Heard learned counsel for the appellant and\n\n                     learned counsel for the State.\n\n<\/pre>\n<p>                                2. The appellant has been convicted for offence<\/p>\n<p>                     under Section 376, 313 and 304 I.P.C. and sentenced to<\/p>\n<p>                     undergo imprisonment for seven years for offence under<\/p>\n<p>                     Section 376 I.P.C., five years for offence under Section<\/p>\n<p>                     313 I.P.C. and six years for offence under Section 304<\/p>\n<p>                     Part II of I.P.C.\n<\/p>\n<p>                                3. The prosecution case as alleged in the written<br \/>\n<span class=\"hidden_text\">               2<\/span><\/p>\n<p>report signed by the victim Pulbati Kumari that she used<\/p>\n<p>to live with her father Rup Lal Ganesh (P.W.2) and<\/p>\n<p>brothers Deo Narayan Ganesh (P.W.1) and Yogi Lal<\/p>\n<p>Ganesh (P.W.3) at village- Biranguri, P.S. Thakurganj,<\/p>\n<p>District- Kishanganj. The appellant Raisuddin used to<\/p>\n<p>come to her house to meet her brother. It is further<\/p>\n<p>alleged that Raisuddin raped her by enticing her. When<\/p>\n<p>she became pregnant she disclosed about pregnancy and<\/p>\n<p>then Raisuddin took her across the river Mechi and get<\/p>\n<p>Jaributi pushed in her vagina through a lady about 9-10<\/p>\n<p>days prior to filing of the written report. When the blood<\/p>\n<p>start oozing out the victim became seriously ill then she<\/p>\n<p>disclosed about the occurrence to her brother Deo<\/p>\n<p>Narayan Ganesh and father.\n<\/p>\n<p>         4. On the written report dated 25. 09. 1995,<\/p>\n<p>F.I.R. was lodged and investigation proceeded. After<\/p>\n<p>investigation charge sheet submitted under Sections 376,<\/p>\n<p>313 and 304 I.P.C. and trial proceeded. During trial,<\/p>\n<p>seven witnesses were examined. Witnesses P.W. 1 and 3<\/p>\n<p>are brothers of the victim who deposed that they got<\/p>\n<p>information through letters from their father P.W.2, Rup<\/p>\n<p>Lal Ganesh that Pulbati Kumari died in Purnea hospital<br \/>\n<span class=\"hidden_text\">               3<\/span><\/p>\n<p>when they were in Punjab and Harayana, so they have<\/p>\n<p>been declared hostile. P.W. 2, father of the victim also<\/p>\n<p>stated that Pulbati Kumari died and he had not heard<\/p>\n<p>about rape. P.W. 4 has been tendered. P.W. 5 is the<\/p>\n<p>Police Officer has proved the signature of Pulbati<\/p>\n<p>Kumari on the written report which has been marked as<\/p>\n<p>Ext. 2. He has also proved Ext. 3, the F.I.R. lodged on<\/p>\n<p>the basis of said written report (Ext. 2). However, in his<\/p>\n<p>cross-examination has stated that the victim when came<\/p>\n<p>to the police station was very weak and was taken to<\/p>\n<p>police station with the assistance of her father and<\/p>\n<p>brothers. She died on 30. 10. 1995. P.W. 5 stated in his<\/p>\n<p>evidence that he did not know through whom the said<\/p>\n<p>written report was got written.\n<\/p>\n<p>         5. P.W.4 is the doctor who conducted autopsy<\/p>\n<p>on her person has stated that cause of death of the victim<\/p>\n<p>septic peritomisis and metritis and such infection can be<\/p>\n<p>possible by putting indigenous medicine like Jaributi<\/p>\n<p>through the vagina. P.W. 6 has stated that he did not<\/p>\n<p>know how she died. P. W. 7 is the I.O. who has only<\/p>\n<p>submitted the charge sheet.\n<\/p>\n<p>         6. The trial court taking into consideration the<br \/>\n<span class=\"hidden_text\">               4<\/span><\/p>\n<p>evidence of P.W. 5 who has proved the signature of<\/p>\n<p>Prosecutrix on the written report which has been marked<\/p>\n<p>as Ext. 2. The trial court and further taking into<\/p>\n<p>consideration the evidence of P.W. 5 that Prosecutrix<\/p>\n<p>died in course of investigation in proximity with F.I.R.