nAppeal is allowed with no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India D.G, Doordarshan Mandi House, New &#8230; vs Manas Dey &amp; Ors on 17 November, 2005 Author: A Pasayat Bench: Arijit Pasayat, R.V.
