No.21651\/2010-F, 21652\/2010-F &amp;\n                        21655\/2010-F\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n           Dated this the 11th day of August, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    This writ petitions are concerned with the restriction<\/p>\n<p>made by the Excise Commission with regard to the operation<\/p>\n<p>of toddy transport permits by directing the petitioners to<\/p>\n<p>delete one of the two vehicle numbers from the transport<\/p>\n<p>permit.\n<\/p>\n<p>    2.   This Court had passed an interim order in these<\/p>\n<p>matters and a batch of cases, namely, W.P(C).Nos.15513,<\/p>\n<p>15704, 15705, 15723 and 16038\/2010 were disposed of in the<\/p>\n<p>light of the subsequent developments.  Paragraph (2) of the<\/p>\n<p>said Judgment is extracted below:-\n<\/p>\n<blockquote><p>              &#8220;Today  when  the  matter  came  up   for<\/p>\n<p>          hearing,  the   learned  Government   Pleader<\/p>\n<p>          submitted  that  the  restriction  introduced<\/p>\n<p>          which has led to the filing of the writ<\/p>\n<p>          petitions  stands  withdrawn  as  per   Order<\/p>\n<p>          No.XA2.14439\/01 dated 22\/07\/2010.  A reading<\/p>\n<p>          of the order shows that the order dated<\/p>\n<p>          01\/07\/2010 of the Excise Commissioner has<\/p>\n<p>          been  modified  and   directions  have  been<\/p>\n<p>          issued to mention registration numbers of<\/p>\n<p>          two vehicles in the toddy transport permit,<\/p>\n<p>W.P.(C). Nos.21651\/2010,<br \/>\n21652\/2010 &amp; 21655\/2010<br \/>\n<span class=\"hidden_text\">                               -:2:-<\/span><\/p>\n<p>             subject to certain conditions.  The modified<\/p>\n<p>             orders have been directed to be implemented<\/p>\n<p>             also.&#8221;<\/p><\/blockquote>\n<p>     3.      Since the position is the same in these cases<\/p>\n<p>also, the writ petitions are allowed.     The petitioners will<\/p>\n<p>therefore be governed by the transport permits already<\/p>\n<p>issued and the conditions provided in the order dated<\/p>\n<p>22\/07\/2010.
