Agrawal,J.\n<\/pre>\n<p>Hon&#8217;ble Abhinava Upadhya,J.\n<\/p>\n<p>This special appeal has been filed against the judgment and order<br \/>\ndated 22nd April 2010 passed by the learned single Judge. The State<br \/>\nappellant appears aggrieved with the directions issued by the learned<br \/>\nsingle Judge to examine the claim and in the event any arrangement<br \/>\nof funds are required to be made, to issue necessary instructions<br \/>\nwithin a time bound period.\n<\/p>\n<p>We have heard Sri S.G. Hasnain, learned Additional Advocate General<br \/>\non behalf of the appellant, Sri K.P. Agrawal, learned senior counsel<br \/>\nassisted by Sri D.K. Singh on behalf of the respondent No. 1 and Sri<br \/>\nRavindra Singh on behalf of the remaining respondents and have<br \/>\nperused the judgment and order dated 22.4.2010 passed by the<br \/>\nlearned single Judge.\n<\/p>\n<p>Sri Hasnain, learned counsel submitted that the direction issued to the<br \/>\nPrincipal Secretary of the department arrayed as respondent No. 1 in<br \/>\nthe writ petition to examine the claim of the petitioner and in the event<br \/>\nany arrangement of funds are required to be made to issue necessary<br \/>\ninstructions within a time bound period has been passed without giving<br \/>\nany opportunity to file counter affidavit to the State respondents in the<br \/>\nwrit petition and, therefore, the said order is liable to be set-aside on<br \/>\nthis ground alone. He further submitted that in any event, the State is<br \/>\nnot responsible to make any payment of the retiral benefits to the<br \/>\npetitioners therein as there is no relationship of master and servant.<br \/>\nSri K.P. Agrawal, learned senior counsel submitted that no mandamus<br \/>\nhas been issued against the State respondent No. 1 herein for making<br \/>\npayment to the petitioners for their retiral dues and the State has only<br \/>\nbeen asked to examine the claim and issue necessary<br \/>\ninstructions\/directions, which does not affect the State and it can not<br \/>\nbe said to be a person aggrieved by the said order. According to him,<br \/>\nthe service condition of the petitioner is governed by the U.P. Cane<br \/>\nCooperative Service Regulations, 1975, which is a statutory regulation<br \/>\nand the state exercises supervisory powers and control over the<br \/>\nsociety under various statutes and, therefore, the learned single Judge<br \/>\nhas rightly asked the respondent No. 1 to examine the claim and to<br \/>\nissue necessary instructions\/directions.\n<\/p>\n<p>We have given our thoughtful consideration to the various pleas raised<br \/>\nby the learned counsel for the parties and are in full agreement with<br \/>\nthe submission made by Sri K.P. Agrawal that no mandamus has been<br \/>\nissued to the respondent No. 1 for making payment of the retiral dues.<br \/>\nHe has only been asked to look into the claim of the petitioner and<br \/>\nissue necessary directions\/instructions to the authority concerned.<br \/>\nIn this view of the matter, we are of the considered opinion that the<br \/>\n Sate can not be said to be a person aggrieved by the said order.<br \/>\nThe appeal fails and is dismissed.\n<\/p>\n<p>Order Date :- 26.7.2010<br \/>\nAM\/-\n<\/p>\n<p>Hon&#8217;ble R.K.
