In all 12<br \/>\npersons came to be selected  for promotion to the post of Jailors<br \/>\nGroup-II.  Out of the 12 selectees, 7 persons were promoted<br \/>\nimmediately. Out of the remaining  5 persons,  4 persons  including<br \/>\nthe petitioner filed Special Civil Application  No. 234 of 1987  to<br \/>\nquash and set aside the appointments  of direct recruits to the post<br \/>\nof Jailor., Grade II since there was excess on that count.\n<\/p>\n<p>3.\t\tOut<br \/>\nof the four petitioners in the aforesaid petition, the petitioner was<br \/>\nat the top of the select list.  The petitioner came to be promoted<br \/>\nto the post of  Jailor, Group II by the order dated 4th<br \/>\nMarch 1986 passed by the respondent No.2, in a leave vacancy. The<br \/>\npetitioner  worked on that post from 4th March 1986 to 2nd<br \/>\nJuly 1986 when he came to be reverted  for want of vacancy.\n<\/p>\n<p>4.\t\tOn<br \/>\n19th December 1986 Mr K.D Baria one of the petitioners<br \/>\nwho was junior to the petitioner  was promoted in the leave vacancy<br \/>\nto the post of  Jailor  Group II,  and in that order it was made<br \/>\nclear  that the seniority  of the petitioner  would not be affected.<br \/>\nThe petitioner made an application enquiring about his promotion but<br \/>\nwas informed by Section Officer, Home Department that since the<br \/>\npetitioner  did not fulfill  the requisite  physical fitness, he was<br \/>\nnot selected for the post of  Jailor Group II , and therefore his<br \/>\nrequest for promotion  could not be granted.\n<\/p>\n<p>5.\t\tThe<br \/>\npetitioner filed Civil Application No. 12 of 1991 in Special Civil<br \/>\nApplication No. 12 of 1991  in Special Civil Application  NO. 234 of<br \/>\n1987 claiming promotion which came to be withdrawn  with a view to<br \/>\nfile substantive petition.  In the meanwhile  the petitioner was<br \/>\npromoted to the post of Jailor, Group II along with other employees.\n<\/p>\n<p>6.<br \/>\nAs far as the  petitioner  was concerned,  a complaint  was received<br \/>\nregarding his eligibility  and therefore he was physically<br \/>\nre-examined by the Civil Surgeon on 27th May 1987 and at<br \/>\nthat time he was found  short of physical  standards prescribed under<br \/>\nthe Rules, as his chest measurement  was 81 to 84 cm.  Hence this<br \/>\npetition.\n<\/p>\n<p>6.\t\tLearned<br \/>\nadvocate for the petitioner has contended that the petitioner was<br \/>\nonce selected by the competent authority   and  cannot be denied<br \/>\npromotion  on the ground  that subsequently he was found to be short<br \/>\nof physical standards.  It was stated that at the time of interview<br \/>\nthe departmental  selection committee  found the petitioner fit.  The<br \/>\npetitioner was re-examined  by one Civil Surgeon   in the presence<br \/>\nof Deputy Secretary on 27th May  1987  and was found<br \/>\nshort of physical  standard.  It is submitted that there is no<br \/>\nprovision  of law authorising  any person to re-examine a candidate<br \/>\nalready selected and that too by any persons or two  persons  and<br \/>\nafter a long lapse of time.\n<\/p>\n<p>7.\t\tAffidavit<br \/>\nin reply has been filed by the respondent. In paras 6,7 and 8 and 9<br \/>\nit is held as under :\n<\/p>\n<p>   6.\tI<br \/>\nrespectfully say that  12 persons  were selected  for the post of<br \/>\nJailor  Group- 2 out of which  7 persons  who were  appointed  to the<br \/>\nvacant posts  of Jailor Group-2 for a probation period of two years<br \/>\nwith a condition  to undergo such training  as may be prescribed  by<br \/>\nthe Government  and pass necessary post training examination.\n<\/p>\n<p>7.\tI<br \/>\nrespectfully  say that petitioner came to be selected to the post  of<br \/>\nJailor group   2 vide dated  4th March 1986 in leave<br \/>\nvacancy  wherein it was clarified  that said appointment was for<br \/>\ntemporary  and on  adhoc basis and the petitioner would without  any<br \/>\nprior notice be reverted back to his original post.\n<\/p>\n<p>8.\tI<br \/>\nrespectfully say that some allegations were made to the State<br \/>\nGovernment  against the petitioner&#8217;s inclusion in the select list.<br \/>\nThe State Government, therefore  directed for re-examination  of the<br \/>\npetitioner for his  eligibility  for selection  to the post of Jailor<br \/>\n Group-2. I further  respectfully  say that the  petitioner was<br \/>\nre-examined  by the Civil Surgeon  in presence of Deputy Secretary to<br \/>\nthe Government of Gujarat, Home Department on 27th May<br \/>\n1987 and on such examination the petitioner was found to be short of<br \/>\nthe physical standard prescribed under the statutory rules. \tIt was<br \/>\nfound that  that the petitioner&#8217;s chest measurement  was 81-84 cms<br \/>\nrespectively.  I respectfully  say that an  inquiry was also<br \/>\ninitiated at the relevant  point of time  against the petitioner&#8217;s<br \/>\ninclusion in the selection list.\n<\/p>\n<p>9.\tI<br \/>\nrespectfully say that selection of the petitioner under the select<br \/>\nlist    I\t  was based  on  some illegality  and\/ or irregularity<br \/>\ncommitted  at that relevant point of time  pursuing  to which by<br \/>\nmistake  the petitioner came  to be selected in the selection list. I<br \/>\nrespectfully  say that appointment of  the petitioner was totally on<br \/>\na temporary  ad-hoc basis on leave vacancy. Merely because the<br \/>\npetitioner&#8217;s name was appearing in the selection list the same would<br \/>\nnot  create any right in the favour of the petitioner to be continued<br \/>\n in the said cadre.  I respectfully  say that due to oversight  on<br \/>\npart of the Department Selection Committee   his name was cleared for<br \/>\nthe select list.\n<\/p>\n<p>7.<br \/>\nOver and above  the order passed by this Court on 8th<br \/>\nSeptember 2000, during the intervening period the petitioner was<br \/>\nplaced under suspension and he had preferred   Civil Suit<br \/>\nchallenging  the order of suspension. But in my view, this part  of<br \/>\nthe submission  being irrelevant  does not  require consideration.\n<\/p>\n<p>8.\t\tAs<br \/>\na result of hearing and perusal of the record, I am of the opinion<br \/>\nthat the  petitioner&#8217;s chest measurement  was 81-84 cms respectively<br \/>\nand  hence he does not have the criteria required for the promotion.<br \/>\nApart from that the appointment of  the petitioner was totally on a<br \/>\ntemporary  ad-hoc basis on leave vacancy. Merely because the<br \/>\npetitioner&#8217;s name was appearing in the selection list the same would<br \/>\nnot  create any right in the favour of the petitioner to be continued<br \/>\n in the said cadre.\n<\/p>\n<p>9.\t\tLooking<br \/>\nat the facts and circumstances of the case this petition deserves to<br \/>\nbe rejected.   Accordingly this petition is dismissed. Rule is<br \/>\ndischarged with no order as to costs.