<\/p>\n<p>lodged on the written report. The trial court treated the<\/p>\n<p>written report in evidence as dying declaration under<\/p>\n<p>Section 32 of the Evidence Act. The trial court further<\/p>\n<p>drawn analogy of the admission of the written report as<\/p>\n<p>dying declaration on the decision reported in 1991 (2)<\/p>\n<p>BLJ 245, where their lordships held that F.I.R. and<\/p>\n<p>Fardbeyan could be read in evidence under Section 294<\/p>\n<p>of Cr.P.C. even if the signature has not been proved by<\/p>\n<p>the prosecution, when genuineness of the signature is not<\/p>\n<p>doubted or challenged. The trial court that is the Learned<\/p>\n<p>Additional Sessions Judge further relying upon decision<\/p>\n<p>reported in A.I.R. 1984 S.C. 1622 drawn an analogy that<\/p>\n<p>Prosecutrix will not tell a lie on the verge of her death.<\/p>\n<p>The trial court taking into consideration the written<\/p>\n<p>report as dying declaration and convicted the appellant<\/p>\n<p>taking the written report as substantive evidence as what<\/p>\n<p>is written in the written report is true and    hold that<br \/>\n<span class=\"hidden_text\">                5<\/span><\/p>\n<p>Raisuddin has indulged in rape and was instrumental in<\/p>\n<p>miscarriage of the pregnancy and causing death of victim<\/p>\n<p>Pulbati Kumari by septic due to inducing Jaributi in her<\/p>\n<p>vagina.\n<\/p>\n<p>          7. Learned counsel for the appellant however<\/p>\n<p>contended that written report cannot be treated as dying<\/p>\n<p>declaration.\n<\/p>\n<p>          8. Learned counsel for the State however<\/p>\n<p>supported the order of conviction and sentence.<\/p>\n<p>          9. The question for consideration whether<\/p>\n<p>conviction can be sustainable treating the written report<\/p>\n<p>as dying declaration.\n<\/p>\n<p>          10. Section 32 of the Evidence Act provided<\/p>\n<p>that statement, written or verbal, made by a person who<\/p>\n<p>is dead with regard to his cause of death is a relevant fact<\/p>\n<p>which is admissible in evidence. Hence the statement of<\/p>\n<p>a person either oral or written who is dead with regard to<\/p>\n<p>his cause of death is dying declaration. However this<\/p>\n<p>statement either oral or written, to be treated as dying<\/p>\n<p>declaration is required to be proved. It has to be proved<\/p>\n<p>that the statement, oral or written actually made by the<\/p>\n<p>deceased. The statement may be oral or verbal or the<br \/>\n<span class=\"hidden_text\">              6<\/span><\/p>\n<p>statement may be written but that statement is the<\/p>\n<p>statement of the deceased is required to be proved. But<\/p>\n<p>mere a rumour that deceased was heard by some one is<\/p>\n<p>not admissible in evidence. If the statement is verbal<\/p>\n<p>then it is required to be proved by the person who heard<\/p>\n<p>it. The person who heard must come in dock to say that<\/p>\n<p>he heard the statement.    If a person who heard the<\/p>\n<p>statement and recorded it then he may refresh his<\/p>\n<p>memory by seeing the record he made. If the person<\/p>\n<p>who is unable to remember what he has heard then he<\/p>\n<p>may prove the record with assurance that he correctly<\/p>\n<p>recorded it and he may testify the recorded statement.<\/p>\n<p>To prove the statement as written statement it must be<\/p>\n<p>proved that statement was in writing of the person who<\/p>\n<p>made the declaration i.e. in writing of the deceased.<\/p>\n<p>However, if the deceased is unable to write and record<\/p>\n<p>was made on her statement then the person who recorded<\/p>\n<p>the said statement must come before the court to say that<\/p>\n<p>he recorded the statement on dictation of the victim and<\/p>\n<p>further he must satisfy that said statement was read over<\/p>\n<p>to the victim and the victim accepted what was written<\/p>\n<p>on her dictation. This written record must be proved by<br \/>\n<span class=\"hidden_text\">              7<\/span><\/p>\n<p>the person who heard it and satisfy the court that same<\/p>\n<p>was read over and explain to the victim which she found<\/p>\n<p>to be correct. However, this proposition of law has been<\/p>\n<p>relied on judgment in Cr. Appeal No. 227 of 1998<\/p>\n<p>decided on 16. 09. 2011.\n<\/p>\n<p>         11. However it is pertinent to mention that mere<\/p>\n<p>formal prove of writing or signature is only prove that<\/p>\n<p>the document has been written by the person but does<\/p>\n<p>not prove the content. However to proof the contents of<\/p>\n<p>the document witness is to be examined on the fact.