    2.            The      Civil        Revision             application              takes<\/p>\n
    exception      to    the    order     dated        3rd    December,        2001      by<\/p>\n
    Civil     Judge       Senior       Division,             Amalner,       in        Misc.\n<\/p>\n
    Application No. 3 of 1999.\n<\/p>\n
    3.            The     Civil     Revision           applicant        herein        fled<\/p>\n
    Misc. Application No. 3 of 1999 before Civil Judge<\/p>\n
    Senior Division, Amalner, under Order 9Rule 13 of the<\/p>\n
    Civil    Procedure    ig   Code.     The       respondent         herein          filed<\/p>\n
    Civil Suit NO. 2 of 1997 against the applicant for<\/p>\n
    recovery      of    Rs.    30,983\/-       (Rs.      Thirty       thousand          nine<\/p>\n
    hundred eight three). The applicant herein appeared in<\/p>\n
    the suit but could not file Written Statement. When<\/p>\n
    the    case    was    fixed     for       final      hearing,        applicant’s<\/p>\n
    Counsel was absent, as he has to appear before the<\/p>\n
    Court of Civil Judge Junior Division, Chopada. It is<\/p>\n
    further case of the applicant that the letter issued<\/p>\n
    by his Advocate, could not received by him in due<\/p>\n
    course, because the applicant was performing his duty<\/p>\n
    at    some    other    village.       As       a   result,       the     suit       was<\/p>\n
    decided       exparte      on      18th       December,        1998.         As     the<\/p>\n
    applicant could not appeared in Special Civil Suit No.<\/p>\n
    2 of 1997, the suit was decided exparte. Therefore,<\/p>\n
    Misc. Application was filed by the applicant herein<\/p>\n

    for setting aside the exparte decree.\n<\/p>\n
    4.          The      respondent        herein       who       is      original<\/p>\n
    opponent    had   no    objection      to   restore            the     Special<\/p>\n
    Civil Suit No. 2 of 1997.\n<\/p>\n
    5.            The learned Judge has recorded the evidence<\/p>\n
    of the applicant. In support of his case, applicant<\/p>\n
    examined    himself,
\n                       ig     his    evidence       was       recorded         below<\/p>\n
    (Exh. 22). In the said statement he stated that he had<\/p>\n
    not filed any Written Statement in the suit. The suit<\/p>\n
    was   fixed   for      final    hearing,     he       was      residing         at<\/p>\n
    Chopada. The Counsel appearing on behalf of applicant<\/p>\n
    told him that he will informed the applicant, whenever<\/p>\n
    required. The applicant was transferred to Bhusawal,<\/p>\n
    and therefore, he could not appear before the court.\n<\/p>\n
    Hence, the suit was decided against him exparte on 18th<\/p>\n
    December, 1999. Therefore, he prayed that                       suit may be<\/p>\n
    restored to its original file.\n<\/p>\n
    6.             The     learned      Judge       after         hearing          the<\/p>\n
    applicant      and      original        opponent           rejected            the<\/p>\n
    application for setting aside exparte decree. Hence,<\/p>\n
    this Civil Revision Application.\n<\/p>\n

    7.               The    learned       Counsel          for    the      applicant<\/p>\n
    submitted that inspite of express consent given by the<\/p>\n
    respondent    to       set    aside    the    exparte          decree,         Trial<\/p>\n
    Court    exceeded       its    jurisdiction            vested       in     its     by<\/p>\n
    refusing to setting aside the exparte decree. It is<\/p>\n
    further submitted that Trial Court acted illegally and<\/p>\n
    with     material       irregularity          in        exercise          of      its<\/p>\n
    jurisdiction, in that the provisions of Order VI Rule<\/p>\n
    12(2) (a) had no bearing in facts of the present case.\n<\/p>\n
    The     findings       are     capricious          and        arbitrary           and<\/p>\n
    perverse.    If     the      impugned      order       allowed       to     stand,<\/p>\n
    could    occasioned         grave    mis-carriage            of    justice        and<\/p>\n
    would    cause     undue      hardship       to     the      applicant.           The<\/p>\n
    learned    Counsel          also    invited       my    attention          to     the<\/p>\n
    grounds    taken       in    the    application,             and    also       other<\/p>\n
    documents placed on record.\n<\/p>\n
    8.          The learned Counsel appearing for respondent,<\/p>\n
    vehemently opposed the application and submitted that<\/p>\n
    in view of Order 43 Rule 1 (d) of Civil Procedure<\/p>\n
    Code, the present Civil Revision Application is not<\/p>\n
    maintainable.\n<\/p>\n

