He was in the employment of the<br \/>\n\tBoard from 1-6-1990. The termination of the respondent workman was<br \/>\n\trequired to be seen in view of the stand taken by the Board in its<br \/>\n\twritten statement before the Labour Court.  The concerned workman<br \/>\n\traised industrial dispute and ultimately it came to be referred to<br \/>\n\tcompetent Court being Labour Court, Gandhidham, which came to be<br \/>\n\tnumbered as Reference Case No.166 of 2001. The Labour Court after<br \/>\n\tappreciating evidence led by both the sides, came to the conclusion<br \/>\n\tthat the workman deserves to be reinstated with full back wages and<br \/>\n\tcontinuity of services and passed order on 8-1-2004.  The same is<br \/>\n\timpugned as stated herein above.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tMunshaw has submitted that impugned award deserves to be quashed and<br \/>\n\tset aside as the workman appears to have been not vigilant and<br \/>\n\tinterested in persuing his remedy and, therefore, he approached the<br \/>\n\tCourt belatedly and it itself is sufficient to come to the<br \/>\n\tconclusion that the workman was not interested in serving the Board.<br \/>\n\t He submitted that fact remains to be noted that workman was in<br \/>\n\temployment of the Board since 1-6-90 and services were put to an end<br \/>\n\ton 16-11-96.  He approached belatedly and raised industrial dispute<br \/>\n\tonly after period of four years as can be seen as Reference, which<br \/>\n\twas filed in the year 2001. Delay itself is indicative of workman<br \/>\n\tnot interested in persuing his remedy.  Mr. Munshaw, however, could<br \/>\n\tnot point out any compliance of mandatory provision of the<br \/>\n\tIndustrial Dispute Act before the services of workman came to be<br \/>\n\tterminated.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tSoni appearing for respondent-workman in presence of workman<br \/>\n\tconcerned and under the instruction of concerned workman, submits<br \/>\n\tthat respondent workman is prepared to give up entire amount of back<br \/>\n\twages as granted by  the order of Labour Court and submits that<br \/>\n\treinstatement be ordered within stipulated period.  This concession<br \/>\n\tis given under the instruction of respondent workman who is present<br \/>\n\tin the Court.  Shri Soni further submitted that in identicle matters<br \/>\n\tof other workmen, this Court rejected the petition filed by the<br \/>\n\tBoard being Special Civil Application No.7836 of 2004 to 7844 of<br \/>\n\t2004, though in that case workmen were not granted back wages.<br \/>\n\tPresent workman is on better footing in as much as he had put in<br \/>\n\tfive years services before the unfortunate termination came into<br \/>\n\tbeing. Therefore, he is entitled to be treated with those who are<br \/>\n\tcovered by the earlier award so far back wages is concerned.\n<\/p>\n<p>This<br \/>\n\tCourt has heard parties, and perused papers. Labour Court has in<br \/>\n\tunequivocal terms recorded clear finding that there was absolutely<br \/>\n\tno compliance with mandatory provision of Sec.25(F) of the<br \/>\n\tIndustrial Dispute Act.  It is not in dispute that workman was<br \/>\n\tserving with the Board since 1-6-90 to 16-9-1996. Non-compliance<br \/>\n\twith mandatory provision leaves no room for any other view but that<br \/>\n\tthe impugned termination was bad and to quash the action which was<br \/>\n\tper se illegal and, therefore, there cannot be any manner of doubt<br \/>\n\tthat the action of termination was contrary to the mandatory<br \/>\n\tprovision of law rendering the same absolutely unsustainable.\n<\/p>\n<p>The<br \/>\n\taspect of belatedly raising industrial dispute deserves<br \/>\n\tconsideration. Mr. Soni relied upon decision of this Court in the<br \/>\n\tcase of <a href=\"\/doc\/143404322\/\">Deputy Executive Engineer, Panchayat Sub-Division-2 vs.<br \/>\n\tJitgendrakumar Ranchhodbhai Bhatt,<\/a> reported in 2002(3) G L H 434,<br \/>\n\twhich is applicable to the present case so far as belatedly<br \/>\n\treference is concerned.  The plea can be taken care in view of the<br \/>\n\tconcession given by the workman concerned, and therefore, the<br \/>\n\tpetition deserves to be allowed partly and the awrd deserves to be<br \/>\n\tmodified to the extent that the workman is not entitled to any back<br \/>\n\twages as he has given up expressly before this Court. The order<br \/>\n\timpugned shall be modified only to that extent.\n<\/p>\n<p>The<br \/>\n\tpetition, therefore, partly allowed. Rule is made absolute to the<br \/>\n\taforesaid extent only. No order as to costs.\n<\/p>\n<p>The<br \/>\n\torder has been confirmed so far as reinstatement is concerned.