<\/p>\n<p>         12. However, reverting back to the facts and<\/p>\n<p>circumstance of the case, here P.W. 5 has proved the<\/p>\n<p>signature of the victim Pulbati Kumari on the written<\/p>\n<p>report which has been marked as Ext. 2. He (P.W.5) has<\/p>\n<p>not proved that who wrote the content of the written<\/p>\n<p>report on which the victim signed.     However, he has<\/p>\n<p>stated in cross-examination that the victim when came to<\/p>\n<p>the police station was very weak. She was brought to<\/p>\n<p>police station being supported by her father (P.W.5) and<\/p>\n<p>brothers (P.W. 1 and P.W.3). He do not know from<\/p>\n<p>whom the contents of the written report, on the basis of<\/p>\n<p>which F.I.R. lodged, was got written. Hence from the<br \/>\n<span class=\"hidden_text\">                 8<\/span><\/p>\n<p>evidence it emerges that only signature of the victim on<\/p>\n<p>the written report was proved. Who wrote the contents<\/p>\n<p>of the written report has not been established. There is<\/p>\n<p>no evidence at all that the said statement was recorded<\/p>\n<p>on the statement of the victim. There is no evidence at<\/p>\n<p>all of any person in the entire evidence that the victim<\/p>\n<p>ever stated about the contents in the written report.<\/p>\n<p>Hence the status of the written report is not more than a<\/p>\n<p>rumour and merely because signature of the victim has<\/p>\n<p>been proved on the written report, the content of the<\/p>\n<p>written report will not be admissible in evidence under<\/p>\n<p>Section 32 of the Evidence Act for treating it the dying<\/p>\n<p>declaration because it has neither been proved to be<\/p>\n<p>either an oral statement of the deceased.       The said<\/p>\n<p>content of the written report has neither been proved as<\/p>\n<p>oral or verbal statement made the deceased. No person<\/p>\n<p>has come forward to say that he heard the victim making<\/p>\n<p>that statement and hence not an oral declaration of the<\/p>\n<p>victim.\n<\/p>\n<p>          13.       The said statement is not a written<\/p>\n<p>statement of the victim as the same is neither in the<\/p>\n<p>writing of the victim nor written on her dictation nor has<br \/>\n<span class=\"hidden_text\">                 9<\/span><\/p>\n<p>been proved that the same has been read over and<\/p>\n<p>explain to her nor that she accept it to be true. The record<\/p>\n<p>of unknown person with a signature of victim is not a<\/p>\n<p>written statement even if it is signed by the victim. As it<\/p>\n<p>is the declaration which is admissible but not the record.<\/p>\n<p>To get the status of declaration it must be established<\/p>\n<p>that the said record was recorded correctly at the<\/p>\n<p>dictation of the declarant and was read over and<\/p>\n<p>explained to her and unless the same is done is not<\/p>\n<p>admissible in evidence treat it as a dying declaration.<\/p>\n<p>          14. However, the trial court treated the written<\/p>\n<p>report as dying merely on the pretext that written report<\/p>\n<p>and death of the victim was proximate and draw analogy<\/p>\n<p>on the basis of A.I.R. 1984 S.C. 1622 that Prosecutrix<\/p>\n<p>will not tell a lie.\n<\/p>\n<p>          15. However, it is pertinent to mention that<\/p>\n<p>admissibility or relevancy of the statement oral and<\/p>\n<p>written is one thing, but Section 32 of the Evidence Act<\/p>\n<p>is admissible in Evidence Act as an exception to the<\/p>\n<p>general rule that hearsay evidence has been admitted in<\/p>\n<p>evidence is another thing.     However, before treating a<\/p>\n<p>declaration or statement to be a dying declaration it is<br \/>\n<span class=\"hidden_text\">                10<\/span><\/p>\n<p>required to be proved that the statement is really<\/p>\n<p>statement made by the deceased so that rumour may not<\/p>\n<p>take place of prove.       The considerations of those<\/p>\n<p>materials are required to be relevant i.e. admissible in<\/p>\n<p>evidence. The mode of prove of oral statement is under<\/p>\n<p>Section 60 of Evidence Act and in case of written<\/p>\n<p>statement under section 64 and 67 of the Evidence Act.