    9.              I have carefully perused the Civil Revision<\/p>\n
    Application, along with its annexures, and also the<\/p>\n
    provisions of the Civil Procedure Code. It is not in<\/p>\n
    dispute that the application filed by the applicant<\/p>\n
    under Order IX Rule 13 of the Civil Procedure Code.\n<\/p>\n
    The Trial Court in para NO. 5 has considered                                   the<\/p>\n
    application of the applicant and taking recourse to<\/p>\n
    order VI Rule 14(a) (2) of the Civil Procedure Code<\/p>\n
    held that it was the duty of the applicant to file<\/p>\n
    fresh memo of address, as it required under Order VI<\/p>\n
    Rule 14(a) (2) of the Civil Procedure Code. Therefore,<\/p>\n
    in    absence    of   such   steps,       it    is    not       possible        to<\/p>\n
    entertain application and further observed that there<\/p>\n
    is mistake on the part of the applicant, because of<\/p>\n
    which he could not appeared before the Court and which<\/p>\n
    is not reasonable excuse to condone such a conduct.\n<\/p>\n
    10.              Without     entering       into          the    aspect         of<\/p>\n
    maintainability       of     Civil       Revision         Application,            I<\/p>\n
    propose to dispose of the application on its merits<\/p>\n
    itself. Since the Rule is issued on the Civil Revision<\/p>\n
    Application, by this Court in 2001, now telling the<\/p>\n
    applicant   to     file    some    other       proceedings,         after       10<\/p>\n
    years   would     cause    great     hardship        to    the    applicant.\n<\/p>\n

    That   apart       the   assignment        of      hearing           the     Civil<\/p>\n
    Revision   Application         and    also    Appeal         From     Order       is<\/p>\n
    with this Court, and therefore, it is desirable to<\/p>\n
    decide the matter on its own merits.\n<\/p>\n
               “[Rule 14A. Address for Service of notice :-<\/p>\n
                 (1)    Every pleading, when filed by a party,<\/p>\n
                 shall be accompanied by a statement in the<\/p>\n
                 prescribed form, signed as provided in rule<\/p>\n
                 14, regarding the address of the pary.\n<\/p><\/blockquote>\n
                 (2)    such address may, from time to time, be<\/p>\n
                 changed     by    lodging       in    Court       a     form      duly<\/p>\n
                 filled up and stating a new address of the<\/p>\n
                 party       and    accompanied             by       a      verified<\/p>\n
                 petition.”\n<\/p><\/blockquote>\n
\n<\/blockquote>\n
    11.            The perusal of Sub Rule 2 of Rule 14(a)<\/p>\n
    would make it clear that every pleadings, when filed<\/p>\n
    by a party, shall be accompanied by a statement in the<\/p>\n
    prescribed     form,      signed      as     provided         in      Rule       14,<\/p>\n
    regarding address of the party.                   Sub Rule (2) further<\/p>\n
    provided that such address may, from time to time, be<\/p>\n
    changed by lodging in Court a from duly filled up and<\/p>\n
    stating the new address              of the party and accompanied<\/p>\n

    by a verified petition. The Sub Rule (3) provides that<\/p>\n
    address furnished in the statement made under sub-rule<\/p>\n
    (1) shall be called as “registered address” of the<\/p>\n
    party, and shall, until duly changed as aforesaid, be<\/p>\n
    deemed to be the address of the party for the purpose<\/p>\n
    of service of all processes in the suit, and shall<\/p>\n
    hold good as aforesaid, for a period of two years<\/p>\n
    after the final determination of the cause or matter.\n<\/p>\n
                     A careful reading of Rule 14(a) would clearly<\/p>\n
    spell out that it is for the party to furnish the new<\/p>\n
    address if any by lodging in Court a form duly filled<\/p>\n
    up and stating therein new address of the party.\n<\/p>\n
    12.              Therefore, the provisions are very clear and<\/p>\n
    there is no any scope to infer that the applicant was<\/p>\n
    not obliged to give his changed address to the Court,<\/p>\n
    either himself or though his pleader, in the manner<\/p>\n
    stated      in    sub   rule   2   of       Rule   14(a)       of    Order       VI.\n<\/p>\n
    Therefore, the Trial Court has rightly addressed the<\/p>\n
    issue and concluded that it was for the applicant to<\/p>\n
    furnish such address. Therefore, there is no substance<\/p>\n
    in    the   Civil       Revision   Application.            That      apart        the<\/p>\n
    decree passed by the Court below was money decree and<\/p>\n

    interference in such decree, unless very strong case<\/p>\n
    is made out        would be frustrating the claim of the<\/p>\n
    opponents.\n<\/p>\n
    13.        Therefore, taking over all view of the matter<\/p>\n
    and taking into consideration scope of the revision,<\/p>\n
    no case is made out for interference. Hence, Civil<\/p>\n
    Revision         Application     stands       dismissed.               Rule<\/p>\n
    discharged.\n<\/p>\n
               Original record if any be sent back to the<\/p>\n
    concerned Court.\n<\/p>\n
               In      view   of   the   dismissal       of     the      Civil<\/p>\n
    Revision Application, Civil Application, if any stands<\/p>\n
    disposed of accordingly.\n<\/p>\n
