M. SAHAI)<\/p>\n<p>\t\tWe<br \/>\nhave heard Mr. Kishor M. Paul, learned counsel for the appellant and<br \/>\nMr. N. J. Shah, learned Assistant Government Pleader for respondent.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this Intra-Court Letters Patent Appeal, the appellant &#8211;<br \/>\noriginal petitioner has challenged the judgment and order dated<br \/>\n29.06.2004 passed by the Learned Single Judge in Special Civil<br \/>\nApplication No.7355 of 2004 by which the Learned Single Judge has<br \/>\ndismissed the writ petition by holding that the appellant has<br \/>\nalternative efficacious remedy of raising Industrial Dispute.\n<\/p>\n<p>3.\t\tThe<br \/>\nappellant was appointed as peon on 01.09.1986.  He was terminated by<br \/>\norder dated 18.04.1988.  The appellant challenged the said order by<br \/>\nfiling Reference (LCR) No.265 of 1990 before the Labour Court,<br \/>\nRajkot.  The Labour Court vide award dated 10.04.2011 allowed the<br \/>\nreference and granted reinstatement with 100% back wages.  The<br \/>\nrespondent challenged the said order by preferring writ petition<br \/>\nbeing Special Civil Application No.8912 of 2001.  The Learned Single<br \/>\nJudge disposed of the writ petition on 16.01.2003 with a direction to<br \/>\nthe respondent to deposit Rs.7,500\/- and the matter was remanded back<br \/>\nto the Labour Court, Rajkot.\n<\/p>\n<p>3.1\t\tThereafter,<br \/>\nthe Labour Court passed award dated 15.12.2003 and held that the<br \/>\nappellant is entitled for reinstatement with continuity of service<br \/>\nand 50% back wages.  In pursuance of the said award, the appellant<br \/>\nwas reinstated on 04.05.2004.  On 01.06.2004, the respondent issued<br \/>\ncheque of Rs.37,700\/- in favour of appellant towards back wages.<br \/>\nThereafter, the services of the appellant were terminated vide order<br \/>\ndated 09.06.2004.  The appellant challenged the said termination<br \/>\norder by preferring Special Civil Application No.7355 of 2004.  The<br \/>\nLearned Single Judge vide impugned judgment and order dated<br \/>\n29.06.2004 dismissed the said writ petition.\n<\/p>\n<p>4.\t\tLearned<br \/>\ncounsel for the appellant has placed reliance on the decision of the<br \/>\nHon&#8217;ble Supreme Court in the case of <a href=\"\/doc\/1885496\/\">Whirlpool Corporation v.<br \/>\nRegistrar of Trade Marks, Mumbai and others<\/a>, (1998) 8 SCC 1 and<br \/>\nhas urged that alternative remedy is not a constitutional bar to High<br \/>\nCourt&#8217;s jurisdiction but is a self-imposed restriction.\n<\/p>\n<p>\t\tIt<br \/>\nis no doubt true that alternative remedy is no bar, but where there<br \/>\nare disputed questions of fact involved, in such a situation, the<br \/>\nfinding of fact cannot be recorded by the High Court and it has to be<br \/>\nrecorded by some other Court or Tribunal.\n<\/p>\n<p>4.1.\t\tLearned<br \/>\ncounsel for the appellant has further placed reliance on another<br \/>\ndecision of the Apex Court in the case of Harbanslal Sahnia and<br \/>\nanother v. Indian Oil Corporation Limited and others, (2003) 2 SCC<br \/>\n107 and on the strength of this judgment, he urged that where the<br \/>\nquestion of bread and butter of the workman is involved, in such<br \/>\ncases, alternative remedy would not be a bar.\n<\/p>\n<p>\t\tWe<br \/>\nhave carefully gone through this judgment.  It does not lay down the<br \/>\nproposition that in such cases, the Court should itself record a<br \/>\nfinding of fact after considering the entire evidence and take<br \/>\nstatement of witnesses etc.  The proposition laid down by the Apex<br \/>\nCourt is not disputed, but the principles are not applicable to the<br \/>\nfacts of the instant case.\n<\/p>\n<p>4.2.\t\tLearned<br \/>\ncounsel for the appellant has further placed reliance on the decision<br \/>\nof the Apex Court in the case of <a href=\"\/doc\/1728255\/\">Shri Anadi Mukta Sadguru Shree<br \/>\nMuktajee Vandasjiswami Suvarna Jayanti Mahotsav Smarak Trust and<br \/>\nothers v. V. R. Rudani and others<\/a>, AIR 1989 SC 1607 wherein the<br \/>\nApex Court in paragraph 21 has held that mandamus is a very wide<br \/>\nremedy which must be easily available to reach injustice wherever it<br \/>\nis found.\n<\/p>\n<p>\t\tThis<br \/>\ndecision also does not lay down the proposition that alternative<br \/>\nremedy is to be surpassed and finding of fact should be recorded by<br \/>\nHigh Court under Article 226 of the Constitution of India.\n<\/p>\n<p>5.\t\tWe<br \/>\nhave gone through the impugned order of the Learned Single Judge. The<br \/>\nLearned Single Judge has specifically observed that there are large<br \/>\nnumber of disputed questions of fact involved in the petition and<br \/>\ntherefore the writ petition would not be a proper remedy.  Hence,<br \/>\nwhile holding that the appellant has alternative efficacious remedy<br \/>\nof raising Industrial Dispute, the Learned Single Judge has dismissed<br \/>\nthe writ petition.  It is no doubt true that alternative remedy is no<br \/>\nbar, but where there are disputed questions of fact involved, in such<br \/>\na situation, the finding of fact cannot be recorded by the High Court<br \/>\nand it has to be recorded by some other Court or Tribunal.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe aforesaid reasons, we do not find any illegality in the impugned<br \/>\njudgment of the Learned Single Judge.