<\/p>\n<p>         16.    However,    in   decision   reported     in<\/p>\n<p>A.I.R.1984 S.C. 1622 the evidence of the dying<\/p>\n<p>declaration was the letter of the deceased addressed to<\/p>\n<p>her sisters and friends as well as oral statement made by<\/p>\n<p>the deceased to her father, mother, sisters, and friends.<\/p>\n<p>The father, mother, sister and friends deposed in that<\/p>\n<p>case as P.W. 2, 3, 4, 5, 6 and 20. They in their evidence<\/p>\n<p>stated that the deceased disclosed about the occurrence<\/p>\n<p>of ill treatment about subjecting cruelty and demand.<\/p>\n<p>This evidence and statement of the witnesses about<\/p>\n<p>disclosure by victim admissible in evidence to prove as<\/p>\n<p>oral statement of the deceased. Letter in the writing of<\/p>\n<p>the victim was admissible as written statement in the<\/p>\n<p>writing of the victim. Hence the statement of the victim<\/p>\n<p>which was proved by these witnesses by their<br \/>\n<span class=\"hidden_text\">                11<\/span><\/p>\n<p>depositions in court was treated as dying declaration.<\/p>\n<p>         17.    However,    here    in   the   facts     and<\/p>\n<p>circumstances of the case, none has come forward to<\/p>\n<p>depose that the victim ever disclosed about the fact<\/p>\n<p>mentioned in the written report.     Here the father has<\/p>\n<p>turned hostile and has not supported the case that victim<\/p>\n<p>ever disclosed before him about the rape or about the<\/p>\n<p>fact of termination of pregnancy of putting Jaributi<\/p>\n<p>causing death. Neither P.W. 1 and 3 brothers of the<\/p>\n<p>victim have come forward nor P.W. 6 has come forward<\/p>\n<p>to prove that victim ever disclosed them about rape or<\/p>\n<p>termination of pregnancy the cause of death. Hence<\/p>\n<p>analogy drawn on the basis of decision reported in A.I.R.<\/p>\n<p>1984 S.C. has not sustainable regarding admissibility of<\/p>\n<p>the statement to be treated as dying declaration.<\/p>\n<p>         18. The trial court further misconceived drawn<\/p>\n<p>the analogy on the basis of decision reported in 1991 (2)<\/p>\n<p>BLJ 245 that written report admissible in evidence under<\/p>\n<p>Section 294 Cr.P.C. Section 294 Cr.P.C. and decision<\/p>\n<p>reported in 1991 (2) BLJ 245 is only mean to cover those<\/p>\n<p>documents which requires formally proved. To prove<\/p>\n<p>the document formally only mean that document has<br \/>\n<span class=\"hidden_text\">              12<\/span><\/p>\n<p>been written by the person, but the content of the<\/p>\n<p>document is not proved by formally proving the<\/p>\n<p>document. One cannot say that by formally proving the<\/p>\n<p>Fardbeyan in writing of the victim, he has proved the<\/p>\n<p>prosecution case to record the conviction. It can only be<\/p>\n<p>said to be a prove that the said Fardbeyan is in writing of<\/p>\n<p>so and so, but to prove the content made in the<\/p>\n<p>Fardbeyan the author of the Fardbeyan is required to<\/p>\n<p>come to prove the fact else it has only the status of<\/p>\n<p>corroborative evidence. The content of a document<\/p>\n<p>which is not substantive evidence is required to be<\/p>\n<p>proved on deposition by a competent witness and to be<\/p>\n<p>tested by cross-examination can never be tendered in<\/p>\n<p>evidence by formal prove. Hence learned trial court<\/p>\n<p>misconceive itself taking the written report as dying<\/p>\n<p>declaration or formally proving the signature of the<\/p>\n<p>victim Pulbati Kumari on written report marked as Ext.<\/p>\n<p>2.<\/p>\n<p>         19. However, except written report there is no<\/p>\n<p>evidence at all regarding implication of the accused<\/p>\n<p>person to record conviction and written report cannot be<\/p>\n<p>treated as a dying declaration as written report is neither<br \/>\n<span class=\"hidden_text\">                             13<\/span><\/p>\n<p>               oral nor documentary evidence as there is no evidence to<\/p>\n<p>               proof that any statement either written or documentary is<\/p>\n<p>               the statement of the deceased with regard to the cause of<\/p>\n<p>               death.\n<\/p>\n<p>                        20.
