to A-5) were quarreling with   <\/p>\n
husband had given a sum of’E?_s.2,00Q_\/0? to  <\/p>\n
this was witnessed by them, theyywere  enmity with
\nher husband and theyzljy\u00e9fere   in this
\nconnection. On   herself and
\nher children  the liusband had gone to
\nplay cards.  about 8.30 pm one
\nNanjaiVahllllca1ig’.\u00a7’_.V  informed her that her
\nhusband   by the accused persons and<\/p>\n
deadbodyillof _her,l’1usband has fallen in a pit belonging to<\/p>\n
onelChikkagangaiah’.”it When she Went near the place, the<\/p>\n
  accuseld\u00abgoing away from the place of occurrence and<\/p>\n
  and gave complaint to the police. The said<\/p>\n
 comptaint was received by the police at 2.00 pm on<\/p>\n
 5i4l;’i23_001 and a case in Crime No.33\/01 is registered for the<\/p>\n
  offence punishable U \/ s 302 IPC. The police after completion<\/p>\n
of the investigation, have \ufb02ied charge sheet against the
\naccused persons. A4 by name Nanjaiah has died in the<\/p>\n
intervening period and hence case against A4 is abated. The<\/p>\n
appeal has been fiked against four other accus–eidr.befor’eAV’V<\/p>\n
Court.\n<\/p>\n

exarnination”o.n  dead ‘body of the deceased. He has found<\/p>\n
asananya as. six injuries on the person of the deceased and<\/p>\n
  opined.\u00e9vtheiddeath of the deceased was due to shock and<\/p>\n
haen1orrhat’gEe’iVas a resuit of injury to carotid arteries and<\/p>\n
 internaijugular veins as per EXP 18. — PM report.<\/p>\n
 7. PW20 — Parvathamma is the wife of the<\/p>\n
 Wtfeceased. She has stated that on the date of offence, when<\/p>\n
she was in the house, her husband and daughter was akso<\/p>\n
present. After her husband went to piay cards by taking<\/p>\n

Rs.4000\/– which was kept by him by sale-of  herv. <\/p>\n

Nanjaiah came to her house     told her
\nthat the accused  near the
\nmanure pit belonging to   which is at a
\ndistance of   “‘fh.ereafter, she went to
\nthe said   her way, she met her
\ndaugk;.teru%:  toidtvtther that the accused were
\nassaulhn\u00e9 iorder to kill him. Learning the<\/p>\n
inforrriationg’ she .went. near the pit and saw all the accused<\/p>\n
  pe’r.sionseV.runningH away. She has stated that she saw axe in<\/p>\n
  tif1e’Vdo4f4Vt;’\u00a7:1′,’:..Machu in the hand of A2, another Machu in<\/p>\n
thethand  On seeing her, the accused told her that they<\/p>\n
 have ‘fi_ni:shed her husband. She saw blood stains on the axe<\/p>\n
“it andjmachu. There were two notes of Rs. 10\/ – near the dead<\/p>\n
  Sbody. She has further stated that some one in the village<\/p>\n
seems to have given the complaint. She did not lodge the
\ncomplaint. However, the police have recorded her statement<\/p>\n
and she has given statement before the police and her<\/p>\n

\nfather. She has statedthat  aisAS$1l’u1i_tede.0_I1 therigh,t side of
\nthe neck of her father,  cut bleeding
\ninjuries. A-2 and ai5ai;_1t\u00e9d  Machu on the
\nchest,    body of her father. Her
\n  and there was profuse
\nbleeding: vinjuriesisustained injuries, he saw her<\/p>\n
father the ground. There was blood spilled on<\/p>\n
 A.Thella\u00a7{e”and machhus stained with blood. She<\/p>\n
 al two Rs.10 notes having fallen down. She<\/p>\n
hasllfurtherilistated that she could see the incident because of<\/p>\n
 street”1ig11t and moon light. She has watched and seen the<\/p>\n
 incident from a distance of about 5 feet and because of that<\/p>\n
  she could not save her father and she was frightened by<\/p>\n
seeing the axe and machhu. in the cross examination, it<\/p>\n
suggested that she has not seen the incident and that there<\/p>\n
