SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 04\/10\/2011 \nORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nway of this Intra-Court Letters Patent Appeal, the appellant &#8211;<br \/>\noriginal petitioner has challenged the judgment and order dated<br \/>\n20.09.2002 passed by the Learned Single Judge in Special Civil<br \/>\nApplication No.9813 of 2000 whereby the Learned Single Judge has<br \/>\ndismissed the writ petition filed by the appellant.\n<\/p>\n<p>2.\t\tHeard<br \/>\nlearned counsel Mr. Panchal for the appellant.\n<\/p>\n<p>3.\t\tThe<br \/>\nfacts of the case are that on 23.08.1973, the State Government issued<br \/>\na Resolution whereby certain teachers working in Ashram Shalas in the<br \/>\nDistricts where District Education Committees existed, were given a<br \/>\nright to be absorbed as teachers under the District Panchayats.<br \/>\nSubsequently, the State Government issued another Government<br \/>\nResolution dated 22.12.1999 whereby the rights conferred by G.R.<br \/>\nDated 23.08.1973 were revoked.  The appellant submitted an<br \/>\napplication for being absorbed as teacher on 23.12.1999, i.e. on the<br \/>\nday after the right of absorption was revoked by the G.R. Dated<br \/>\n22.12.1999.\n<\/p>\n<p>4.\t\tWhile<br \/>\ndismissing the writ petition filed by the appellant, the Learned<br \/>\nSingle Judge has given specific findings in paragraphs 4 &amp; 5 of<br \/>\nthe impugned judgment and order.  We are in agreement with the view<br \/>\ntaken by the Learned<br \/>\nSingle Judge.
