On completion of all<br \/>\nthe legal formalities, the Special Land Acquisition Officer by award<br \/>\ndated 28.07.1997 granted compensation @ Rs.1.35 per sq. metre. Being<br \/>\naggrieved by the same, the claimants preferred applications before<br \/>\nthe S.L.A.Q. requesting to refer the issue to the competent Court,<br \/>\nwhich, ultimately, culminated into references. The reference Court,<br \/>\nafter appreciating the evidence on record, partly allowed the<br \/>\nreferences. Being aggrieved the same, the appellant has approached<br \/>\nthis Court by way of these appeals.\n<\/p>\n<p>3.0\t\tHeard<br \/>\nlearned counsel for the respective parties. While passing the<br \/>\nimpugned award, the reference Court has relied upon an award passed<br \/>\nin an earlier case being L.A.R. No.334 of 1988 dated 06.01.1997<br \/>\nwherein, the reference Court has awarded an amount of Rs.12.50 per<br \/>\nsq. metre as compensation for the acquired lands. The said award was<br \/>\nconfirmed in appeal by this Court in First Appeal No.3712 of 1997.\n<\/p>\n<p>4.0\t\tIn<br \/>\nthat case, the Notification u\/s.4 in L.A.R. No.334 of 1988 was<br \/>\npublished on 14.03.1984. In the present case, the said Notification<br \/>\nwas published on 17.05.1975, i.e. after a period of 11 years and 2<br \/>\nmonths and by taking 10% rise p.a. for every year, on the basis of a<br \/>\ndecision of this Court passed in S.L.A.Q., Bharuch v. Motibhai<br \/>\nMohanbhai reported in 1997(2) G.L.H. 773, the reference<br \/>\nCourt assessed the market value of the land at Rs.25\/- per sq. metre.<br \/>\nConsidering the facts of the case, I am of the opinion that the Court<br \/>\nbelow was completely justified in passing the impugned award. I am in<br \/>\ncomplete agreement with the reasonings given by and the findings<br \/>\narrived at by the reference Court and hence, find no reasons to<br \/>\ninterfere in these appeals.\n<\/p>\n<p>5.0\t\tFor<br \/>\nthe foregoing reasons, the appeals are dismissed.
