CIVIL WRIT PETITION NO. 8656\/2009.\n              Hari Singh Vs. State of Rajasthan &amp; Ors.\n\n\nDate of Order :: 11th September 2009.\n\n\n      HON'BLE MR. JUSTICE DINESH MAHESHWARI\n\nMr.Vijay Agarwal, for the petitioner.\n                                ....\n\nBY THE COURT:<\/pre>\n<p>      This writ petition, filed way back on 17.08.2005,<\/p>\n<p>remained lying on the defects side; and the defects were<\/p>\n<p>removed only after passing of the peremptory order dated<\/p>\n<p>04.03.2009. The petition has, thus, come up for admission<\/p>\n<p>after four years.\n<\/p>\n<p>      The counsel for the petitioner submits that there had<\/p>\n<p>been subsequent events after filing of the petition and the<\/p>\n<p>matter may be adjourned so as to enable the petitioner to<\/p>\n<p>bring the subsequent events on record. There appears<\/p>\n<p>absolutely no justification that the petitioner has kept this writ<\/p>\n<p>petition   pending on the defects side for over four years and<\/p>\n<p>when the matter is placed for admission, an adjournment is<\/p>\n<p>sought for bringing on record the so-called subsequent events.<\/p>\n<p>Prayer for adjournment is declined.\n<\/p>\n<p>      It has been submitted in this writ petition that the<\/p>\n<p>petitioner was granted permission for the facility to pour the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>brackish water of the tube-well in the canal and to be allowed<\/p>\n<p>equal water of canal in exchange and for the purpose of<\/p>\n<p>irrigation of his agriculture land.   However, an order was<\/p>\n<p>passed for stoppage of such facilities on 17.06.2000; and<\/p>\n<p>thereafter, demand was raised against the petitioner by the<\/p>\n<p>Department that came to be challenged and ultimately this<\/p>\n<p>Court allowed the writ petition on 21.05.2003 quashing the<\/p>\n<p>demand and directing the Executive Engineer to decide the<\/p>\n<p>matter afresh.\n<\/p>\n<p>      An order dated 21.06.2004 (Annex.10) as passed by<\/p>\n<p>the Executive Engineer has been placed on record whereby<\/p>\n<p>the Executive Engineer ordered that stoppage of supply of<\/p>\n<p>water due to earlier demand was not proper as the same had<\/p>\n<p>been quashed by the High Court; and further directions were<\/p>\n<p>made for recalculating the amount recoverable. It is submitted<\/p>\n<p>that even the recalculation as made has since been quashed<\/p>\n<p>by the SDO concerned.      It is, however, submitted that the<\/p>\n<p>directions for supply of water and regarding abolition of lock<\/p>\n<p>system have not been complied with.\n<\/p>\n<p>      The said order by the Executive Engineer was passed<\/p>\n<p>way back on 21.06.2004 and therein too, the Executive<\/p>\n<p>Engineer observed, while directing that the lock system be<\/p>\n<p>abolished and temporarily the water supply be allowed, that if<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>     for any reason, any policy decision would be taken by the<\/p>\n<p>     Government or higher officials and any new orders would be<\/p>\n<p>     passed, water supply could be modified or stopped.<\/p>\n<p>            This Court finds no reason or justification that any<\/p>\n<p>     further directions be made in relation to the position that has<\/p>\n<p>     continued for over five years since after passing of the said<\/p>\n<p>     order by the Executive Engineer on 21.06.2004.<\/p>\n<p>           After this much of dictation, the learned counsel for the<\/p>\n<p>     petitioner submits that the petitioner   may be permitted to<\/p>\n<p>     withdraw the petition so as to move a proper representation.<\/p>\n<p>           Having regard to the circumstances, the petitioner is<\/p>\n<p>     permitted to withdraw; and the writ petition is dismissed as<\/p>\n<p>     withdrawn.\n<\/p>\n<p>           The counsel submits that the petitioner may be granted<\/p>\n<p>     liberty to make representation.
